Abstract

Article 209 of the Compilation of Islamic Law normatively limits the recipients of wasiat wajibah ‘mandatory bequests’ only to adopted children and adoptive parents with a maximum limit of one-third of the testator's property. However, the development of the Supreme Court's jurisprudence shows that there is an expansion of the recipients of compulsory probate to other parties such as stepchildren, children from unregistered marriages, and non-Muslim heirs, which creates a gap between written norms and judicial practice. This study aims to analyze the legal considerations of the Supreme Court in expanding the subject of compulsory probate recipients and its contribution to the renewal of probate law in the development of national law. The research uses an empirical juridical approach with data collection techniques through documentation studies of Supreme Court decisions, laws and regulations, and legal literature, which are analyzed descriptively- analytically using maqāṣid al-sharī'ah theory, legal reform theory, and legal discovery theory; validation is done through triangulation of primary and secondary legal sources. The results show that the Supreme Court's consideration in expanding the mandatory bequests is based on the recipient's real contribution to the testator, social proximity, and protection of vulnerable parties for the sake of substantive justice. Theoretically, this research contributes to the development of the concept of maqāṣid al-sharī'ah-based mandatory bequests and strengthens the legitimacy of jurisprudence as an instrument of Islamic law reform in Indonesia's national legal system, especially in bridging the tension between normative norms and social reality.

Abstract

The progress of modern times is often viewed as a driving force behind advancements in human life. However, it has also had adverse effects on the development of communal values, cultural traditions, and religious beliefs within local communities that have thrived for generations. This study aims to explore the significance of the local culture and religion of Serwisu Hamutuk in the lives of border communities, examine the socio-economic changes that have contributed to the decline of this practice, and propose a revitalization model for Serwisu Hamutuk that enhances community empowerment in border areas. The research employed descriptive qualitative methods, including participatory observation, in-depth interviews, and documentation studies. Data analysis was conducted using the interactive model of Miles and Huberman, combined with contextual theological interpretation. The findings reveal that the practice of Serwisu Hamutuk has evolved into a semi-transactional form as younger generations adapt to economic pressures. These economic factors pose challenges to maintaining the symbolic and religious meanings associated with the practice, which are crucial for fostering community cohesion among border populations. In homogeneous communities, the significance of Serwisu Hamutuk tends to diminish, whereas in heterogeneous communities, it appears to grow stronger. This study advocates for the revitalization of Serwisu Hamutuk to preserve social solidarity and the religious identity of border communities. Furthermore, it contributes to the fields of cultural and religious studies by offering an empowerment model rooted in local wisdom and religious values, integrating both customary and religious authority, and ultimately fostering harmony in communal living.

Abstract

Padang Ampera restaurants, as diaspora manifestations of Minangkabau culture in urban Java, do not merely display decorative visual elements for commercial attraction. Their logos, colors, spatial markers, ornaments, halal labels, and typographic choices function as a system of signs through which identity is communicated, negotiated, and legitimized This study integrates Islamic aesthetics to explain the ethical and formal boundaries of visual expression with cultural semiotics to interpret branding as a cultural text. To achieve this objective, a qualitative descriptive-analytical approach was implemented, involving field observations at 45 Padang Ampera restaurants across Bandung, Yogyakarta, and Malang, alongside in-depth interviews with 15 informants, including 5 owners and 10 patrons. These methods allow for a systematic decoding of how Minangkabau memory, Islamic values, and the social meaning of hospitality are materialized in contemporary commercial spaces. Through this combined framework, the branding of Padang Ampera restaurants can be understood not only as a marketing strategy but also as a signifying practice that transforms everyday commercial space into a visible expression of Muslim cultural identity. This article contributes to Islamic anthropology in at least three ways. First, it extends the discussion of Islam beyond ritual and doctrinal domains into the sphere of everyday material culture by showing how Islamic values are embodied in visual branding practices. Second, it demonstrates that restaurants can function as vernacular sites of religious-cultural expression, where design choices become a medium for articulating piety, propriety, and communal identity. Third, it highlights how Minangkabau migrants in Java negotiate continuity and adaptation through visual symbols that are both commercially effective and culturally meaningful. In this sense, the study offers a practical contribution by showing that branding in Muslim cultural enterprises may operate not only as an economic instrument but also as a medium of cultural transmission, identity preservation, and ethical representation in diaspora settings.

