Abstract

The field of medical aesthetics has experienced rapid growth in recent years, in line with the increasing public awareness of the importance of appearance, skin care, and technological advancements in aesthetic medicine. However, behind this progress lie several legal issues that require serious attention, including unauthorized medical practice, alleged malpractice, and the inadequate legal protection afforded to both patients and medical practitioners. This study aims to examine the forms of legal protection available to doctors and patients in the practice of medical aesthetic services, with reference to Law Number 17 of 2023 on Health and Law Number 8 of 1999 on Consumer Protection. The research employs a normative juridical (doctrinal) method using a statute approach and a conceptual approach. The analysis is carried out qualitatively by examining primary, secondary, and tertiary legal materials. These two legal instruments serve as the primary foundation for ensuring legal protection for both parties; however, their implementation still requires derivative regulations and clearer enforcement mechanisms to strengthen their effectiveness. The government, the Professional Discipline Council, and the public are expected to play an active role in establishing an aesthetic medical service system that is safe, ethical, and equitable. Reforms to Indonesia’s health law framework should be directed toward an integrative and humanistic model of legal protection—one that not only safeguards medical practitioners from potential criminalization but also ensures patient safety and the protection of patients’ rights as consumers of aesthetic medical services. This study is expected to provide new perspectives and contribute to the growing body of literature in the field of health law in Indonesia.

Abstract

Surgical procedures in children with tumors constitute high-risk medical services that have the potential to give rise to medical disputes. Within the framework of health law, hospitals function not only as healthcare providers but also as legal entities responsible for service quality, patient safety, and the resolution of medical disputes. This study aims to analyze the legal responsibilities and roles of hospitals in resolving medical disputes arising from pediatric surgical procedures in children with tumors, based on Minister of Health Regulation Number 24 of 2022, Law Number 17 of 2023 on Health, and Government Regulation Number 28 of 2024. The research employs normative and empirical juridical approaches, supported by field studies conducted at H. Adam Malik General Hospital, Medan. The findings indicate that hospital legal responsibility is comprehensive, encompassing the actions of medical personnel, healthcare service systems, compliance with patient safety standards, and medical record documentation. Hospitals also play a strategic role in resolving medical disputes through non-litigation mechanisms, particularly internal mediation and patient complaint systems, in order to provide legal protection and prevent the escalation of disputes.

Abstract

Penanganan persalinan dengan komplikasi merupakan salah satu aspek krusial dalam praktik kebidanan yang menuntut ketelitian, keterampilan, dan pemahaman mendalam terhadap prosedur medis yang aman. Namun, kesalahan atau kelalaian dalam menghadapi kasus komplikasi dapat menimbulkan risiko hukum bagi bidan, termasuk tuntutan malpraktik dan sanksi profesi. Sosialisasi mengenai risiko hukum ini menjadi sangat penting untuk meningkatkan kesadaran bidan akan tanggung jawab profesional, memperkuat praktik yang sesuai standar, serta mencegah terjadinya perselisihan hukum yang merugikan pasien maupun tenaga kesehatan.Kegiatan pengabdian ini bertujuan untuk memberikan edukasi kepada bidan terkait hak dan kewajiban profesional mereka, prosedur penanganan persalinan dengan komplikasi, serta potensi risiko hukum yang dapat muncul jika prosedur tidak sesuai standar. Metode sosialisasi dilakukan melalui workshop interaktif, diskusi kasus, dan penyebaran materi panduan hukum yang relevan, sehingga bidan tidak hanya memahami aspek teoretis, tetapi juga mampu menerapkan pengetahuan tersebut dalam praktik sehari-hari. Pendekatan partisipatif ini diharapkan dapat meningkatkan kemampuan kritis dan pengambilan keputusan bidan di lapangan. Hasil kegiatan menunjukkan peningkatan pemahaman bidan terhadap risiko hukum penanganan persalinan dengan komplikasi. Peserta mampu mengidentifikasi potensi kesalahan yang berisiko secara hukum, memahami prosedur dokumentasi yang tepat, serta mengetahui langkah-langkah preventif yang harus dilakukan untuk melindungi diri dan pasien. Selain itu, sosialisasi ini juga mendorong terciptanya budaya praktik yang aman dan bertanggung jawab, yang selaras dengan standar etika dan peraturan perundang-undangan di bidang kebidanan. Kesimpulannya, sosialisasi risiko hukum penanganan persalinan dengan komplikasi bagi bidan terbukti efektif dalam meningkatkan kesadaran profesional dan kesiapan menghadapi potensi masalah hukum. Kegiatan ini tidak hanya bermanfaat bagi peningkatan kualitas pelayanan kebidanan, tetapi juga berperan dalam membangun sistem kesehatan yang lebih aman, transparan, dan berkelanjutan. Rekomendasi ke depan mencakup pelaksanaan sosialisasi secara berkala serta integrasi materi hukum dalam pendidikan berkelanjutan bagi bidan di seluruh wilayah.

Abstract

This study examines the legal role of informed consent in high-risk dental medical procedures under Law Number 17 of 2023 on Health. Informed consent represents not only an ethical obligation but also a legal mechanism ensuring patient autonomy and professional accountability. Using a normative juridical method with statutory, conceptual, and case approaches, this research analyzes how the new legal framework strengthens patient protection and defines the professional responsibilities of dental practitioners. The findings indicate that despite the law’s explicit provisions particularly Articles 293 and 294 implementation remains constrained by limited legal literacy, ineffective communication, and insufficient documentation among practitioners. From the ethical perspective, informed consent reflects respect for autonomy, while legally it serves as preventive protection against malpractice claims. Therefore, enhancing professional understanding, integrating bioethics and health law in education, and ensuring standardized consent documentation are essential to achieving transparent, fair, and patient-centered dental services in Indonesia.
