law (rechtsstaat) recognizes and protects human rights. All people must be treated equally in the law. Equality in law must be balanced with equal treatment. Legal assistance is the right of a person who is involved in a criminal case to be able to prepare a defense or counseling in upholding his rights as a suspect. Everyone has the right to receive legal assistance from an advocate, no one may be denied the right to obtain a legal defense in a legal state. Abstract

Gampong Aceh Qanun No. 1 of 2019 concerns the Gampong government regulating gampong governance administration. The Keuchik as the gampong government, must submit a government responsibility report to Tuha Peut Gampong and the Mayor through the camat. The report consists of three parts: the year-end report on the administration of gampong governance, the final report on the administration of gampong governance at the end of the period, and the information report on the administration of gampong governance at the end of the fiscal year. Keuchik reporting activities are funded by the Gampong Revenue and Expenditure Budget (APBG), and the procedures for submitting Keuchik accountability reports are regulated in a Mayor Regulation. With this rule, it is hoped that the Gampong Aceh administration will become more accountable and transparent.

Abstract

Responding to the phenomenon of defamation during the execution of caning sentences, the Aceh Government limited the place where caning sentences were carried out from initially being carried out in public places and then being transferred to detention centres or correctional institutions. This rule is stated in Governor's Regulation Number 5 of 2018. The aim of moving the place of execution to a detention centre is to protect the rights of the convict so that it does not spread on social media. With the issuance of Gubernatorial Regulation no. 5 of 2018, of course there are legal implications regarding whether or not to record the caning procession. If caning is considered a disgrace, then those who spread caning can be charged under the ITE Law on defamation, but this phenomenon continues to occur and there are no calls from law enforcers to prohibit it. Thus, researchers feel it is necessary to examine the legal certainty regarding the dissemination of recordings of caning processions on digital media, and what the view of Islamic law is regarding the dissemination of recordings of caning processions on digital media. This research is entirely qualitative research (qualitative approach) using a normative juridical approach or library research. From the results of the research, it was concluded that there is no clear prohibition on the distribution of caning punishments either in the governor's regulation or in the qanun, so the law is permissible. The perpetrator also cannot be charged under the ITE Law because the execution is open to the public. However, victims may report to the authorities if they feel that the news conveyed does not match the facts or attacks their honour. This is also not prohibited in Islam, because it is classified as permissible backbiting, with the aim of making the perpetrators feel embarrassed and have a deterrent effect and warning for others.

Abstract

The public implementation of flogging in Aceh is a manifestation of Islamic law that has been practiced since the time of Prophet Muhammad SAW, where the process aimed to deter society at large. However, in the digital era, the dissemination of recordings of such punishments through social media has sparked legal controversy concerning privacy violations and defamation, with broad impacts on the convicted individuals. This study aims to analyze the legal certainty regarding the distribution of flogging punishment content in digital spaces and to examine the intersection between Islamic law and Indonesia’s national law. This article is a qualitative library research, using a normative legal study methodology with a descriptive-analytical approach. The results show that the dissemination of flogging punishment recordings in Aceh via social media creates complex legal issues because, although public flogging is legally justified under Islamic law and the Qanun Jinayat, its digital distribution has the potential to violate privacy and defame individuals according to the provisions of the Electronic Information and Transactions Law (ITE Law) and the Indonesian Criminal Code (KUHP). Therefore, specific regulations are urgently needed to integrate Islamic law principles with national law to ensure the protection of human rights and to prevent the misuse of content in the global and permanent nature of digital public spaces.

Abstract

Corruption is a key structural barrier to economic growth and investment flows in developing countries. This study analyzes a range of academic literature, international reports, and empirical cases from countries such as Mali, Ethiopia, and Indonesia to examine how corruption affects investment efficiency, public budget management, infrastructure quality, and socio- economic inequality. The synthesis reveals that corruption increases transaction costs for investors, creates legal uncertainty, and distorts policy-making and budget allocation. Moreover, it worsens wealth distribution and undermines public services such as education and healthcare, thereby limiting investment in human capital. The study further emphasizes that the impact of corruption is not uniform, but highly dependent on the strength of institutional governance. Therefore, institutional reform, enhanced transparency, and stronger public oversight are essential prerequisites for fostering inclusive and sustainable economic development.

Abstract

Online gambling in Aceh represents a borderless and technology-driven transformation of maisir that challenges the practical application of Qanun Aceh No. 6 of 2014 on Jinayat Law. Rather than indicating a complete legal vacuum, the problem lies in interpretive and enforcement challenges arising from digital gambling modalities, electronic evidence, and inter-agency coordination. This paper aims to analyze the effectiveness of Qanun Jinayat implementation in addressing online gambling crimes, assess enforcement practices among relevant institutions, and formulate policy recommendations that align syariah-based legality with contemporary digital realities. Employing a qualitative juridical-sociological approach, this study combines semi-structured interviews with law-enforcement and syariah institutions and document analysis of regulations, case data, and court decisions. The data were examined through thematic analysis and triangulated to ensure validity. The findings indicate that the doctrinal elements of maisir under Qanun Jinayat are sufficiently broad to cover gambling activities, including online forms. However, interpretive difficulties arise when betting activities involve tokens, e-wallet balances, virtual accounts, or in game mechanisms. Electronic evidence, such as screenshots, bank transfer records, digital logs, and online communication traces, is increasingly used in practice, provided that authenticity, relevance, and chain of custody standards are fulfilled. Enforcement agencies rely on undercover techniques, financial tracing, and basic digital forensics, yet investigations remain constrained by encryption, cross-border servers, limited forensic infrastructure, and uneven regional capacity. Preventive efforts by municipal enforcement authorities, syariah institutions, prosecutors, and community actors show potential but remain inconsistent due to budget limitations and digital-literacy gaps. Courts also consider non-juridical factors, including repentance, motive, and socio-economic background, while maintaining due-process guarantees. The study concludes that Aceh has developed an emerging integrated criminal justice response combining repressive, preventive, and educational measures. Nevertheless, its effectiveness requires clearer interpretive guidelines, formal inter-agency protocols, certified regional digital forensic facilities, standardized procedures for electronic evidence, sustained capacity-building, and community-based digital literacy programs.

Abstract

This study aims to analyse the evidentiary crisis in criminal defamation within the digital space and examine how the interaction between legal norms, electronic evidence, and public perception affects the determination of legal truth. Employing a normative legal research design enriched with a socio-legal perspective, this study analyses statutory provisions (the 2023 Criminal Code and amended ITE Law), Constitutional Court rulings, and empirical case studies of contemporary viral disputes, particularly the digital defamation conflict in East Aceh and the administrative takedown controversy involving state regulatory bodies. The results show that the digital evidentiary crisis is driven by four interrelated dimensions: the normative ambiguity of legal boundaries, the technical instability and AI-manipulation vulnerability of electronic evidence, the dominance of public perception generating “trial by social media”, and the pre-emption of judicial authority by administrative classifications and platform governance. This research develops the analytical concept of the “digital evidentiary crisis” to illuminate the structural tension between procedural “legal truth” and algorithmically amplified “social truth”. By integrating criminal evidentiary doctrine, platform governance, and socio-legal communication dynamics, this study emphasizes the urgent need for robust electronic evidence authentication standards and adaptive digital co-regulation to preserve the presumption of innocence, due process of law, and freedom of expression in the digital age.
