Abstract

Environmental crimes committed by corporations are one of the main causes of massive, systemic, and sustainable environmental damage. Although various environmental legal instruments are available, the practice of enforcing environmental criminal law shows a weak and ineffective tendency in proportionally prosecuting corporate perpetrators. This article aims to analyze the crisis in environmental criminal law enforcement in dealing with corporate environmental crimes, as well as to identify the structural and normative factors that cause legal impunity. This study uses a normative-critical legal approach supported by a green criminology perspective to examine legislation, court decisions, and environmental law enforcement policies. The results of the study show that the dominance of an administrative approach, the limitations of the application of corporate criminal liability, and the low ecological orientation of criminal policy are the main factors contributing to the weak deterrent effect of environmental criminal law. This article argues that without reconstructing environmental criminal law policies that treat corporate environmental crimes as serious crimes against the public interest and ecosystem sustainability, environmental damage will continue to recur. The findings of this study are expected to contribute theoretically and practically to strengthening the enforcement of environmental criminal law in the context of sustainable environmental protection.

Abstract

This study examines the integration of ecosystem protection with the right to a healthy environment as an essential component of human rights protection in addressing flood disasters in Indonesia. The study is motivated by the increasing frequency of floods caused not only by climate change but also by deforestation, land degradation, and weak spatial planning policies, which threaten fundamental human rights. This research employs a normative legal method using statutory, conceptual, and human rights approaches by analyzing the 1945 Constitution of the Republic of Indonesia, environmental and disaster management legislation, and relevant international human rights instruments. The findings reveal that ecosystem degradation has significantly increased disaster risks and undermined the rights to life, security, health, housing, and a healthy environment. Consequently, the State bears constitutional obligations to protect, respect, and fulfil these rights through ecosystem-based disaster mitigation, effective environmental law enforcement, protection of vulnerable groups, and comprehensive post-disaster recovery. The study concludes that integrating ecosystem conservation with the protection of environmental rights is essential to strengthening sustainable development, disaster resilience, and the realization of constitutional human rights in Indonesia.

Abstract

Tujuan penelitian ini adalah untuk memeriksa konstruksi kriminalisasi perilaku privat yang ditemukan dalam Kitab Undang-Undang Hukum Pidana baru dan menilai seberapa sesuai dengan prinsip hukum pidana modern dan hak asasi manusia. Penelitian hukum normatif dilakukan dengan menggunakan pendekatan perundang-undangan, konseptual, dan perbandingan. Metode analisis dilakukan secara kualitatif dengan melihat standar hukum, gagasan, dan teori tentang kriminalisasi. Hasil penelitian menunjukkan bahwa peraturan perzinahan dan kohabitasi dalam Pasal 411 dan 412 KUHP menunjukkan bahwa kriminalisasi telah berkembang ke area privat yang sebelumnya tidak termasuk dalam jangkauan hukum pidana. Meskipun mekanisme delik aduan membatasi hal ini, ketentuan ini masih menimbulkan risiko overcriminalization dan membuka peluang bagi negara untuk memasuki kehidupan pribadi seseorang. Dari sudut pandang hak asasi manusia, mungkin ada pelanggaran terhadap prinsip perlindungan privasi, proporsionalitas, dan pembatasan kekuasaan negara. Oleh karena itu, legitimasi kriminalisasi yang didasarkan pada moralitas publik harus diperiksa secara menyeluruh agar tidak melampaui batas perlindungan hukum terhadap kebebasan individu.
