Abstract

The second-hand clothing trade has emerged as a significant global industry, with the export and import of used clothing playing a vital role in the worldwide economy. However, the environmental impact of this trade has become a significant concern, particularly in developing countries that receive large quantities of used clothing. Reusing used clothing can be motivated by various considerations, such as charity, economic issues, reducing emissions and water use, and as benefits for prisoners during wartime. However, it is still unclear how much it can improve the sustainability of the apparel sector. According to the U.S. Environmental Protection Agency's most recent estimates, Americans dumped more than 21 billion pounds of clothing and other textiles into landfills in 2015. This amount is a significant increase from 12.5 billion pounds in 2000 and 4.6 billion pounds in 1980. Yet the proliferation of the inexpensive, disposable clothing known as "fast fashion" is one of the many environmental issues the apparel sector faces, along with water pollution and greenhouse gas emissions. Through normative library research using secondary data, this article examines the current international regulatory frameworks on the second-hand clothing trade and its environmental impacts. The finding highlights the importance of engaging stakeholders, including governments, NGOs, and the private sector, in developing more effective regulations and practices to regulate the environmental impact of the second-hand clothing trade. This article recommends more significant attention to the environmental effects of the second-hand clothing trade and for international regulations to be developed to promote more sustainable and responsible practices in this industry. Keywords: International Law, Enviromental Law, Thrifting Policy.

Abstract

Introduction to the Problem: The rapid expansion of digital markets, driven by network effects and data concentration, challenges traditional merger control frameworks, particularly due to the risk of market “tipping” toward dominant platforms in jurisdictions such as Indonesia, the United States, China, and the European Union. Purpose/Study Objectives: To examine the criteria used by competition authorities in assessing mergers involving application-based companies and their implications for fair competition in digital markets. Design/Methodology/Approach: This study employs a normative juridical method with a comparative approach, analysing merger control regimes in Indonesia, the European Union, the United States, and China, including key assessment tests such as SLC, SIEC, and dominance-based approaches. Findings: The study finds that traditional indicators such as market share and transaction value are insufficient to capture competitive risks in digital markets. Mergers may reinforce data control, ecosystem dominance, and eliminate potential competition without immediate effects on market structure. Therefore, competition authorities should adopt more forward-looking assessments that consider data, innovation, and tipping risks, alongside stronger pre- and post-merger oversight to protect long-term competition and consumer welfare. Abstract

The development of Artificial Intelligence (AI) technology has made a significant contribution to the legal field, particularly in the drafting of business contracts such as Joint Venture Agreements (JVAs). AI assists in researching necessary data and drafting contractual clauses in JVAs. Although AI greatly facilitates contract drafting, it has inherent limitations because it cannot fully accommodate the legal context, or the specific needs of the parties involved in a transaction. This article examines the use of AI in contract drafting through the lens of Roscoe Pound’s theory of Mechanical Jurisprudence. Pound criticized the rigid application of law by judges, which this study analogizes to AI-generated contract clauses that are standardized and insufficiently responsive to the parties’ particular interests. The research is conducted through a literature review using a normative and prescriptive legal approach. The study concludes that AI should be used only as an auxiliary tool rather than as a primary reference in contract drafting, especially for complex business contracts such as JVAs. This is because AI-generated outputs are not the product of human legal reasoning capable of incorporating legal context, social norms, party interests, and considerations of justice. Consequently, such outputs remain rigid and require careful analysis and review by human contract drafters.
