Abstract

The development of information technology has expanded the forms and modes of gambling conducted through electronic systems, thereby requiring adjustments in the framework of regulation and the application of criminal law. This research aims to analyze the regulation of gambling offenses from the perspectives of the KUHP and the UU ITE, as well as to examine the application of Article 45 paragraph (3) in conjunction with Article 27 paragraph (2) of the UU ITE to the defendant in the said decision based on the prevailing legal normative construction. The research method used was normative legal research with a statutory approach and a case approach, conducted through the examination of statutory regulations, criminal law doctrines, and legal considerations contained in court decisions. The results of the research show that the KUHP as lex generalis regulates gambling by emphasizing acts of providing, giving opportunities, as well as participating in gambling activities as regulated in Article 303 and Article 303 bis of the KUHP. Meanwhile, the UU ITE as lex specialis contains regulations concerning acts of distributing, transmitting, or making accessible electronic information containing gambling content as regulated in Article 27 paragraph (2), which conceptually are directed at parties who act as providers, operators, or facilitators of online gambling. This research affirms that the differences in regulatory character between the KUHP and the UU ITE require a systematic legal interpretation of the function and purpose of each norm.

Abstract

The advancement of digitalization in healthcare services requires hospitals to implement Electronic Medical Records (EMRs) supported by secure, accurate, and integrated data management. This study aims to analyze the compliance of data breach prevention measures for patient EMRs at RSUD Serpong Utara with national legal provisions and to assess the potential legal risks arising from data breaches. The research employs a normative–empirical juridical approach, with data collected through in-depth interviews with the Medical Records Coordinator, EMR implementing officers, Head of the IT Team, Public Relations officers, and the Chair of the Quality Committee, as well as analysis of internal documents and relevant laws and regulations. The findings indicate that RSUD Serpong Utara has implemented access control mechanisms, individual user accounts, hierarchical supervision, and data storage on external servers to prevent data breaches. However, EMR implementation remains hybrid in several units, the CPPT audit trail has not been effectively implemented, and there is no appointed Data Protection Officer or internal legal unit. The enactment of Law No. 27 of 2022 on Personal Data Protection (UU PDP) establishes a more stringent regulatory standard compared to previous regulations, demanding comprehensive compliance from healthcare institutions in protecting patient data. The potential legal risks include administrative sanctions, civil liability claims, and criminal liability. Based on normative juridical analysis of the applicable laws and regulations and empirical findings regarding EMR management practices at RSUD Serpong Utara, this study concludes that strengthening EMR governance through the completion of digital transition, the appointment of a Data Protection Officer, the establishment of an internal legal unit, and the effective implementation of incident audits and audit trails is necessary to enhance legal compliance and reduce the risk of patient data breaches.

Abstract

Tujuan penelitian ini adalah untuk mengetahui: bagaimana Modus Operandi para pelaku Penipuan online di wilayah Polres Jakata Barat, Dan bagaimana Penanggulangan tindak Pidana Penipuan Online di Wilayah Hukum Polres Metro Jakarta Barat. Penelitian ini menggunakan Metode Empiris. Hasil penelitian ini menunjukkan bahwa upaya atau upaya penanggulangan hukum dalam menangani kejahatan siber dapat berupa upaya preventif, upaya preventif, dan upaya represif. Berbagai modus operandi yang semakin beragam seperti Phising meretas aplikasi mobile banking, Money Mule jenis penipuan yang meminta korban untuk menerima sejumlah uang ke rekening, Pharming penipuan daring yang melibatkan kode, social engineering atau rekayasa sosial, sniffing tindakan penyadapan, upaya penanggulangan kejahatan penipuan yaitu upaya penanggulangan kejahatan melalui jalur nonpenal Upaya penanggulangan kejahatan perlu ditempuh dengan pendekatan kebijakan secara terpadu (integral), dimana terdapat keterpaduan antara kebijakan kriminal dengan kebijakan sosial juga penanggulangan dengan sarana penal dan non-penal. Penelitian ini mengupas mengenai Modus dan cara penanggulangan Kejahatan Penipuan Online.

