Abstract

Marriage preparation course (Kursus Calon Pengantin – Suscatin) is a short course for engaged couples about domestic life. Legal basis for this course is Regulation from General Director of Islamic Community Guidance No DJ.II/491 Year 2009 renewed by No DJ.II/542 Year 2013. Therefore, the course is basically an effort made by the government – BP4 – to provide the couple with skill and psychological provision to overcome marriage problems. Thus, theidea of loving, affection and compassion in marriage may be achieved and at the same time also to realize a harmonious society and to avoid family conflict and divorce. Theoretically, materials of the marriage preparation course by Office of Religious Affairs (KUA) are comprehensive, covering: rules and procedures of marriage; religious knowledge; marriage and family laws and regulations; rights and obligations of husband and wife; female reproduction health; familymanagement; and also psychology of marriage and family. Unfortunately, the practice of the course has become a mere formality.

Abstract

A worriness about the mix of ilm al-kalam with ilm al-Mantiq of Aristoteles, which is considered inconsistent, have prompted several Muslim thinkers like Ibn Taimiyah and Ibn Qayyim Al-Jauziah to ban the available ilm al-kalam at that time. They both believed that, in ilm al-Mantiq of Aristoteles, there is no qiyas aula or an effort of humanizing God and, therefore, it will result in not recognizing God as creator of universe (because universe exists by himself). Thus, the tradition of  ilm al-Mantiq have made someone to be kufr. Meanwhile, the ulama of kalam have tended to also used Aristoteles’ framework of thinking in building their arguments. Abstract

The number of divorce cases filed by wives is increasing. One of the factors considered to be the cause is the Nafkah issue. Accordingly, the discourse on the problem of sustenance as a reason for divorce among classical fiqh scholars and reinterpreting the text to find a solution to the high rate of divorce due to economic and living reasons, without having to leave the classical Islamic scholar’s legal tradition, needs to be studied more deeply. This research aims to provide a solution to prevent divorce caused by family conflicts due to economic factors by reviewing the concept of alimony from the perspective of fiqh. This research is qualitative, using a normative approach to fiqh and interpretation. The results of this study indicated that there was a need for reinterpretation of the views of the majority of scholars regarding the wife’s right to ask for a divorce from the judge if the husband does not provide a living. If the opinion of the fiqh scholars continues to be applied, it will increase the number of divorce cases for economic and livelihood reasons. Moreover, this action received legitimacy from stakeholders through marriage laws and regulations. The interpretation of KH. Husayn Muhammad’s of Q.S. al-Nisa' (4): 34 needs to be used as a reference in updating the law regarding the obligation of a living so that it is hoped that there will be no more divorces carried out for economic and livelihood reasons.

Abstract

Pernikahan dini dan perundungan (bullying) merupakan dua isu yang krusial di kalangan remaja Indonesia. Kedua masalah tersebut memiliki dampak yang signifikan terhadap perkembangan fisik, mental, dan sosial remaja. Dalam upaya mengurangi insiden pernikahan dini dan perundungan pada remaja, diperlukan penyuluhan hukum sebagai upaya preventif. Penyuluhan hukum merupakan kegiatan edukasi yang bertujuan untuk meningkatkan pemahaman masyarakat tentang hukum yang berlaku. Penyuluhan ini sangat penting dalam mencegah pernikahan dini dan perundungan dengan cara meningkatkan kesadaran hukum remaja seperti memberikan informasi mengenai undang-undang perlindungan anak, hak-hak anak, dan konsekuensi hukum dari pernikahan dini dan perundungan. Dimana kegiatan tersebut merupakan wujud nyata pengabdian Fakultas Syariah IAIN Kediri kepada masyarakat dengan metode Participatory Action Reasearch (PAR). Hasil kegiatan ini menyimpulkan bahwa penyuluhan hukum adalah alat yang efektif dalam upaya preventif pernikahan dini dan perundungan di kalangan remaja. Dengan meningkatkan kesadaran hukum dan menyediakan edukasi yang komprehensif, diharapkan insiden pernikahan dini dan perundungan dapat dikurangi secara signifikan.

