Abstract

Zakat, infaq and almsgiving is one of the worship in Islam to seek pleasure from Allah SWT. In Islam besides worshiping zakat, infaq and almsgiving are also effective solutions for poverty alleviation. Therefore a zakat, infaq and alms management body is needed which has a good management mechanism and has an optimal role in efforts to improve the economy in the community. LAZISNU Metro City was formed in order to maximize the management of zakat and maximize the increase in the economy of the community in Metro City. This research is a field research with theoretical, normative, pedagogical and philosophical approaches. Sources of data sourced from primary data obtained from the results of direct interviews and secondary data in the form of written information from the literature. Data collection through observation, documentation interview, triangulation and final stages is to draw conclusions. The results of this study indicate that the zakat management mechanism that exists in LAZISNU Metro City is quite good, but there are still some parts that are not maximal due to the obstacles faced. The role of zakat, infaq and almsgiving in an effort to improve the economy of the community in Metro City runs in the form of consumptive assistance and productive assistance. The implementation is carried out based on Islamic law and the Law. Therefore LAZISNU Metro City needs to continue to evaluate in order to achieve a maximum role in an effort to improve the economy of the community in Metro City.

Abstract

Background.The application of Islamic family law has differences in Islamic countries. The differences stem from the interpretation and understanding of the relationship between Islam and the state (din wa siyasah), the ideological basis of the state, the Islamic style of the mainstream Muslim population, traditions and socio-cultural realities, and their respective historical backgrounds.Aim. This library research article review uses a philosophical and sociological approach in each country which sets the minimum age limit for marriage to examines the comparison of Islamic family law in the Islamic world.Results. The existence of Islamic family law in the world as positive law has different forms. There are three categories of countries based on the adopted family law; 1) Countries that apply traditional family law. Countries that fall into this category are Saudi Arabia. Yemen, Kuwait, Afghanistan, Mali, Mauritania, Nigeria, Sinegal, Somalia. 2) Countries that apply secular family law. Included in this category are Turkey, Albania, Tanzania, the Muslim minority of the Philippines. 3) Countries that implement the updated family law. countries in the category of carrying out substantive reforms and or regulatory reforms. The reform of Islamic family law was carried out for the first time in Turkey, followed by Lebanon and Egypt, Brunei, Malaysia and Indonesia.

Abstract

Background. There is no corner of space that is not touched by Islamic law, the difference in legal products from the results of ijtihad scholars is a blessing for the people. The problem is; Why do scholars differ on a religious issue? Aim. This study aims to explore the ijtihad method of madhhab scholars used as a tool to analyze all phenomena that occur, so that the roots of these differences are known.Methods. This research is a type of qualitative research in the form of library research, by exploring the arguments and methods used by scholars who then make legal products that are different from one another.Results. The results of this study indicate that differences are mercy, as long as these differences do not cause division, and always bring benefit with logical arguments and can be accepted by common sense, even though there are two types of differences, namely differences in reason (ikhtilaf al-aql), and differences in morals. (ikhtilaf al-akhlak), differences occur due to unequal contextualization, thus requiring different arguments and methods of ijtihad, resulting in unequal products from one another.

Abstract

This article analyzed wife discrimination in the household viewed from the perspective of the Convention for the Elimination of All Forms of Discrimination Against Women (CEDAW) and Islam Mubādalah. Regulation of wife obligation in the household are stated in the Marriage Law (UUP), Number 1 of 1974, article 34 paragraph (b) saying that “A wife has duty to manage household affairs as well as possible”. The fact shows that the regulation is widely understood literally, hence it creates gender bias stigma and a wife discrimination. The study was a library research using a normative approach, which examined the Marriage Law with qualitative analysis and applied gender justice theories. The research showed that the regulation in the article 34 of the Marriage Law is interpreted textually, which has implications for discrimination against wife roles in the household. As the result, this understanding affects on wife discrimination and againsts gender justice in the perspective of CEDAW and Islam Mubādalah. As the novelty, the authors found that the wife discriminations in the household are due to the strong pratiarchical perspective in the article 34 of Marriage Law, and the article tends to be a masculine perspective.