Abstract

This study aims to examine the regulation of criminal acts involving the misuse of personal data under Law Number 27 of 2022 concerning Personal Data Protection, as well as the legal liability of perpetrators who misuse other individuals’ personal data as reflected in the Decision of the Tangerang District Court Number 76/Pid.Sus/2024/PN Tangerang dated April 2, 2024. This research is classified as normative legal research, employing a statutory approach, a conceptual approach, and a case approach. The results of this study indicate that the Personal Data Protection Law (PDP Law) provides a firm legal framework through Articles 67–70, which prohibit the unlawful acquisition, use, disclosure, and falsification of personal data, while also affirming that the protection of personal data constitutes a fundamental right that must be guaranteed by the state. The perpetrator’s actions in this case fulfilled all the elements of the charged provisions and therefore resulted in the imposition of criminal sanctions pursuant to Article 67 paragraph (3) of the PDP Law. Furthermore, the perpetrator’s conduct also satisfies the elements of an unlawful act as stipulated in Article 1365 of the Indonesian Civil Code, as such conduct violated the right to privacy, was committed intentionally, caused immaterial damage, and had a causal relationship with the harm suffered by the victim. Consequently, the perpetrator may also be held civilly liable under Article 1365 of the Indonesian Civil Code.

Abstract

Law Number 27 of 2022 on Personal Data Protection regulates criminal sanctions in the form of fines and additional sanctions of compensation payment, enforced through the seizure of the convicted person’s assets or income. This policy aims to ensure the fulfillment of criminal sanctions and to provide legal protection for victims of personal data violations. However, this study finds that the current formulation policy contains fundamental weaknesses, as asset seizure may only be conducted after a court decision has obtained final and binding legal force, thereby allowing the convicted person to transfer assets during the lengthy criminal process. This research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that such weaknesses may hinder the execution of fines and compensation payments and undermine the objectives of punishment. Therefore, this study recommends reformulating the policy by allowing asset seizure at the investigation stage as a legal guarantee to ensure effective enforcement of fines and compensation payments, as well as stronger protection for victims of personal data misuse.

Abstract

Putusan Mahkamah Konstitusi Nomor 25/PUU-XIV/2016 mengubah paradigma pembuktian tindak pidana korupsi dengan menghapus frasa "dapat" dalam Pasal 2 ayat (1) dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi, sehingga unsur kerugian keuangan negara wajib dibuktikan sebagai kerugian nyata (actual loss), bukan sekadar potensi kerugian (potential loss). Pergeseran ini menimbulkan dua persoalan hukum yang saling berkaitan: pertama, dualisme kewenangan lembaga audit dalam menghitung dan mendeklarasikan kerugian keuangan negara; kedua, implikasi yuridis kekuatan laporan audit kerugian negara dalam tindak pidana korupsi. Penelitian ini bertujuan menganalisis problematika kewenangan otoritas audit serta implikasi yuridis kekuatan alat bukti actual loss pasca pergeseran delik formil menjadi delik materil. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa berdasarkan Putusan Mahkamah Konstitusi Nomor 28/PUU-XXIV/2026, BPK merupakan satu-satunya lembaga yang berwenang secara absolut menetapkan kerugian keuangan negara, sedangkan laporan BPKP hanya bersifat investigatif dan tidak dapat berdiri sendiri sebagai alat bukti. Kekuatan alat bukti actual loss ditentukan oleh ketepatan metodologi perhitungan real cost, net loss, atau total loss.

Abstract

The designation of a suspect is a legal action that has significant implications for an individual's fundamental rights and therefore must be carried out in accordance with criminal procedural law and supported by sufficient preliminary evidence. However, in practice, suspects are sometimes designated without fulfilling the minimum evidentiary standard, as reflected in Pretrial Decision Number 2/Pid.Pra/2024/PN Jkt.Sel. This study aims to analyze the legal reasoning behind the court's declaration that the suspect designation was unlawful and to examine the proper procedure for designating a suspect under Indonesian positive law from the perspectives of rechtsstaat and machtsstaat. This research employs a normative legal research method using statutory, case, and conceptual approaches, analyzed descriptively through primary, secondary, and tertiary legal materials. The findings indicate that the suspect designation was declared legally defective because it was not supported by at least two valid pieces of evidence at the time the designation was made, thereby violating the Indonesian Criminal Procedure Code, Constitutional Court Decision Number 21/PUU-XII/2014, the principles of legality, legal certainty, and due process of law. Furthermore, to ensure the validity of a suspect designation, investigators must strictly comply with all procedural requirements, including preliminary inquiry, issuance of an investigation warrant, collection of at least two lawful pieces of evidence, case exposition, submission of the Notice of Commencement of Investigation, and protection of the suspect's legal rights. Therefore, the legitimacy of suspect designation must be grounded in strict adherence to legal procedures as an embodiment of the rechtsstaat principle and to prevent machtsstaat practices in criminal law enforcement.

