Abstract

Frankincense is not only an economic commodity but also a cultural entity governed by a strong customary law system in the communities that produce it, such as Tapanuli. In a customary law system that is often patriarchal, the position of women requires deeper examination. This study stems from a contradictory portrait: on one hand, women are actively involved in the frankincense value chain, yet on the other hand, their contributions are often unrecorded and marginalized, and they lack legal recognition and economic compensation. This study used a qualitative approach with a case study method in North Tapanuli. Data were collected through in-depth interviews with key informants (women artisans, customary elders, and female community leaders), participatory observation of the incense processing process, and a study of documents related to local customary rules. Data were analyzed interactively through data reduction, data presentation, and conclusion drawing techniques. The research findings show that women play a central and critical role in the post-harvest and processing stages, which determine the quality and market value of the incense. However, prevailing customary laws tend to position women in the domestic sphere and deny them access to strategic decision-making, tree ownership, and fair distribution of economic benefits. Their contributions are often categorized as 'assistance' or 'domestic obligations' rather than as economically valuable 'work' and thus are not valued equally with men's contributions. There is a significant gap between women's actual economic contributions to the Frankincense value chain and the recognition and protection provided by customary law. To achieve gender justice and women's economic empowerment, a more inclusive reinterpretation or revitalization of customary law is needed, without eroding core cultural values.

Abstract

Prinsip kebebasan berkontrak merupakan salah satu asas fundamental dalam sistem hukum perjanjian di Indonesia sebagaimana tercermin dalam Pasal 1338 Kitab Undang-Undang Hukum Perdata. Namun, penerapan asas tersebut secara absolut berpotensi menimbulkan ketidakadilan, khususnya dalam situasi kontraktual yang ditandai oleh ketidakseimbangan posisi tawar para pihak. Dalam praktik, kondisi ini kerap dimanfaatkan oleh pihak yang lebih kuat untuk mengeksploitasi pihak yang berada dalam keadaan lemah, sehingga kebebasan berkontrak kehilangan makna keadilannya. Penelitian ini bertujuan untuk menganalisis kedudukan hukum, unsur-unsur, serta akibat hukum doktrin misbruik van omstandigheden dalam sistem hukum perjanjian di Indonesia sebagai mekanisme pembatas asas kebebasan berkontrak. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan studi pustaka, dengan bahan hukum berupa KUHPerdata, doktrin, yurisprudensi, serta literatur hukum terkait. Hasil penelitian menunjukkan bahwa meskipun doktrin misbruik van omstandigheden tidak diatur secara eksplisit dalam KUHPerdata, keberadaannya diakui secara doktrinal dan yurisprudensial melalui penafsiran asas itikad baik dan kausa yang halal. Doktrin ini memiliki tiga unsur utama, yaitu adanya kondisi lemah pada salah satu pihak, adanya penyalahgunaan kondisi tersebut oleh pihak lawan, serta timbulnya kerugian yang signifikan. Perjanjian yang terbukti mengandung penyalahgunaan keadaan menimbulkan akibat hukum berupa dapat dibatalkannya perjanjian. Penelitian ini menyimpulkan bahwa doktrin misbruik van omstandigheden merupakan instrumen penting untuk mewujudkan keadilan kontraktual. Oleh karena itu, disarankan agar doktrin ini memperoleh penguatan normatif yang lebih tegas dalam pembaruan hukum perjanjian di Indonesia.Kata Kunci: Misbruik van Omstandigheden; Kebebasan Berkontrak; Cacat Kehendak; Hukum Perjanjian; Keadilan Kontraktual.

Abstract

Public service is a form of realization in conducting government administration. In this case, the public complaint service carried out by the Secretariat General of the DPR RI as a support for the DPR RI institution has tried to carry out its duties as much as possible. However, it cannot be denied that the condition of the complaint service certainly has obstacles or challenges in implementing and achieving effectiveness according to the principles of good governance. Therefore, the purpose of this research is to find out the extent to which the conditions of public complaints services have been carried out, see the effectiveness in accordance with the principles of good governance, and evaluate any challenges that become obstacles in realizing the principles of good governance. This research uses an empirical juridical method with a socio legal research approach conducted at the Public Complaints Section at the Secretariat General of the DPR RI, and obtains primary and secondary data to be analyzed with a qualitative descriptive method. The results and discussion show that the current governance condition of the implementation of public complaints services has been running well according to the legal basis that regulates it, its effectiveness with the principles of good governance has also been realized even though through several challenges, but these challenges become a form of evaluation for future service progress to be more optimal.

Abstract

This research aims to analyze the restorative justice approach in drug crimes involving children in Indonesia. The research method used a systematic literature review of 11 selected articles. The results showed that restorative justice in cases where children are involved in drugs can be carried out under the condition that the criminal sanction is less than seven years and the child is a first-time offender, whether the child is less than 12 years old or 12-17 years old. The restorative justice approach involves all parties. In cases where the restorative justice approach cannot be used, imprisonment is the final option.
