Abstract

Gender equality remains a significant discourse in contemporary Islamic studies, particularly in relation to how Islamic law (sharī’ah) is interpreted and applied within modern socio-cultural contexts. Traditional interpretations of Islamic texts have often been critiqued for reinforcing patriarchal readings, while contemporary scholarship increasingly emphasizes contextual and egalitarian approaches through gender-sensitive methodologies. This paper aims to examine gender equality from the perspective of Islamic law and to analyze the gender approach in Islamic studies as a methodological framework for reinterpreting classical Islamic texts. This research employs a qualitative method with a library research approach. Data were collected from primary sources such as classical fiqh literature and Qur’anic interpretations, as well as secondary sources including contemporary academic journals, books, and scholarly articles related to gender studies and Islamic jurisprudence. The data were analyzed using descriptive-analytical techniques to identify patterns of interpretation and conceptual developments regarding gender justice in Islam. The findings indicate that Islamic teachings fundamentally uphold principles of justice, equality, and human dignity, which can serve as a foundation for gender equity. However, interpretative diversity in classical jurisprudence has led to varying applications of gender roles. The gender approach in Islamic studies provides a critical and contextual framework that allows reinterpretation of texts in light of contemporary realities without departing from core Islamic principles. This approach contributes to a more inclusive understanding of Islamic law that supports gender justice within Muslim societies

Abstract

In the digital era, social media has become a key medium for disseminating Islamic legal knowledge. This study analyzes the Instagram account of Muhammad Abu Rivai, which promotes Islamic inheritance law through accessible content. Using a qualitative-descriptive method and content analysis of 30 posts from January 2023 to January 2024, the research examines engagement metrics and content relevance to core inheritance issues. Applying the maqāṣid al-sharīʿa framework, the study finds that the account effectively simplifies complex legal concepts, enhancing public understanding of inheritance law and supporting the preservation of lineage (ḥifẓ al-nasl), property (ḥifẓ al-māl), and religion (ḥifẓ al-dīn). However, limited depth and interactivity in some posts pose risks of misinterpretation. The study recommends greater scholarly collaboration and interactive features to improve the accuracy and educational value of Islamic legal content on social media.

Abstract

Environmental crimes committed by corporations are one of the main causes of massive, systemic, and sustainable environmental damage. Although various environmental legal instruments are available, the practice of enforcing environmental criminal law shows a weak and ineffective tendency in proportionally prosecuting corporate perpetrators. This article aims to analyze the crisis in environmental criminal law enforcement in dealing with corporate environmental crimes, as well as to identify the structural and normative factors that cause legal impunity. This study uses a normative-critical legal approach supported by a green criminology perspective to examine legislation, court decisions, and environmental law enforcement policies. The results of the study show that the dominance of an administrative approach, the limitations of the application of corporate criminal liability, and the low ecological orientation of criminal policy are the main factors contributing to the weak deterrent effect of environmental criminal law. This article argues that without reconstructing environmental criminal law policies that treat corporate environmental crimes as serious crimes against the public interest and ecosystem sustainability, environmental damage will continue to recur. The findings of this study are expected to contribute theoretically and practically to strengthening the enforcement of environmental criminal law in the context of sustainable environmental protection.

Abstract

Perkembangan perdagangan elektronik di Indonesia telah mendorong transformasi pola transaksi konsumen menjadi lebih cepat, mudah, dan berbasis teknologi digital. Namun, di balik kemudahan tersebut muncul praktik manipulatif dalam desain antarmuka digital yang dikenal sebagai dark pattern, yaitu strategi desain yang secara sengaja memengaruhi keputusan konsumen melalui teknik manipulasi psikologis, pengaburan informasi, tekanan visual, maupun persetujuan yang tidak sepenuhnya disadari oleh pengguna. Praktik ini berpotensi mereduksi kebebasan konsumen dalam menentukan pilihan serta menimbulkan kerugian ekonomi maupun pelanggaran terhadap hak atas informasi yang benar dan transparan. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk praktik dark pattern dalam transaksi e-commerce di Indonesia serta mengkaji efektivitas perlindungan hukum terhadap konsumen berdasarkan kerangka hukum nasional. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan komparatif (comparative approach). Data diperoleh melalui studi kepustakaan yang dianalisis secara kualitatif terhadap regulasi, doktrin hukum, dan perkembangan praktik digital. Hasil penelitian menunjukkan bahwa praktik dark pattern memiliki keterkaitan erat dengan pelanggaran terhadap prinsip transparansi, itikad baik, hak atas informasi, dan keseimbangan hubungan hukum antara pelaku usaha dan konsumen sebagaimana diatur dalam rezim perlindungan konsumen dan transaksi elektronik di Indonesia. Meskipun ketentuan hukum yang berlaku telah memberikan dasar perlindungan secara umum, belum terdapat pengaturan khusus yang secara eksplisit mengatur klasifikasi, indikator, serta mekanisme penegakan hukum terhadap praktik dark pattern. Oleh karena itu, diperlukan penguatan regulasi melalui pembentukan standar desain digital yang berorientasi pada perlindungan konsumen, peningkatan tanggung jawab platform e-commerce, serta integrasi pengawasan terhadap praktik manipulatif berbasis teknologi.

Abstract

In the current discourse on Islamic family law, cultural aspects cannot be separated from the scope of family law, especially marriage. As in the view of the Pasir Sialang Village community, when conducting a marriage, considerations must be taken into account, such as the community's perception of the prohibition of two siblings marrying at the same time. The purpose of this article is to determine the views of the Pasir Sialang Village community regarding the prohibition of marriage between two siblings at the same time and the impact of this prohibition from a cultural anthropology perspective. This research is empirical legal research using a cultural anthropology approach. The results of this study confirm the existence of a prohibition on the marriage of two siblings at the same time and the community's belief in the impact of such marriages. This is due to the influence of traditional culture and the reality of beliefs that exist in the community as a result of violating established rules, as evidenced by past occurrences in the Pasir Sialang community. Such as divorce, death, and miscarriages during pregnancy. From a cultural anthropology perspective, the phenomenon of marriage prohibition cannot be permanently prohibited, due to social considerations that influence understanding in society.

