Abstract

The digital era has birthed a new phenomenon in religious practices: performing the Hajj or Umrah pilgrimage on foot while broadcasting the journey through live streaming on social media platforms like TikTok. This phenomenon is often accompanied by online donation solicitations from viewers, triggering public controversy and the label of "digital begging." This research aims to analyze this phenomenon from an Islamic law perspective, specifically regarding its relevance to the concept of istitha’ah (capability) as a mandatory requirement for Hajj, while also examining the dimensions of worship ethics in the digital space. This study employs a qualitative approach with a juridical-normative method and library research. Data are analyzed by referring to classical and contemporary fiqh (Islamic jurisprudence) literature concerning the requirements of Hajj and digital muamalah ethics. Findings: The results indicate that the practice of traveling to the Baitullah by relying on social media donations does not meet the criteria for independent financial istitha’ah according to the majority of scholars. Furthermore, such actions potentially reduce the essence of the sanctity of worship, as they are susceptible to elements of riya’ (showing off), sum’ah (seeking popularity), and the exploitation of religious symbols for personal material gain. This article concludes that while technology provides new spaces for expression, a sincere and pure intention remains the fundamental basis of Islamic law in performing Hajj. Massive religious education is necessary to enhance digital ethical awareness so that the sanctity of worship remains preserved amidst the tides of modernity.

Abstract

Penelitian ini bertujuan untuk menganalisis fenomena permohonan dispensasi kawin yang diajukan oleh orang tua non-Muslim di Indonesia, dalam konteks hukum perkawinan dan perlindungan anak. Dispensasi kawin merupakan mekanisme hukum yang memungkinkan pernikahan dilakukan di bawah usia minimum yang ditentukan oleh undang-undang, dengan persetujuan pengadilan. Fokus kajian ini adalah pada aspek hukum, sosial, dan kultural yang melatarbelakangi permohonan dispensasi kawin dari keluarga non-Muslim, serta pertimbangan hakim dalam mengabulkan atau menolak permohonan tersebut. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dan sosiologis, dengan analisis terhadap putusan-putusan pengadilan Agama terkait permohonan dispensasi kawin dari pemohon non-Muslim, serta wawancara dengan aparat peradilan dan pihak terkait. Hasil penelitian menunjukkan bahwa faktor ekonomi, pendidikan, dan tekanan sosial menjadi pendorong utama permohonan dispensasi kawin, sementara pertimbangan hakim lebih menitikberatkan pada prinsip perlindungan anak dan kepentingan terbaik bagi anak. Penelitian ini merekomendasikan perlunya pendekatan yang lebih komprehensif dalam penanganan perkara dispensasi kawin, termasuk penguatan peran konseling dan edukasi kepada orang tua serta calon mempelai.

Abstract

Waqf is one of the instruments of Islamic philanthropy that has great potential in improving the welfare of the people. Nadzir holds a central role as the party responsible for the management and development of waqf assets. This article aims to examine the professionalism and ethics of waqf nadzir from the perspective of Islamic law, using the theory and analysis of maqāṣid al-sharī'ah on the practice of productive waqf in Indonesia. This research uses a qualitative-descriptive approach through the method of literature study, referring to classical and contemporary Islamic law sources as well as national waqf regulations. The results of the study show that efforts to improve the professionalism of a waqf nadzir are to prioritize the principles of Islamic law. Commitment to justice and transparency is a moral-legal responsibility in the management of waqf property. Therefore, strengthening the capacity and integrity of a nadzir is essential to make waqf an instrument for sustainable economic development of the ummah.

Abstract

This research aims to examine the role of wives of sardine factory workers at PT Pasifik Harvest Indonesia in Badean Village, Blimbingsari District, Banyuwangi Regency, as breadwinners, viewed from the perspective of the Indonesian Ulema Council (MUI) of Banyuwangi Regency. This research uses an empirical research design with a descriptive qualitative method and a case study approach. Primary data was obtained through interviews with female factory workers and MUI clerics, while secondary data was sourced from verses of the Al-Qur'an, hadith, and relevant scientific journals. Data validity was tested using the triangulation method. The research results indicate that the wife's decision to work as a factory worker is driven by economic factors, namely the husband's income, which is felt to be insufficient for living needs and children's education costs, as well as environmental factors and work habits. Working provides an opportunity for wives to contribute to the family's economic welfare and prepare for future savings, although it also poses challenges in the form of limited time with children and partners, which can potentially disrupt household harmony. According to the view of the MUI clerics of Banyuwangi Regency, the law for a wife working is fundamentally permissible as long as it does not contradict Islamic law, such as continuing to maintain modesty (aurat) and avoiding excessive mixing (ikhtilat), and is based on deliberation and the husband's permission with mutual understanding. This research confirms that the wife's role as an additional breadwinner can be in harmony with Islamic values if based on communication, agreement, and professionalism (itqan) between husband and wife.
