Abstract

COVID-19 yang menggemparkan dunia saat ini membuat banyak pihak mengalami dampaknya. Di Indonesia sendiri, pandemi ini berdampak pada pengangguran, banyak sekali masyarakat yang menganggur akibat pandemi ini. Menurut data dari BPS, Tingkat Pengangguran Terbuka (TPT) Agustus 2021 sebesar 6,49 persen, turun 0,58 persen poin dibandingkan dengan Agustus 2020. Terdapat 21,32 juta orang (10,32 persen penduduk usia kerja) yang terdampak COVID-19. Terdiri dari pengangguran karena COVID- 19 (1,82 juta orang), Bukan Angkatan Kerja (BAK) karena COVID-19 (700 ribu orang), sementara tidak bekerja karena COVID-19 (1,39 juta orang), dan penduduk bekerja yang mengalami pengurangan jam kerja karena COVID-19 (17,41 juta orang). Menurunnya berbagai aktivitas ini berdampak pada kondisi sosial-ekonomi masyarakat, khususnya masyarakat rentan dan miskin. Oleh sebab itu, pemerintah, baik di tingkat pusat maupun daerah, mengeluarkan berbagai kebijakan untuk menanggulangi penyebaran COVID-19 serta kebijakan kebijakan yang bersifat penanggulangan dampak sosial dan ekonomi akibat pandemi ini. Kendati demikian, pelaksanaan berbagai kebijakan ini perlu dipantau dan dievaluasi untuk mengetahui efektivitasnya. Berdasarkan permasalahan tersebut, penulis melakukan pengabdian pada masyarakat melalui kegiatan pengabdian secara online yaitu Menghasilkan Pasif Income Dengan Alat Digital dan juga usaha alternatif yang bisa dilakukan selama masa pandemi berupa Pembuatan Wedang Uwuh dan juga Inovasi Aquascape sebagai terobosan usaha untuk masyarakat.

Abstract

This scientific paper analyzes the juridical analysis of profit-sharing agreements on split land in Dengkol Village, Malang Regency. The legal issue to be analyzed is a land dispute case in Malang Regency. The purpose of this research is to reach an agreement on land disputes that benefit both parties, namely between the Air Force and the Community and to find out the problems that occur and result in land disputes. This study uses a normative legal research method based on a study of cases and laws and regulations. The land dispute that occurred in Malang Regency was proven to have occurred due to incitement carried out by the local village head who was assisted by irresponsible persons, in this case it was also resolved in a non-litigation manner which was carried out outside the court and carried out by mediation.

Abstract

Law Number 20 of 2016 concerning Trademarks and Geographical Indications provides protection against the use of famous persons' names, photos, and legal entity names in trademark applications submitted to the Directorate General of Intellectual Property. Article 21 paragraph (2) letter a stipulates that a trademark application will be rejected if such elements are used without written consent from the rightful party. However, this provision only results in an administrative sanction rejection of the application without any accompanying criminal sanctions for violations. This normative gap reveals a significant weakness in the legal protection system for intellectual property in Indonesia. This study aims to analyze this legal void and provide recommendations for a more comprehensive legal framework, including the possibility of imposing criminal sanctions. The method used is normative juridical, involving analysis of legal statutes, legal literature, and comparative studies. The findings indicate that criminal sanctions are necessary to ensure deterrence and provide effective legal protection for owners of famous names and legal entities from acts that exploit or damage their reputation.

Abstract

This community service program aimed to empower farmers in the Taman Madani Farmers' Community, Nongkojajar, by enhancing entrepreneurial skills through digital technology and business innovation. Over 14 weeks, the Agriculture Community Business Creation Program provided training and mentorship to 40 participants on micro-enterprise development, covering business planning, financial management, digital marketing, and product innovation. The program was conducted in four phases: preparation, training, independent business initiation, and development. Participants were introduced to digital tools like Facebook for marketing, along with practical business planning exercises. Despite challenges such as limited internet access, the program significantly improved participants' understanding of business management, marketing, and product development. Many began adopting digital platforms to expand their market reach, increase sales, and improve product competitiveness. The results demonstrated substantial progress in business operations, with participants showing greater confidence in managing their enterprises. Moving forward, recommendations include expanding access to financial support, increasing the frequency of training sessions, and providing continuous mentorship to ensure sustainable business growth and long-term success. By fostering innovation and digital adoption, this program has helped rural farmers build more resilient and competitive businesses in an increasingly digital economy.

