Abstract

The purpose of this study is to identify a model in the protection of traditional knowledge (TK) of medicinal herbs by adopting a comprehensive protection instrument, comprising positive and defensive protection. Based on the regulation of TK in international conventions and the national laws, the best practice for the protection of TK of medicinal herbs is by implementing a sui generis regulation that stems from the principle of justice in fulfilling the traditional communities’ rights over access to health and welfare.

Abstract

Perjanjian baku dalam transaksi bisnis terjadi bukan melalui proses negosiasi yang seimbang diantara para pihak yang melakukan penandatanganan perjanjian karena hanya salah satu pihak saja yang membuat isi perjanjian. Perjanjian pemberian kredit dapat dikategorikan sebagai kontrak baku. Hal ini dapat dilihat dari bentuk dan format perjanjian kredit yang diserahkan sepenuhnya kepada masing-masing bank. Sehingga, klausula-klausula dalam dokumen perjanjian kredit semuanya dibakukan tanpa pemberian kebebasan untuk menegosiasikan kembali isi klausula kepada pihak nasabah debitur.

Abstract

Indonesia is a culturally megadiverse country, which is a source of Communal Intellectual Property. However, Communal Intellectual Property that has high economic value can lead to the misappropriation and destruction instigated by foreign parties. Thus, a Communal Intellectual Property legal protection is needed in the international and national law. This research aims to describe about communal intellectual property in national and international law. By using normative juridical research, statute approach, conceptual approach, and comparative approach regarding primary and secondary legal materials, it is then analyzed with the findings that Communal Intellectual Property protection in international and national law do not only cover legal protection in the field of Intellectual Property Rights. It also encompasses nonIntellectual Property Rights legal protection, both preventively and repressively (hybrid protection). This research has an essential meaning in the formation of national law on sui generis Communal Intellectual Property by adopting the best practices in the Philippines.Indonesia adalah negara yang kaya dengan keanekaragaman budaya, sebagai sumber Kekayaan Intelektual Komunal. Namun, dalam perkembangannya, Kekayaan Intelektual Komunal yang memiliki nilai ekonomi tinggi menjadi potensi penyalahgunaan dan perusakan oleh pihak asing, sehingga diperlukan perlindungan Kekayaan Intelektual Komunal dalam hukum internasional dan hukum nasional yang memadai. Penelitian ini bertujuan untuk memaparkan perlindungan Kekayaan Intelektual Komunal dalam hukum nasional dan internasional. Dengan menggunakan jenis penelitian yuridis normatif dan pendekatan peraturan perundangan, pendekatan konseptual, serta pendekatan perbandingan dari bahan hukum primer dan bahan hukum sekunder, maka kemudian dianalisis dengan temuan bahwa perlindungan Kekayaan Intelektual Komunal dalam hukum internasional dan hukum nasional tidak cukup hanya dengan perlindungan hukum di bidang Hak Kekayaan Intektual, namun juga meliputi perlindungan hukum non Hak Kekayaan Intelektual baik secara preventif maupun represif (perlindungan campuran). Penelitian ini memiliki arti penting dalam pembentukan hukum nasional Kekayaan Intelektual Komunal secara sui generis dengan mengadopsi praktik terbaik di Filipina.

Abstract

Legal certainty is an integral part of the anatomy of the purpose of the law being formed. One of the premises that was built in assembling this anatomy occurred when we discussed the amendment of the deed carried out by persons with disabilities (people with visual impairments). Where, in principle, a notary as a public official is obliged to make sure that the deed made is understood by the appearers. When linking the aspects of Persons with Disabilities in Article 43 of the UUJN there is a provision that the Article provides legal guarantees for notarial products using an understandable language. This scheme then leads to the question that if the Notary Product uses Article 43 paragraph (1) of the UUJN, the deed must be made in Indonesian, is it written using the alphabet or using Braille?

Abstract

AbstractThis Paper aims to analyze the importance of Indonesian traditional cultural expressionsgoverned by sui generis. To obtain these objectives, this legal research uses statutory approachwith a systematic interpretation. Based on the results, it can be concluded that the regulationof Indonesian traditional cultural expression in Law Number 28 of 2014 about Copyright still cannot realize the protection of Traditional Cultural Expressions due to differences in charateristic between copyright with Traditional Cultural Expression. AbstrakTulisan ini bertujuan untuk menganalisis pentingnya ekspresi budaya tradisional Indonesia diatur secara sui generis. Untuk memperoleh tujuan tersebut, penelitian hukum ini menggunakan pendekatan peraturan perundang-undangan dengan penafsiran sistematis. Berdasarkan hasil pembahasan maka dapat disimpulkan bahwa pengaturan ekspresi budaya tradisional Indonesia dalam Undang-undang Nomor 28 Tahun 2014 tentang Hak Cipta masih belum dapat mewujudkan perlindungan terhadap Ekspresi Budaya Tradisional karena adanya perbedaan karakteristik antara hak cipta dengan ekspresi budaya tradisional.