Abstract

Penelitian ini ditulis untuk menjelaskan mengenai pernikahan dalam masa iddah perspektif Hukum Islam dan Undang-undang perkawinan.kompleksitas permasalahan perkawinan ini ditunjukkan oleh berbagai macam problematika yang muncul dari zaman ke zaman dan jika dilihat dari sisi sosiologis dipengaruhi oleh perubahan sosial seiring perkembangan zaman yang menyebabkan perubahan way of thinking (cara berfikir) manusia kemudian mempengaruhi way of action (cara bertindak) yang mengubah way of life (cara hidup) manusia secara umum dan muslim secara khusus. Salah satu problematika yang muncul akibat perubahan sosial tersebut adalah perkawinan yang dilakukan dalam masa iddah. Yang berakibat dampak baik dari sisi indvidual maupun sosial masyarakat. Jenis penelitian ini adalah field research yang bersifat diskriptif kualitatif. Dengan menggunakan tehnik pengumpulan data secara analisis kualitatif. Dengan analisis ini diharapkan dapat menghasilkan deskripsi yang lebih objektif dan sistematis tentang faktor dan dampak perkawinan dalam masa iddah perspektif hukum Islam dan Undang-undang perkawinan (studi kasus di Kecamatan Trimurjo, Kabupaten Lampung Tengah). Dari penelitian diatas peneliti mendapat kesimpulan bahwasanya faktor-faktor dan dampak dari perkawinan yang dilakukan dalam masa iddah adalah faktor internal (faktor pendidikan, ekonomi dan biologis) dan faktor eksternal (lemahnya tingakat kontrol tokoh Agama dan Publik. Sedangkan dampak dari pernikahan tersebut adalah dampak individual dan sosial.

Abstract

Radikalisme atas nama agama, yang tidak jarang menggunakan instrumen kekerasan menjadi fenomena menonjol dan menarik perhatian kembali dunia internasional saat ini. Pondok pesantren merupakan insitusi pendidikan agama Islam yang sangat fungsional. Pesantren mampu memberi jawaban terhadap berbagai permasalahan yang dihadapi masyarakat serta mampu mempertahankan eksistensinya meskipun perubahan zaman berjalan dengan sangat pesat. Penelitian ini bertujuan untuk menggambarkan pemberdayaan pondok pesantren NU dalam upaya deradikalisasi di Kota Metro. Penelitian ini adalah penelitian lapangan (field research) yang bersifat deskriptif. Pengumpulan data dilakukan dengan metode wawancara (interview) dan metode dokumentasi. Analisis data dilakukan dengan model analisis mengalir (flow model of analysis). Hasil penelitian menunjukkan bahwa belum ada ada indikasi atau benih-benih radikalisme di Pondok Pesantren se-Kota Metro baik dari sisi pengajar maupun santri. Namun, pihak Pondok Pesantren se-Kota Metro berupaya untuk membangun kerja dengan pihak kepolisian dan antar sesama pondok pesantren untuk melakukan pencegahan dengan berbagai cara baik secara internal maupun eksternal.

Abstract

Wakaf adalah perbuatan hukum waqif untuk memisahkan dan/atau menyerahkan sebagian harta benda miliknya untuk dimanfaatkan selamanya atau untuk jangka waktu tertentu sesuai dengan kepentingannya guna keperluan ibadah dan/atau kesejahteraan umum menurut syari’ah. Permasalahan yang terjadi pada harta wakaf seperti yang terjadi di Desa Karang Anyar Kecamatan Jati Agung Kabupaten Lampung Selatan, disana tejadi peristiwa pengambilan kembali harta wakaf oleh wakif yang pada awalnya wakaf untuk pondok pesantren diambil kembali oleh wakif untuk di wakafkan kembali untuk dijadikan pasar. Hasil Penelitian ini menunjukkan bahwa hukum pengambilan kembali harta wakaf oleh wakif didesa Karang Anyar Kecamatan Jati Agung Kabupaten Lampung Selatan dalam Perspektif Hukum Islam sudah jelaslah bahwa pengambilan kembali harta wakaf oleh wakif tidak diperbolehkan, karena para Imam Madzhab berpendapat kepemilikan harta wakaf bukan pada wakif bahkan wakif sudah tidak mempunyai hak atas wakaf itu. Sedangkan dalam UU No. 41 Tahun 2004 Tentang Wakaf dijelaskan bahwa harta wakaf tidak boleh diambil kembali oleh wakif, namun dalam kasus Pengambilan Kembali Harta Wakaf Oleh Wakif Di Desa Karang Anyar Kecamatan Jati Agung Kabupaten Lampung Selatan harta wakaf belum di daftarkan ke Pejabat Pembuat Akta Ikrar Wakaf (PPAIW), maka secara hukum tanah tersebut masih milik orang yang namanya tertulis di dalam surat tanah tersebut.

Abstract

The aim of this study was to know how the portrait of social interactions that occur between villagers in the Perspective of George Herbet Mead's symbolic intercationalism theory and to determine the factors that support social interaction between villagers. This article was descriptive qualitative. The researchers used documentation, observation and interviews in collecting the data. The result show that The form of social interaction that occurs between Restu Buana villagers and Bumi Nabung Ilir village residents is in the form of associative-cooperation (in the form of trade / buying and selling between villagers, friendship)/ Second, it is in the form of associative-accommodation (that is, in the event of a fight, usually with mediation by leaders religious. Third, the form of dissociation f-Contravention which is manifested by the feeling of resentment. Fourth, which is in the form of dissociative-competition such as competition in the economy. Factors that support social interaction: first, there is mutual tolerance between residents. Thirdly their mutual appreciation of cultures of other villagers.