Abstract

Religious diversity in Indonesia represents a social reality that can both enrich communal life and generate social tension and conflict. In response to these challenges, the Indonesian government has promoted religious moderation as a strategic framework to foster social harmony, particularly in interfaith relations. This study aims to describe the practice of religious moderation within the Sorogenen community in Yogyakarta and to analyze its relevance to the principles of maqāṣid al-sharī‘ah as a conceptual framework of Islamic law. This research employs an empirical legal method with a conceptual approach. Fieldwork was conducted over a two-week period and involved four key informants, consisting of one religious leader, one neighborhood head, and two community members. Data were collected through in-depth interviews and analyzed using empirical legal analysis alongside an analytical framework of religious dialogue to interpret patterns of interreligious interaction. The findings indicate that the practice of religious moderation in the Sorogenen community is consistent with the fundamental principles of maqāṣid al-sharī‘ah, particularly the protection of religion (ḥifẓ al-dīn). This alignment is reflected in social behaviors that emphasize mutual respect among residents of different religious backgrounds, including interfaith cooperation to ensure security and the smooth conduct of worship activities during religious holidays. Religious dialogue within the community is characterized by an ethical and persuasive approach (mau‘iẓah ḥasanah), positioning religious outreach as a means of fostering peaceful coexistence rather than religious dominance. The originality of this study lies in its integration of maqāṣid al-sharī‘ah with empirically observed practices of religious moderation through interfaith dialogue at the community level. Conceptually, this research contributes to the development of maqāṣid al-sharī‘ah as a normative framework for strengthening religious moderation and social harmony in pluralistic societies.

Abstract

This article comparatively analyzes abortion practices and regulations for rape victims from the perspectives of Islamic jurisprudence (fiqh jinayah) and Indonesian positive law. The study aims to examine the normative foundations, limitations, and legal consequences related to the protection of rape victims in both legal systems. This research employs normative legal methods, drawing on classical and contemporary Islamic legal sources as well as national legislation governing abortion. The findings indicate that Islamic jurisprudence (fiqh jinayah) fundamentally prohibits abortion; however, in certain emergency circumstances—such as pregnancies resulting from rape—it allows abortion based on the principle of hifz al-nafs (protection of life). Meanwhile, Indonesian positive law permits abortion for rape victims in a limited manner, subject to strict legal requirements, particularly concerning gestational age and medical procedures. This study underscores the importance of a legal approach that prioritizes substantive justice and the protection of victims’ rights. Furthermore, a humane response to abortion resulting from rape requires the reconciliation of the values of Islamic law and national law. Abstract

Tujuan penelitian ini adalah untuk memeriksa konstruksi kriminalisasi perilaku privat yang ditemukan dalam Kitab Undang-Undang Hukum Pidana baru dan menilai seberapa sesuai dengan prinsip hukum pidana modern dan hak asasi manusia. Penelitian hukum normatif dilakukan dengan menggunakan pendekatan perundang-undangan, konseptual, dan perbandingan. Metode analisis dilakukan secara kualitatif dengan melihat standar hukum, gagasan, dan teori tentang kriminalisasi. Hasil penelitian menunjukkan bahwa peraturan perzinahan dan kohabitasi dalam Pasal 411 dan 412 KUHP menunjukkan bahwa kriminalisasi telah berkembang ke area privat yang sebelumnya tidak termasuk dalam jangkauan hukum pidana. Meskipun mekanisme delik aduan membatasi hal ini, ketentuan ini masih menimbulkan risiko overcriminalization dan membuka peluang bagi negara untuk memasuki kehidupan pribadi seseorang. Dari sudut pandang hak asasi manusia, mungkin ada pelanggaran terhadap prinsip perlindungan privasi, proporsionalitas, dan pembatasan kekuasaan negara. Oleh karena itu, legitimasi kriminalisasi yang didasarkan pada moralitas publik harus diperiksa secara menyeluruh agar tidak melampaui batas perlindungan hukum terhadap kebebasan individu.

Abstract

The phenomenon of incest is a serious issue because it violates mahram boundaries and threatens the safety, honor, and resilience of the family. Changes in family interaction patterns in the digital age also present challenges in the form of exposure to sexual content, unsupervised use of digital devices, and a lack of communication between parents and children. This study aims to analyze incest as a threat to family resilience and to examine the relevance of the hadiths of the Prophet Muhammad, peace be upon him, in establishing moral protection for Muslim families. This study employs a qualitative approach using library research and a thematic (maudhu’i) approach in the analysis of hadiths. Primary sources consist of hadiths from Ṣaḥīḥ al-Bukhārī, Ṣaḥīḥ Muslim, Sunan Abī Dāwūd, and other relevant hadith collections, while secondary sources include books, journal articles, and research on incest, family resilience, child protection, digital literacy, and sex education. The data were analyzed through inventory, classification, interpretation, and thematic analysis. The research findings indicate that incest threatens family resilience by undermining the functions of protection, trust, honor, and relationships among family members. The Prophet’s hadiths contain preventive values such as upholding mahram boundaries, honor, and privacy; Islamic-values-based sex education; parental responsibility; child protection; and the internalization of ḥayā’. These values can be reconstructed as a foundation for strengthening family resilience through education, supervision, protection, and the establishment of family moral control