Abstract

This study addresses the problem of legal choice in inheritance distribution within Indonesia’s plural legal system, where Islamic inheritance law (farā’iḍ) and customary law coexist but often operate in tension. Focusing on Padang Sidempuan, a predominantly Muslim society characterized by a strong Batak Angkola patrilineal structure, this research aims to analyze how inheritance decisions are determined and negotiated in practice. Using a qualitative socio-legal approach, the study examines six inheritance cases (2023–2024) through in-depth interviews with 18 informants, analysis of Religious Court decisions, and relevant documentary evidence. The data were analyzed thematically to identify patterns of legal choice and dispute resolution. The findings reveal three distinct typologies of inheritance settlement: first, full application of Islamic inheritance law, second, dominance of customary law, and third, a negotiated hybrid model combining elements of both systems. The study further demonstrates that legal choice is shaped by the interaction of six key factors: religious literacy, patrilineal kinship structure, social authority, institutional access, economic value of assets, and gender awareness. Rather than reflecting rigid normative conflict, inheritance practices operate through dynamic processes of social negotiation that produce context-specific outcomes. Theoretically, this study contributes to the discourse on legal pluralism by conceptualizing inheritance decisions as negotiated and adaptive processes. Empirically, it provides a structured model for understanding legal choice in inheritance practices within patrilineal Muslim societies.

Abstract

This study examines a contextual interpretation of hadiths related to war, moving beyond literalist readings that often detach the texts from their historical, social, and ethical dimensions. Methodologically, the research employs qualitative textual analysis combined with hadith hermeneutics and a historical-critical approach, supported by a maqasid al-sharia framework. The study focuses on a selected corpus of approximately 60–70 narrations concerning warfare, particularly the well-known hadith about the command to fight people until they profess the testimony of faith, drawn from major canonical collections such as Sahih al-Bukhari, Sahih Muslim, Sunan al-Tirmidhi, Sunan al-Nasa’i, and Musnad Ahmad. These narrations are analyzed through thematic coding to identify patterns of literalist versus contextual interpretation, while also examining their linguistic structures, historical backgrounds, and legal-ethical implications. The findings indicate that literal interpretations, when detached from context, may contribute to rigid and exclusivist understandings that can be misused in contemporary discourse. In contrast, a contextual approach demonstrates that hadiths on war emerged within specific circumstances of defense, conflict regulation, and the survival of the early Muslim community, rather than as universal mandates for violence. By integrating linguistic analysis, historical contextualization, and the objectives of Islamic law, this study shows that these texts can be understood as ethical guidance for limiting conflict and promoting justice and peaceful coexistence. This research contributes to contemporary hadith studies by offering a systematic methodological framework that bridges classical interpretive tools and modern hermeneutical approaches, while also supporting more balanced and responsible religious understanding in plural and modern societies.

Abstract

This study examines the effectiveness of post-divorce enforcement of court decisions concerning women’s and children’s rights at the Religious Court of Batam, Indonesia. Using a qualitative field research approach, data were collected between 2023 and 2024 through in-depth interviews with 12 informants (judges, clerks, bailiffs, lawyers, and litigants), analysis of selected court decisions, and procedural observations. While judicial rulings consistently recognize rights to child custody, child support, ʻiddah maintenance, and mutʻah, the findings reveal persistent patterns of non-compliance, including child support arrears, delayed payments, and avoidance of enforcement procedures. These conditions indicate a significant gap between normative recognition and substantive realization of rights. The analysis employs a socio-legal framework of legal system effectiveness, covering legal substance, structure, and culture, and is evaluated through maqāṣid al-sharīʻah, particularly the protection of lineage, property, and life. The findings show that the main problem lies in limited enforcement capacity, reflected in the absence of automatic enforcement mechanisms, institutional constraints, and weak compliance culture. The study argues that realizing maqāṣid al-sharīʻah requires operational enforcement measures, such as automatic wage withholding, administrative integration, and systematic monitoring of maintenance obligations. Without these mechanisms, Islamic family law risks functioning only as symbolic recognition rather than as an effective system of substantive justice and social protection.

Abstract

The persistence of religious literary practices in local Muslim communities remains underexplored, particularly in explaining how such traditions sustain social meaning, identity, and cultural adaptation in contemporary contexts. This study examines the practice of reciting the Barzanji book in Lapeo Village, Polewali Mandar Regency, Indonesia as a socio-religious phenomenon reflecting an ongoing process of acculturation between Arabic literary tradition and local Mandar culture. The research aims to explain the mechanisms underlying the sustained use of Arabic in Barzanji recitation and its role in shaping and reinforcing the community’s religious identity. An explanatory qualitative design was employed to capture the depth and complexity of the phenomenon. Data were collected through in depth interviews, participant observation, and documentation, and analyzed using thematic analysis guided by reception theory, lived religion perspective, and acculturation theory. The findings indicate that Arabic functions as a symbol of sacred authority, strengthening the perceived legitimacy and authenticity of the ritual. Collective recitation operates as a mechanism of social cohesion, fostering solidarity and shared religious sentiment. The incorporation of local material symbols reflects a contextual process of cultural interpretation and adaptation. Furthermore, Barzanji serves as a form of nonformal religious education that transmits moral exemplars associated with the Prophet Muhammad. Overall, the study demonstrates that Barzanji constitutes a living religious literary practice and a dynamic socio-symbolic mechanism of religious acculturation in constructing Mandar Muslim identity.