Abstract

Justice in the field of land as a constitutional mandate is a foundation that must be regulated as contained in the provisions of Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia which states, "Earth and air and the natural resources contained therein are controlled by the state and be used for the greatest prosperity of the people.”1 In order to achieve justice according to the mandate of the constitution, at least it can be realized through infrastructure development efforts in the national strategic project plan. This is in accordance with one of the priorities on President Joko Widodo's agenda to accelerate and continue infrastructure development. One of the many infrastructures that has become the object of a national strategic project is a network of toll roads or usually called toll roads.

Abstract

Indonesia, as a country that adheres to the concept of a welfare state, seeks to achieve social welfare development by implementing a national social security system, particularly health insurance, managed by the Health Social Security Administration Agency (BPJS). It is regulated in Article 19, paragraph 1 of Law No. 40 of 2004 concerning the National Social Security System (SJSN). The fundamental principles of social insurance include mandatory participation, equitable health coverage, and contributions proportional to income. The philosophical issue at hand is whether implementing health insurance via the social insurance mechanism effectively guarantees the interests of the community while upholding the values of welfare and justice, as prescribed by the concept of the welfare state. This paper analyses the philosophical foundation underlying social insurance as a mechanism for implementing health insurance in Indonesia. This study employs normative research methods, utilising legislation as the analytical starting point. A philosophical examination is necessary to understand why, after a decade of implementing national health insurance, the state's goal of achieving welfare and social justice in health services for Indonesian citizens remains unmet. This analysis seeks to identify new mechanisms to fulfil the goals outlined in Law No. 40 of 2004.

Abstract

This paper analyzes legal issues regarding the legal protection for folk song and music licenses in Indonesia. Indonesia which has cultural diversity is expressed through several folk songs whose creators are anonymous, so they are very susceptible to being changed, re-performed in a way that is inconsistent with the values ​​that live in society and even claimed by irresponsible foreigners. This research is a normative legal research, using a statutory approach. Based on primary and secondary legal materials, then the results of the research show that the copyright of folk songs and music is a protected object in article 40 of Law Number 28 of 2014 concerning Copyright (Copyright Law), and folk songs and music whose creators are anonymous is regulated in Article 38 and Article 39 of Copyright Law. In the Berne Convention folk songs and music whose authors are anonymous are protected in Article 15 Paragraph (4.a) which regulates the protection of unpublished works, and anonymous authors from participating countries of the Berne Convention.

Abstract

Merek berperan vital dalam perdagangan modern, tetapi di Indonesia terdapat konflik norma dalam UU No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis antara Pasal 74 Ayat (1) dengan Pasal 35 Ayat (1), bagaimana mungkin merek terdaftar dapat dihapuskan meskipun masih dalam masa perlindungan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan teori serta bahan hukum primer, sekunder, dan tersier yang dianalisis secara deskriptif. Penelitian ini bertujuan menganalisis latar belakang penghapusan merek terdaftar yang tidak digunakan melalui pendekatan teori kesejahteraan sehingga diperoleh pengaturan yang tepat dan terwujud harmonisasi dengan ketentuan yang berkonflik. Hasil penelitian menunjukkan bahwa merek terdaftar yang tidak aktif harus dihapuskan karena berpotensi menyebabkan kerugian bagi berbagai pihak, khususnya dalam jangka panjang untuk perekonomian negara. Bahwa ketidakpastian hukum akibat konflik norma tersebut juga berdampak bagi pemilik merek karena berisiko kehilangan hak atas merek yang tidak aktif digunakan meskipun atas alasan ketidakaktifan yang sah. Oleh karena itu, perlu dilakukan upaya pernyataan penggunaan merek terdaftar oleh Pemilik Merek yang difasilitasi oleh DJKI sebelum jangka waktu 10 (sepuluh) tahun sehingga terdapat harmonisasi di antara ketentuan yang berkonflik. Implementasi solusi ini diharapkan dapat memberikan kepastian hukum, mendorong penggunaan merek secara aktif, dan mendukung pertumbuhan ekonomi yang berkelanjutan.

Abstract

Penulis penelitian ini menulis tentang Formulasi Pengaturan Indikator Penetapan Honorarium Notaris Sebagai Perwujudan Asas Keadilan dan Kemanfaatan Hukum (Studi Perbandingan dengan Negara India dan Negara Belanda). Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan metode pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan. Analisis dilakukan terhadap bahan hukum melalui penafsiran sistematikal kemudian diolah guna menjawab permasalahan yang diteliti. Pilihan tema tersebut dilatar belakangi oleh maraknya upaya tawar-menawar antara klien dan notaris untuk mendapatkan honorarium di bawah standar yang telah diatur dalam Undang-Undang Jabatan Notaris, yang terjadi antara notaris dengan klien yang mengakibatkan timbulnya persaingan tidak sehat antara sesama rekan notaris dan berkurangnya integritas Notaris sebagai seorang Pejabat Umum. Adanya honorarium dibawah standar ini karena terdapat ketidaklengkapan hukum di dalam Pasal 36 ayat 3 Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris. Sedangkan di Negara India dan Negara Belanda memiliki pengaturan lebih lengkap terkait dengan honorarium notaris. Berdasarkan hal ini, maka perlu adanya pengaturan yang memiliki keadilan hukum guna mencapai kemanfaatan hukum untuk menjawab adanya ketidaklengkapan atas batasan minimum honorarium notaris di Indonesia.