Abstract

General Background Traditional cultural expressions constitute communal cultural heritage embodying identity, philosophy, and collective memory, requiring legal protection aligned with their communal and sacred nature. Specific Background In Indonesia, traditional batik motifs—particularly the sacred Parang motifs of the Yogyakarta Sultanate—are classified as traditional cultural expressions whose copyright is declared “held by the state” under Article 38 paragraph (1) of Law No. 28 of 2014 on Copyright. Knowledge Gap This formulation contains normative ambiguity, as it does not clearly define whether state authority represents ownership, public trusteeship, or mere administrative control, resulting in weak legal certainty for indigenous custodians. Aims This study examines the legal meaning of the phrase “held by the state” in relation to the protection of sacred Parang batik motifs within the framework of traditional cultural expressions. Results The analysis shows that the provision functions as a declarative norm lacking substantive mechanisms, failing to recognize customary authority, community consent, or benefit-sharing, and thereby permitting desacralization and misuse of sacred motifs. Novelty This research clarifies that state control over traditional cultural expressions should be interpreted as public trusteeship rather than ownership, drawing comparative insights from community-centered protection models in India and Thailand. Implications The findings support the development of a sui generis legal framework integrating customary law, community participation, and administrative facilitation to ensure sustainable and culturally respectful protection of sacred batik motifs. Abstract

Introduction: Traditional batik motifs are one of the traditional cultural expressions that are the object of intellectual property law protection. The social, cultural, moral, and spiritual values ​​contained in traditional batik motifs are a cultural heritage passed down from generation to generation and are sacred. In Indonesian positive law, protection of traditional cultural expressions is stipulated in the Copyright Law and the Government Regulation on Communal Intellectual Property. Purposes of the Research: This research will focus on the review of copyright protection for traditional cultural expressions held by the state. Furthermore, this study will also discuss the importance of implementing FCIP principles in ensuring the involvement of indigenous communities in decision-making. Methods of the Research: The method used in this study is doctrinal legal research using legislative and conceptual approaches. The collection of legal materials in this study uses a literature study. Results Main Findings of the Research: Copyright protection for traditional cultural expressions is held by the state. However, in its implementation, the concept of protecting traditional cultural expressions held by the state lacks clear regulations regarding its technicalities and mechanisms. The existence of the state as the holder of copyright degrades the ownership status of traditional cultural expressions by communal communities. The minimal participation of communal communities in decision-making also indicates weaknesses in the legal protection of traditional cultural expressionsThe state's guardianship of copyright over traditional cultural expressions has weaknesses and requires reform by changing the protection mechanism to a legal protection manager by strengthening the application of FCIP principles.

Abstract

This study aims to analyze the legal consequences of Indonesia’s ratification of the GRATK agreement on the patent framework. As is known, the recognition and protection of Intellectual Property Rights (IPR) has undergone rapid development, especially communal IPR such as the protection of genetic resources and traditional knowledge, which demand fair and adequate legal protection for all parties. The emergence of unfair practices in the use, commercialization (biopiracy), and restriction of ownership of traditional knowledge through IPR instruments has created a conflict of interest between the owners of traditional knowledge and those who develop and commercialize it. This research focuses on the legal protection of traditional knowledge through the international agreement, the GRATK Treaty, which the Indonesian government has signed, and its legal consequences. This study uses normative legal research, analyzing Law No. 65 of 2024 concerning Patents and the 2024 GRATK Treaty as the main sources. The results of the study show that the GRATK agreement provides a fair framework for the recognition and legal protection of genetic resources, as desired by countries that own genetic resources in a world dominated by developing countries. However, the study also argues that while the GRATK Agreement and its incorporation into Indonesian patent law represent significant progress, their effective implementation requires comprehensive regulatory harmonization and the development of sui generis mechanisms to protect communal intellectual property, thereby safeguarding the national interest in genetic resources and traditional knowledge.
