Abstract

The purpose of the study is to determine the effectiveness of health human resources in public health services at the Babakan Community Health Center, Mataram City based on Law Number 17 of 2023 concerning Health, and to determine the obstacle factors Health Human Resources from providing health services at the Babakan Community Health Center. The type of research is empirical legal research which analyzes the gap between what ought (das sollen) in Law Number 17 of 2023 concerning Health and the facts that occur in the field (das sein). Based on the result of the study, shows that The effectiveness of Health Human Resources in Public Health Services at the Babakan Community Health Center has not been effective, because the number of medical personnel and health workers is still insufficient, so there are often long queues of patients for treatment at the Babakan Community Health Center. Consequently, the Community Health Center often receives complaints from patients regarding the long queues for health services at the Babakan Community Health Center, the factors inhibiting the Effectiveness of Health Human Resources in Community Health Services at the Babakan Health Center, Mataram City Based on Law Number 17 of 2023 concerning Health general factors legal factors, service factors, community factors. Specific factors unequal distribution of health workers, slow service system.

Abstract

This research aims to find out nurses' responsibilities if they make mistakes while on duty and do not fulfill their obligations according to the provisions of Law Number 38 of 2014 concerning Nursing. Furthermore, it analyzes dispute resolution concerning malpractice by nurses under the provisions of Law Number 38 of 2014 2014 on Nursing. The type of research is normative legal research. The research conclusion is that the nurse's civil liability for malpractice against patients is subject to the work agreement that has been made and mutually agreed between the nurse and the hospital and with absolute liability (strict liability), which refers to the provisions of Article 1601 jo. 1601a Civil Code. If it is expressly agreed in the work agreement that the nurse is fully responsible for malpractice, then the nurse bears all losses caused by his actions, based on the provisions of Article 1365 jo. Article 1366 of the Civil Code, and Article 310 of Law Number 17 of 2023 concerning Health. Forms of dispute resolution if malpractice occurs include compensation costs which will be paid to the patient (in this case the victim). Patients who experience losses due to malpractice actions by nurses can take legal action through litigation and non-litigation channels. The litigation is by filing a lawsuit before the District Court following the relative competence of the court. The non-litigation is in the form of mediation, namely peaceful resolution of disputes. This mediation process is divided into two, namely those carried before the court and outside the court.

Abstract

Penelitian ini bertujuan untuk menjelaskan pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien treatment kecantikan di Kota Mataram dan mengetahui jika terjadinya wanprestasi/kelalaian dalam pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien perawatan kecantikan di Kota Mataram. Jenis penelitian yang digunakan adalah penelitian hukum empiris, menggunakan metode pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan sosiologis. Teknik memperoleh data menggunakan teknik wawancara dan studi dokumen dianalisis secara deduktif. Hasil penelitian di lapangan menunjukkan pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien treatment kecantikan di Klinik Kecantikan Kota Mataram telah memenuhi syarat dan secara yuridis sah sesuai dengan ketentuan Pasal 1320 KUH Perdata. Wanprestasi/kelalaian dalam pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien treatment kecantikan terjadi jika adanya ketidakpelaksanaan kewajiban atau ketidakpenuhan prestasi yang telah disepakati sehingga menyebabkan kerugian pada pasien. Perawatan hingga pemulihan kondisi diberikan secara gratis sebagai tanggungjawab pihak klinik kecantikan atas wanprestasi yang dilakukannya.

Abstract

Tujuan penelitian ini untuk mengetahui perlindungan hukum yang diberikan kepada pasien dalam konteks pelayanan konsultasi pemeriksaan kesehatan online atau telemedicine menurut Peraturan Menteri Kesehatan Nomor 20 Tahun 2019 Tentang Penyelenggaraan Pelayanan Telemedicine Antar Fasilitas Pelayanan Kesehatan. Jenis penelitian ini menggunakan penelitian hukum normatif dengan pendekatan Undang-Undang (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian ini adalah perlindungan yang didapatkan oleh pasien dalam layanan konsultasi Kesehatan online berupa perlindungan terhadap hak-hak pasien, rekam medis dan pertanggungjawaban dokter. Kemudian pertanggung jawaban dokter dalam kesalahan pemeriksaan Kesehatan secara online dapat berupa pertanggungjawaban perdata, pidana, dan administrasi.

Abstract

Penelitian ini bertujuan untuk menjelaskan pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien treatment kecantikan di Kota Mataram dan mengetahui jika terjadinya wanprestasi/kelalaian dalam pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien perawatan kecantikan di Kota Mataram. Jenis penelitian yang digunakan adalah penelitian hukum empiris, menggunakan metode pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan sosiologis. Teknik memperoleh data menggunakan teknik wawancara dan studi dokumen dianalisis secara deduktif. Hasil penelitian di lapangan menunjukkan pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien treatment kecantikan di Klinik Kecantikan Kota Mataram telah memenuhi syarat dan secara yuridis sah sesuai dengan ketentuan Pasal 1320 KUH Perdata. Wanprestasi/kelalaian dalam pelaksanaan kesepakatan tindakan medis antara pihak klinik dengan pasien treatment kecantikan terjadi jika adanya ketidakpelaksanaan kewajiban atau ketidakpenuhan prestasi yang telah disepakati sehingga menyebabkan kerugian pada pasien. Perawatan hingga pemulihan kondisi diberikan secara gratis sebagai tanggungjawab pihak klinik kecantikan atas wanprestasi yang dilakukannya.

Abstract

Penelitian ini bertujuan untuk mengetahui kepastian hukum waktu kerja dan perubahan yang terdapat dalam pasal 81 UU No. 6 Tahun 2023 yang mengubah pasal 59 UU No. 13 Tahun 2003 tentang Ketenagakerjaan. Penelitian ini menggunakan jenis penelitian yuridis  normatif  (legalresearch), yakni penelitian yang difokuskan untuk mengkaji penerapan  kaidah-kaidah  atau  norma-norma dalam hukum positif yang berlaku. Dengan  cara  mengkaji  berbagai  aturan  hukum yang  bersifat  formil  seperti  undang-undang,  peraturan-peraturan serta literatur yang berisi konsep-konsep teoritis yang kemudian  dihubungkan  dengan  permasalahan  yang akan dibahas dalam skripsi ini. Hasil dari penelitian ini menunjukkan bahwa secara umum, klaster ketenagakerjaan dalam UU No. 6 Tahun 2023 tidak membawa kepastian hukum dan justru menimbulkan ketidakpastian kerja. Alih-alih memberikan kepastian hukum, ketidaksinkronan dengan peraturan pelaksana UU No.11 Tahun 2020 yang tetap berlaku, serta munculnya pasal tambahan terkait pengupahan, justru dapat memberikan ketidakpastian hukum tambahan pasca berlakunya UU No. 6 Tahun 2023. Dalam UU No. 6 tahun 2023 ditemukan adanya perubahan  pengaturan mengenai perjanjian kerja waktu tertentu yang semula diatur dalam UU No. 13 tahun 2003 tentang ketenagakerjaan, perubahan pengaturan terdiri dari perubahan jangka waktu dalam perjanjian kerja waktu tertentu, perubahan  pembaharuan perpanjangan perjanjian kerja waktu tertentu, penghapusan akibat hukum apabila perjanjian kerja waktu tertentu dibuat secara tidak tertulis, penegasan akibat hukum apabila PKWT mensyaratkan masa percobaan, penambahan jenis pekerjaan tertentu yang dapat dibuat dalam PKWT dan pengaturan uang kompensasi dalam PKWT.
