Abstract

The enforcement of criminal law starts from the legislative body that is the legislative body that makes the law and determines the norms in the form of orders and prohibitions. The legislation made by this legislative body can reflect the existence of the values of justice desired by the principle of Pancasila that is civilized or dignified justice. Criminal law enforcement is also done by the judiciary. That is the application of criminal law in the form of law by law enforcement officers either ranging from the police level to the courts. They are concrete justice enforcers. And the last is related to facilities and infrastructure that support the policy for criminal law enforcement. The process of criminal law enforcement can be effective if there is a harmony relationship starting from the investigation / investigation process at the police, prosecutor / prosecutor level until the court process and ending with the judges verdict. The legislator in this case is the legislative must be able to make regulations that can be implemented in the field. Law enforcers in carrying out their duties must be able to work professionally so as to create a sense of justice for the parties both for the perpetrator and for the victim of the crime.

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap pemilik merek terdaftar serta mengkaji ratio decidendi hakim dalam perkara tindak pidana penggunaan merek pihak lain tanpa hak (Studi Putusan Pengadilan Negeri Blitar Nomor 18/Pid.Sus/2024/PN Blt). Jenis penelitian ini adalah penelitian hukum normatif yang menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Bahan hukum primer, sekunder, dan tersier yang dikumpulkan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum represif terhadap korban telah diwujudkan melalui penjatuhan sanksi pidana berdasarkan Pasal 100 UU No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Meskipun demikian, sanksi tersebut belum memberikan perlindungan yang optimal, khususnya terkait pemulihan kerugian pemegang hak dan pemberian efek jera. Lebih lanjut, ratio decidendi hakim pada prinsipnya telah memenuhi standar pembuktian delik, namun pertimbangan hukumnya masih sangat positivistik—lebih berorientasi pada pemenuhan unsur pidana daripada penegasan fungsi merek sebagai hak eksklusif yang bernilai ekonomi. Penelitian ini merekomendasikan perlunya penguatan paradigma hakim dalam merumuskan pertimbangan hukum agar putusan pengadilan dapat lebih efektif sebagai sarana perlindungan hak kekayaan intelektual sekaligus penegakan hukum merek di Indonesia.

Abstract

Daluwarsa tindak pidana merupakan prinsip fundamental dalam hukum pidana yang berfungsi membatasi kewenangan negara dalam melakukan penuntutan dan pelaksanaan pidana setelah jangka waktu tertentu. Prinsip ini bertujuan untuk menjamin kepastian hukum, melindungi hak asasi manusia, serta mencegah penyalahgunaan kekuasaan oleh aparat penegak hukum. Namun, dalam praktik penegakan hukum pidana di Indonesia, penerapan daluwarsa sering menimbulkan berbagai problematika, seperti perkara yang mangkrak, ketidakjelasan awal penghitungan waktu daluwarsa, serta potensi impunitas bagi pelaku kejahatan tertentu. Tulisan ini mengkaji secara yuridis konsep daluwarsa tindak pidana dengan menelaah landasan normatifnya dalam KUHP, KUHAP, serta pembaruan melalui Undang-Undang Nomor 1 Tahun 2023 tentang KUHP Nasional. Selain itu, pembahasan diarahkan pada problematika penerapan daluwarsa dalam praktik serta perbandingan dengan pengaturan di beberapa negara lain. Hasil kajian menunjukkan bahwa meskipun KUHP Baru telah memperbaiki sistematika pengaturan daluwarsa, ketentuan tersebut masih menyisakan kelemahan, khususnya karena tetap memberlakukan daluwarsa terhadap tindak pidana luar biasa seperti korupsi dan pelanggaran HAM berat. Oleh karena itu, diperlukan penyempurnaan regulasi daluwarsa yang lebih berorientasi pada keadilan substantif, perlindungan korban, dan harmonisasi dengan hukum internasional.

Abstract

Freedom of expression is a constitutional right that occupies a crucial position in the structure of Indonesia's democratic rule of law, as it is guaranteed in Article 28E paragraph (2), Article 28E paragraph (3), and Article 28F of the 1945 Constitution of the Republic of Indonesia. In practice, this guarantee often clashes with restrictive policies through the Electronic Information and Transactions Law, particularly in provisions on insults, defamation, and hate speech in the digital space that have the potential to lead to multiple interpretations and criminalization of criticism. This article aims to analyze the position of freedom of expression as a constitutional right, the constitutional limits of its restrictions, and the development of the Constitutional Court's interpretation in testing the ITE Law, particularly through Decision Number 50/PUU-VI/2008 and Decision Number 105/PUU-XXII/2024. The research uses normative legal methods with statutory, conceptual, and case approaches. The results of the study indicate that the direction of the Constitutional Court's interpretation has evolved from a more permissive approach to the criminalization of expression to a more restrictive, proportional, and protective interpretation of citizens' constitutional rights in the digital space.
