Abstract

This study aims to examine and analyze the juridical and victimological correlations to the forms and developments of narcotics crime based on several Decisions of the District Court of Makassar during the Covid-19 pandemic. This study uses normative legal research with a statute approach and a case approach. The collected legal material is analyzed using qualitative analysis techniques to describe the problem and answer study purposes. The results show juridical and victimological correlations: Law No. 8 of 1981, Law No. 35 of 2009, and Rehabilitation. The forms and developments of narcotics crime during the Covid-19 pandemic can be identified based on the application of investigator testimony, victims of abusers, rehabilitation, participation, criminal disparity, special minimum punishment, undercover buying, and the best interest principle for children. Therefore, it is recommended that all law enforcement agencies not abuse their authority in implementing the juridical and victimological correlations. In this case, eradicating narcotics crimes in Indonesia can be more effective in the future.

Abstract

This study aims to analyze the crime of deliberately not paying taxes that have been withheld or collected (Tax Evasion) in Indonesia. This study uses normative legal research with a statutory approach (statute approach) and a case approach (statute approach). In this study, legal materials were analyzed qualitatively with steps, namely (1) identifying legal facts and eliminating irrelevant matters; (2) collecting legal and non-legal materials; (3) conducting a review of legal issues; (4) drawing conclusions and providing prescriptions.The results of the study show that First, the general description includes the indictment, demands, witness statements, and expert statements. Second, in the analysis of facts, there are differences between public prosecutors and legal advisors specifically in calculating losses to state revenues, and thirdly, in the juridical analysis, there are differences in the application of legislation where the application of administrative penal law and ultimum remedium is not yet achieved

Abstract

This research aims to analyze the aggravation of members of the TNI who commit torture resulting in death.This research uses normative legal research with a statutory approach (statute approach) and a case approach (statute approach) with the following steps: (1) identifying legal facts and eliminating irrelevant matters; (2) collecting legal and non-legal materials; (3) conducting a review of legal issues; (4) drawing conclusions and providing prescriptions.The results of the research show that first, reviewing Decision No. 61-K/PM I-04/AD/VII/2020 and Decision No. 161-/PM.II-08/AD/VIII/2020 based on a) case of position, has described criminal events, criminal acts, and criminal acts, and b) mitigating and aggravating circumstances, has described differences. Second, the weighting of TNI members who commit abuse resulting in death can be determined through 1) the defendant being a member of the TNI, 2) Article 52 of the Criminal Code, 3) Article 131 of the Military Criminal Code, and 4) causing death.

Abstract

The phenomenon of community associations or associations that do not have legal entities leads this research to seek a re-definition of corporations in Law Number 1 Year 2023. The research is conducted normatively with a historical, statutory and case approach. This will be analyzed qualitatively in order to answer legal questions. The research found that First, the history of corporations in the United States has described the development of terms, understanding, bad behavior, criminal administration, prosecution, criminal liability to deferred prosecution aggrement. Second, the efforts to redefine corporation are divided into 3 (three) things, namely 1) based on legislation, where 7 (seven) phases of development of the meaning of corporation are found, both indirectly and directly; 2) based on the existence of the Business Competition Supervisory Commission which has a connection with corporate crime and can cause problems in the future if it is connected to Article 146 of the New Criminal Code; and 3) based on a systematic review of the New Criminal Code which can cause problems such as the existence of terms without understanding or explanation, the existence of almost the same meaning without explanation, the contradiction of terms and the use of unnecessary words.

Abstract

Penelitian ini bertujuan untuk menganalisis disparitas vonis akibat pemisahan tiga perkara narkotika yang dalam satu rangkaian peristiwa pidana. Penelitian ini menggunakan penelitian normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum di analisis secara kualitatif untuk menjawab isu hukum dan memberikan preskripsi. Hasil Penelitian menunjukkan Pertama, Bagan Kasus Posisi berdasar Dakwaan telah menggambarkan kasus itu dalam satu rangkaian peristiwa pidana. Kedua, Bagan Penahanan, Pelimpahan, Dakwaan, Tuntutan, dan Putusan telah menggambarkan bahwa terdapat perbedaan. Ketiga, maksud Disparitas Vonis yaitu Putusan yang menyatakan bersalah dibandingkan dengan yang bersalah, bersalah dengan tidak bersalah, hingga yang dalam satu rangkaian peristiwa pidana seperti perkara a quo. Keempat, perkara a quo telah memperlihatkan sumber Disparitas Vonis, perpindahan pemeriksaan dari Kepolisian ke Kejaksaan.

