Abstract

This study examines how the juridical-normative perspective and the concept of maqāṣid al-sharī‘ah work together to understand the objectives of law in the contemporary era. While maqāṣid al-sharī‘ah emphasizes the protection of religion, life, intellect, lineage, and property as the fundamental aims of Islamic law, the juridical-normative approach views law as a set of standards that must be followed to ensure certainty and order. The findings indicate that both approaches complement each other in achieving justice, benefit, and legal certainty. Modern dynamics—such as digitalization, blockchain technology, personal data protection, and legal institutional reform—require more contextual and adaptive interpretation. Integrating the values of maqāṣid into positive law is considered capable of enhancing the legal system’s responsiveness to social developments and societal demands. This study concludes that strengthening maqāṣid al-sharī‘ah within regulations and judicial practices is a strategic step toward building a legal system that is humanistic, transformative, and oriented toward public welfare.

Abstract

Dalam hukum Islam, pemakaian jilbab wajib bagi muslimah. Setiap pemakainya  didasari beberapa motivasi, satu diantaranya ibadah sebagai motivasi utama. Berdasarkan perintah teks-teks suci al-Qur’an dan al-Sunnah maka pelaksanaanyapun bernilai ibadah. Jilbab berada pada posisi sesungguhnya yang telah dilegitimasi pemakaiannya, juga sebagai kehormatan dan kemuliaan bukan untuk menjatuhkan kemanusiaan dan menurunkan martabat, justru bagi Polwan menambah energik baru, professional dalam berdinas, mampu meningkatkan kinerja dan tetap melalukan pelayanan dengan baik. Peraturan Kapolri tentang jilbab hanyalah bersifat boleh bukan suatu keharusan yang ditaati dalam lingkup kepolisian. Dari kebijakan Polri tersebut bisa dinilai bahwa para Polwan yang memakai jilbab didasari oleh kemauan sendiri yang memiliki spesifikasi alasan sebagai perintah agama terlebih tidak ada intervensi dan paksaan dari pihak manapun yang kemudian alasan memakai diikuti motivasi lain.

Abstract

This paper elaborates on the Papuan People's Assembly Electing Non-Muslim Leaders in Non-Muslim Majority Areas in the Perspective of Mashid Syari'ah in Jayapura City, Papua Province. The results of this study indicate that the Papuan People's Council (MRP) elects leaders in non-Muslim majority areas in the perspective of maqasid syari'ah in Papua, in its role in the process of organizing the selection of prospective leaders in Papua, has taken away the rights of citizens in general. it is decided by the competent authority of the Papuan People's Assembly (MRP) following what has been decided by formal institutions, such as the General Election Commission (KPU) and traditional institutions that have been given authority according to law. In the provisions of Law No. 21 of 2001 on Papua Special Autonomy, there is no room or space for immigrants. As for the recruitment process for prospective leaders such as Governors and Deputy Governors based on Law No. 21 of 2001 The basic matters that constitute the contents of this Law include the arrangement of authority between the Government and the Provincial Government of Papua and the application of this authority in Papua Province which is carried out with specificity. This law places indigenous Papuans and the population of Papua in general as the main subjects. The existence of the Government, Provincial Government, Regency / City Government, as well as the apparatus under them, are all directed at providing the best service and empowering the people.
