Abstract

Restorative justice is an approach to dispute resolution that emphasizes the restoration of relationships between conflicting parties rather than prioritizing punitive outcomes or adversarial judgments. In the context of civil law, this approach offers a more humane, participatory, and solution-oriented alternative, focusing on achieving mutually beneficial and sustainable agreements. This article aims to examine and analyze the application of restorative justice in civil disputes as part of the development of a progressive legal paradigm in Indonesia. The research employs a normative legal method using both conceptual and statutory approaches, supported by a comprehensive review of relevant academic literature. The analysis is conducted qualitatively to explore the relevance of restorative justice principles in civil law practices and their contribution to achieving substantive justice. The findings indicate that the implementation of restorative justice in civil disputes holds significant potential to enhance the effectiveness of dispute resolution mechanisms. It not only provides legally acceptable outcomes but also helps preserve social relationships between the parties involved. Furthermore, this approach aligns with the principles of progressive law, which prioritize justice, fairness, and social benefit over rigid procedural formalities. However, its implementation still faces several challenges, including the lack of explicit regulatory frameworks, limited understanding among legal practitioners, and low public awareness regarding non-litigation dispute resolution mechanisms. Therefore, strengthening both regulatory support and practical implementation is necessary to optimize the role of restorative justice within Indonesia’s civil law system.

Abstract

This study, entitled The Influence of Age and Technology on Students’ Language Acquisition Absorption, examines how age factors and the use of technology contribute to improving students’ absorptive capacity in language learning. The primary focus of this research is to analyze the extent to which learning technology and age differences influence students’ ability to understand, retain, and effectively use linguistic information. The objective of the study is to determine the impact of these two variables on students’ absorptive capacity, particularly in the context of language learning, which involves cognitive, affective, and interactive processes simultaneously. This research employed a qualitative approach using descriptive qualitative data analysis techniques. This method was chosen to describe the real conditions occurring in the field based on observed learning phenomena. Data were collected through observations of the learning process, students’ interactions with technological media, and their responses in understanding language materials. The analysis was conducted by interpreting patterns of learning behavior, levels of student engagement, and the ease of access to information provided by learning technologies. The findings reveal that the use of technology in the learning process has a more significant influence on students’ absorptive capacity compared to learning without technological support. Technology enables students to access materials before class, review content anytime, and understand concepts through more engaging visual and interactive media. In addition, age is also an important factor; younger learners tend to have higher absorptive capacity due to greater cognitive plasticity. Therefore, the integration of technology and an understanding of age-related learning characteristics are strategic factors in enhancing the effectiveness of language learning

Abstract

Digitalisasi dan platform online telah mengubah landscape ekonomi global, membuka peluang baru namun juga menimbulkan tantangan bagi hukum anti monopoli. Perusahaan teknologi besar yang menguasai platform digital dapat menciptakan dominasi pasar melalui kontrol data dan algoritma, yang dapat mengurangi persaingan dan merugikan konsumen. Penelitian ini mengkaji dampak digitalisasi terhadap penerapan hukum anti monopoli, dengan fokus pada bagaimana regulasi saat ini menghadapi tantangan baru yang dibawa oleh ekonomi digital. Penelitian ini menemukan bahwa hukum anti monopoli tradisional belum sepenuhnya mampu menangani kompleksitas model bisnis berbasis data dan teknologi. Dibutuhkan pembaruan regulasi yang lebih responsif, serta pengawasan yang lebih adaptif dan berbasis bukti ilmiah untuk menghadapi dominasi pasar oleh platform digital. Kolaborasi internasional dan peningkatan pemahaman tentang ekosistem digital juga sangat penting untuk memastikan terciptanya pasar yang kompetitif dan sehat di era ekonomi digital.