Abstract

Animal welfare is proven by fulfilling the 5 principles of animal freedom or five freedoms, namely freedom from hunger and thirst, from discomfort, from pain, injury, or disease, freedom to express normal behavior, and freedom from fear and distress. This research focuses on dogs and cats because in line with cases that occurred in Makassar City, these two animals are often victims of violence. The research aims to describe the public's perception in Makassar City regarding animal welfare, the police's perception of forensic veterinary, the application of forensic veterinary as a law enforcement tool, as well as solutions for implementing forensic veterinary to protect animal rights in Makassar City. This research uses a mixed method with a Sequential Explanatory approach model. The first research used quantitative methods to answer the first to third problem formulations and qualitative methods to answer the fourth problem formulation. Data analysis using quantitative methods through descriptive analysis using the SPSS application. Meanwhile, qualitative data analysis involves reducing the data to concluding. The research results show that public knowledge regarding animal welfare is very low and police investigators' knowledge of veterinary forensics is quite good, but not yet in line with its implementation. Therefore, veterinary forensics is present as an effort to enforce the law against acts of animal violence in realizing animal welfare in the city of Makassar.

Abstract

This study examines the extent to which the implementation of the rights and obligations of Public and Private General Hospitals in Makassar City and the obstacles that make these rights and obligations difficult to implement. The research method used in this study is the empirical method. The results of this study indicate that the implementation of the rights and obligations at the Regional General Hospital (Rumah Sakit Umum Daerah/RSUD) of Makassar City and the Mother and Child Hospital (Rumah Sakit Ibu dan Anak/RSIA) Ananda has carried out the rights and obligations of the hospital simultaneously. However, in the implementation of these rights and obligations, there are still several obstacles, such as community habits, administrative completeness that does not meet minimum service standards, and other supporting infrastructure. Especially for Makassar City Hospital, the data for health personnel has not been updated as mandated by the Government Regulation on the Implementation of the Hospital Sector. Meanwhile, RSIA Ananda must improve the facilities and infrastructure of the hospital parking lot so that health services can be more optimal and effective, and efficient to carry out.

Abstract

This research aims to provide prescriptions on what is the relevance of the Value of Goods toward Criminal Act of Theft and what should be done. This research is a Normative Research, with the approach was Conceptual, Statute and Case approach. Legal material itself was legislation, court rulings, legal journals, theses, and other official legal publications. The data then were analyzed qualitatively. The result of the researcher indicate that the Value of Goods as the causa prima has relevance to criminal act of theft. Misdriff or not, using regular or quick criminal procedure, both depend on the Value of Goods and the specific situation. On the other hand, the accusation of the public prosecutor has an essential role, especially in determining the loss, the specification of evidence, and the application of the Article which has implications for the consideration of judges' decisions. Finally, the high burden of cases and other problems can be prevented by strengthening the existence of misdriff through the adjustment or reconstruction of the Value of Goods until reconstruction of the Criminal Act of Theft.

Abstract

RUU KUHAP masuk Prolegnas 2025 telah membuka diskusi, salahsatunya tidak tersedianya mekanisme restorative justice. Padahal, terjadi disharmonisasi yang berpotensi menciptakan pertentangan norma antara institusi. Untuk itu, peluang untuk penataan restorative justice dalam RUU KUHAP diyakini akan menjawab isu pertentangan norma itu. Apalagi penataan itu dilakukan terhadap perundang-undangan yang lebih tinggi daripada Perja maupun Perpol. Artikel ini akan menggunakan penelitian hukum normatif dengan pendekatan perundang–undangan (statute approach) dan pendekatan konsep (conceptual approach) guna memecahkan pertentangan norma itu dan menawarkan rekomendasi untuk penataan mekanisme. Hasil menunjukkan bahwa tidak adanya pengaturan acara pemeriksaan cepat, namun terdapat Hakim Pemeriksa Pendahuluan yang dapat menjadi ruang mekanisme restorative justice sebagai proses. Peluang mekanisme restorative justice diterapkan dan dilakukan penataan dalam RUU KUHAP berbasis mix penal-nonpenal dan asas publistas, dapat memberi manfaat.
