Abstract

Gender equality remains a significant discourse in contemporary Islamic studies, particularly in relation to how Islamic law (sharī’ah) is interpreted and applied within modern socio-cultural contexts. Traditional interpretations of Islamic texts have often been critiqued for reinforcing patriarchal readings, while contemporary scholarship increasingly emphasizes contextual and egalitarian approaches through gender-sensitive methodologies. This paper aims to examine gender equality from the perspective of Islamic law and to analyze the gender approach in Islamic studies as a methodological framework for reinterpreting classical Islamic texts. This research employs a qualitative method with a library research approach. Data were collected from primary sources such as classical fiqh literature and Qur’anic interpretations, as well as secondary sources including contemporary academic journals, books, and scholarly articles related to gender studies and Islamic jurisprudence. The data were analyzed using descriptive-analytical techniques to identify patterns of interpretation and conceptual developments regarding gender justice in Islam. The findings indicate that Islamic teachings fundamentally uphold principles of justice, equality, and human dignity, which can serve as a foundation for gender equity. However, interpretative diversity in classical jurisprudence has led to varying applications of gender roles. The gender approach in Islamic studies provides a critical and contextual framework that allows reinterpretation of texts in light of contemporary realities without departing from core Islamic principles. This approach contributes to a more inclusive understanding of Islamic law that supports gender justice within Muslim societies

Abstract

This study examines the concept of kafā’ah (compatibility) in marital partner selection within the Indonesian context, focusing on the interaction between Islamic legal norms and evolving social realities. Although classical Islamic jurisprudence emphasizes religious and moral compatibility as primary criteria, contemporary marriage practices in Indonesia increasingly incorporate social variables such as education, economic status, and family background. Using a qualitative descriptive approach through literature review and document analysis, this research analyzes classical fiqh texts, the Compilation of Islamic Law (KHI), and empirical studies on marriage practices across different cultural settings in Indonesia. The findings reveal that kafā’ah remains relevant as a principle for ensuring marital harmony; however, its interpretation has shifted from lineage and socio-economic status toward shared values, emotional maturity, and religious commitment. The study also indicates a gap between normative legal frameworks and practical social considerations, influenced by cultural dynamics and modernization. This research contributes to contemporary Islamic family law discourse by highlighting the need for a contextual reinterpretation of kafā’ah that prioritizes ethical and spiritual dimensions over hierarchical social classifications.

Abstract

In the digital era, social media has become a key medium for disseminating Islamic legal knowledge. This study analyzes the Instagram account of Muhammad Abu Rivai, which promotes Islamic inheritance law through accessible content. Using a qualitative-descriptive method and content analysis of 30 posts from January 2023 to January 2024, the research examines engagement metrics and content relevance to core inheritance issues. Applying the maqāṣid al-sharīʿa framework, the study finds that the account effectively simplifies complex legal concepts, enhancing public understanding of inheritance law and supporting the preservation of lineage (ḥifẓ al-nasl), property (ḥifẓ al-māl), and religion (ḥifẓ al-dīn). However, limited depth and interactivity in some posts pose risks of misinterpretation. The study recommends greater scholarly collaboration and interactive features to improve the accuracy and educational value of Islamic legal content on social media.

Abstract

This article comparatively analyzes abortion practices and regulations for rape victims from the perspectives of Islamic jurisprudence (fiqh jinayah) and Indonesian positive law. The study aims to examine the normative foundations, limitations, and legal consequences related to the protection of rape victims in both legal systems. This research employs normative legal methods, drawing on classical and contemporary Islamic legal sources as well as national legislation governing abortion. The findings indicate that Islamic jurisprudence (fiqh jinayah) fundamentally prohibits abortion; however, in certain emergency circumstances—such as pregnancies resulting from rape—it allows abortion based on the principle of hifz al-nafs (protection of life). Meanwhile, Indonesian positive law permits abortion for rape victims in a limited manner, subject to strict legal requirements, particularly concerning gestational age and medical procedures. This study underscores the importance of a legal approach that prioritizes substantive justice and the protection of victims’ rights. Furthermore, a humane response to abortion resulting from rape requires the reconciliation of the values of Islamic law and national law. Abstract

Tujuan penelitian ini adalah untuk memeriksa konstruksi kriminalisasi perilaku privat yang ditemukan dalam Kitab Undang-Undang Hukum Pidana baru dan menilai seberapa sesuai dengan prinsip hukum pidana modern dan hak asasi manusia. Penelitian hukum normatif dilakukan dengan menggunakan pendekatan perundang-undangan, konseptual, dan perbandingan. Metode analisis dilakukan secara kualitatif dengan melihat standar hukum, gagasan, dan teori tentang kriminalisasi. Hasil penelitian menunjukkan bahwa peraturan perzinahan dan kohabitasi dalam Pasal 411 dan 412 KUHP menunjukkan bahwa kriminalisasi telah berkembang ke area privat yang sebelumnya tidak termasuk dalam jangkauan hukum pidana. Meskipun mekanisme delik aduan membatasi hal ini, ketentuan ini masih menimbulkan risiko overcriminalization dan membuka peluang bagi negara untuk memasuki kehidupan pribadi seseorang. Dari sudut pandang hak asasi manusia, mungkin ada pelanggaran terhadap prinsip perlindungan privasi, proporsionalitas, dan pembatasan kekuasaan negara. Oleh karena itu, legitimasi kriminalisasi yang didasarkan pada moralitas publik harus diperiksa secara menyeluruh agar tidak melampaui batas perlindungan hukum terhadap kebebasan individu.