Abstract

The modern leadership crisis is increasingly characterized by declining public trust, weakening moral legitimacy, and the dominance of instrumental power over ethical responsibility. This study employs a qualitative interpretive approach based on library research, utilizing primary data from standardized Wayang Kulit manuscripts (Mahabharata cycle) and secondary data from scholarly literature on political theory and Javanese philosophy. Data were collected through systematic documentation and close reading techniques, while analysis was conducted using a hermeneutic-semiotic approach to interpret symbols, narratives, and character relations. Theoretical frameworks from Weber’s legitimacy theory, Foucault’s concept of power, and Gramsci’s hegemony were applied to analyze the construction of power and legitimacy. Data validity was ensured through source triangulation and cross-referencing with established academic studies. The findings indicate that wayang characters embody distinct leadership archetypes: Arjuna represents reflective and disciplined leadership grounded in self-control and spiritual awareness; Bima symbolizes assertive and justice-oriented leadership driven by courage and moral firmness; while the Punakawan figures, particularly Semar, function as moral critics who articulate collective ethical consciousness and provide checks on power. These characteristics demonstrate that leadership in wayang is not merely hierarchical but dialogical and ethically grounded, offering relevant insights for contemporary leadership practices that require accountability, integrity, and responsiveness to public values. The results confirm that local cultural heritage can serve as a source of critical insight for fostering ethical and responsible leadership. This study contributes to the expansion of wayang studies into political legitimacy theory and demonstrates that cultural narratives can provide a reflective ethical framework for addressing the challenges of modern leadership.

Abstract

This study investigates the cultural identity transformation of Sundanese women in intercultural marriages with French men living in France. Within the discipline of sociology and cultural studies, the research explores how these women negotiate the friction between Sundanese collectivist values and French individualism. Using a qualitative method and an ethnographic approach involving 15 participants married for at least five years, data were collected through in-depth interviews and field notes. The findings reveal that traditional Sundanese values, specifically the Pancawaluya philosophy (cageur, bageur, bener, pinter, singer), remain a central ethical foundation for the Sundanese women living in France. However, these values are dynamic; through Bourdieu’s concepts of habitus and hysteresis, the research shows that cultural displacement acts as a learning space rather than a failure of adaptation. The results highlight a significant transformation from a traditional "following" habitus to a "deciding" one, where women gain increased self-confidence, independence, and agency. This study contributes to the social sciences by demonstrating that ethnic identity is negotiable within Western contexts, resulting in Bhabha’s "Third Space" or hybrid identity. In conclusion, these women act as cultural mediators who successfully integrate into French society without losing their primordial heritage. This research is important as it provides insights into resilient identity formation and multicultural integration in a globalized world.

Abstract

Grounded in a constructivist paradigm and informed by phenomenological and performativity-based perspectives, this study examines the embodied transformation of the Limbuk–Cangik characters in wayang kulit purwa as a form of cultural practice within Javanese Islam. The research conceptualizes artistic transformation as an epistemic process, in which the body functions as a site for the articulation and negotiation of Islamic ethical values. Accordingly, the paper aims to analyze how such transformations reconfigure the moral, social, and pedagogical functions of these characters in contemporary Muslim contexts. Methodologically, the study adopts a practice-led research design integrated with ethnographic fieldwork, including participatory observation, in-depth interviews with puppeteers, digital archive analysis, and visual studies. Data are analyzed using an interactive model of condensation, display, and verification, supported by triangulation across sources and methods. This approach enables the integration of experiential knowledge derived from artistic practice with empirical cultural analysis. The theoretical framework draws on cultural hermeneutics, embodiment theory, and theories of Islamic performativity, situating wayang as a medium through which religious values are materially and socially mediated. The findings indicate a shift from a ritualized shadow medium to a more communicative three-dimensional embodiment, which enhances audience engagement without diminishing ethical integrity. Rather than eroding Islamic moral values, this transformation reconstructs their social function through adaptive visual and performative strategies. This study contributes to the development of a practice-based framework in Islamic art studies by proposing the concept of visual cultural ijtihād, in which artistic practice operates as a mode of knowledge production. It further demonstrates that the reconstruction of tradition enables the expansion of cultural da’wah while sustaining its moral and cultural legitimacy in contemporary Muslim society.