Abstract

An important part of any criminal inquiry is the official designation of a suspect, which must adhere to the KUHAP, the concept of due process, and be backed by legally acceptable evidence in accordance with Indonesian law. As a result of Constitutional Court Decision No 21/PUU-XII/2014, judges may now check the legitimacy of investigation activities by reviewing the suspect designation before trial. The purpose of this research is to look at the right way to designate suspects under Indonesian positive law and to investigate the judges' legal reasoning in Pretrial Decision No 13/Pid.Pra/2021/PN Kdi, which found that the police investigators' suspect identification was flawed. Statutory, case law, and conceptual techniques are used in this study as part of a normative legal research process. A qualitative analysis was conducted using library research on the legal resources, which include primary, secondary, and tertiary sources. Because the suspect designation did not completely satisfy the formal and substantive conditions outlined in KUHAP also Constitutional Court Decision No 21/PUU-XII/2014, the court found it legally invalid, according to the findings. In addition, the study confirms that to properly designate a suspect, one must first conduct an investigation, formal inquiry, gather at least two pieces of valid evidence, question witnesses, present the case (gelar perkara), and then issue a letter designating the suspect in compliance with relevant legal provisions. By following these protocols, Indonesia's criminal justice system demonstrates its commitment to human rights protection, legal clarity, and the rule of law. So, for law enforcement to be fair and to avoid abuse of power, it is crucial that suspects be designated in accordance with legal processes.

Abstract

This study aims to analyze the inequality in law enforcement in the process of determining suspects by the police through the examination of Pretrial Decision Number 10/Pid.Pra/2024/PN Bdg. The background of this study is rooted in the importance of the rule of law and the principle of fair legal process in the Indonesian criminal justice system, particularly in the determination of suspects, which must be carried out based on valid and fair legal procedures. The research problem focuses on the judge's legal considerations in declaring the determination of a suspect null and void, as well as how the procedure for determining suspects by police investigators must be carried out in accordance with the principle of fair legal process. This study uses normative legal research with a statutory, case, and conceptual legal approach. The existing findings describe that in Pretrial Decision Number 10/Pid.Pra/2024/PN Bdg, the judge declared the determination of a suspect invalid because the investigator failed to examine the potential suspect before determining the suspect status and failed to present at least two valid pieces of evidence as outlined in Article 184 of the Indonesian Criminal Code. In conclusion, the determination of suspects must be carried out professionally, objectively, transparently, and accountably by upholding the principles of fair legal process, the presumption of innocence, and the protection of human rights to ensure legal certainty and justice in the criminal justice system.

Abstract

The rapid development of mobile telecommunications services has made internet access a primary necessity. However, the practice of forfeiting unused internet data quotas raises legal issues concerning consumers’ legal position, legal protection, and the liability of telecommunications service providers. This study employs contract law theory, legal protection theory, and legal interpretation and construction theory, using a normative juridical method with statutory and conceptual approaches. The findings indicate that although consumers are formally bound by valid contractual agreements, their substantive position remains unequal due to the dominant role of service providers in determining service terms and conditions. The forfeiture of unused data quotas prevents consumers from fully benefiting from services they have already paid for, thereby conflicting with the principles of balance and good faith in contract law. Furthermore, legal protection remains ineffective because no adequate compensation mechanism is provided, despite the existence of actual consumer losses that satisfy the elements of legal liability. Therefore, stricter regulations and improved service policies are necessary to ensure fairness, accountability, and effective consumer protection.