Abstract

Abstract: This article explores the debatable problems concerning with the unification of the Religious Courts under the auspices of the Supreme Court. The transfer of authority of the Religious Courts from the Ministry of Religion Affairs to the Supreme Court was deemed inappropriate and uprooted Religious Courts from its historical roots. Therefore, it is necessary to analyze the historical context of Religious Courts and its contemporary dynamics in the form of its unification under the justice system in Indonesia. This research concludes that the positioning of Religious Courts under the auspices of Ministry of Religious Affairs since the independence era was not an attempt to weaken its authority, but rather an effort to save Religious Courts from the threat of dismissal. Religious Court was posed to the threat of dismissal during the political turmoil in the early establishment of Indonesian state due to disputes over the determination of ideal form of the Indonesian state, between a secular state, a religious state, or a nation state. Thus, the transfer of the Relligious Courts from Ministry of Religious Affairs to the same roof with other courts under the auspices of the Supreme Court is not an effort to reduce the authority of the Religious Court or weaken existence. In fact, this unification has returned the Religious Court to its approriate position and eliminated the long-standing negative stigma against this institution.Abstrak: Artikel ini mengeksplorasi problematika penyatuatapan Pengadilan Agama (PA) di bawah Mahkamah Agung (MA) yang menyebabkan polemik. Pengalihan keberadaan PA dari Kementerian Agama ke MA dianggap tidak tepat dan membuat PA tercerabut dari akar historisnya. Oleh karena itu, perlu dianalisis lebih mendalam terkait sinkronisasi sejarah PA dan dinamika kontemporernya berupa unifikasi sistem peradilan di Indonesia. Penelitian ini menyimpulkan bahwa keberadaan PA di bawah Kementerian Agama yang terjadi sejak masa kemerdekaan bukanlah upaya pengebirian terhadap PA, melainkan merupakan sebuah bentuk usaha penyelamatan PA dari ancaman penghapusan. Ancaman penghapusan tersebut muncul ketika negara Indonesia masih belum stabil dikarenakan adanya perselisihan tentang diskursus bentuk negara Indonesia, antara negara sekuler, negara agama, dan nation state. Dengan demikian, keberadaan PA yang menjadi satu atap dengan peradilan lainnya di bawah MA bukanlah upaya mengurangi kewenangan atau melemahkan PA. Sebaliknya, penyatuatapan ini telah mengembalikan PA pada posisi seharusnya dan menghilangkan stigma negatif yang dituduhkan kepada PA selama ini.

Abstract

In response to escalating divorce rates in Indonesia, particularly within its Religious Courts, this study explores the limitations of current mediation practices. It proposes local wisdom-based mediation as an alternative approach. Traditional mediation within these courts often fails to prevent divorces effectively, prompting the need for innovative solutions that integrate cultural insights. This research aims to assess the effectiveness of mediation processes within Indonesia's Religious Courts and investigate the potential role of religious leaders in improving mediation outcomes. Specifically, it highlights how local wisdom can be leveraged to mitigate divorce rates by fostering reconciliation and resolving disputes outside formal legal procedures. Using an empirical approach, researchers collected data by interviewing 50 informants, namely judges, religious leaders, and the government, related to the increasing divorce rate. The findings that can be presented are that religious figures, as locals, can reconcile divorced parties without the need to go to religious courts. The Religious Court is seen as a formal facility to certify the divorce of both parties, but has yet to be able to prevent divorce optimally. That is, the high divorce rate in religious courts requires the involvement of religious leaders in reconciling parties who want to divorce. This study accepts the potential for integrating local wisdom in mediating to reduce divorce rates. With an emphasis on cultural sensitivity and community involvement, this approach aims to go beyond the limitations of conventional legal frameworks and promote more meaningful outcomes in resolving marital conflict.

Abstract

The phenomenon of high divorce in Indonesian religious courts or Muslim communities causes government anxiety and raises cynical public opinion. Economic considerations are frequently referred to as the excuse for the wife's lawsuit. Data from the Kediri City Religious Court shows that there is a tendency for wives to file for divorce first. Not without justification, it is frequently prompted by the husband's perceived inability to satisfy the wife's requirements. The use of nafkah reasons in divorce can reveal that there is a contradictory tendency; on the one hand, women tend to charge a nafkah to men, and on the other hand, there is a tendency not to charge a nafkah to men or are willing to work to make ends meet. Divorce may not be a factor in limited economic conditions, but the perception of nafkah obligations imposed on husbands. It is critical to recognize that attempts to avoid divorce cannot be based just on economic empowerment but rather on cultural and religious ideas on partnerships and the separation of husband and wife roles. , this article examines the relationship between a contested divorce and economic conditions and perceptions of gender relations in the family, especially in earning a nafkah, to clarify this contradiction. Using a phenomenological approach. The economic reasons that have led wives to divorce are solely due to emptiness and even an emotional drought of love between husbands' wives. The indulgence of husband and wife in dividing household roles from transitional to egalitarian ideology also requires attention and respect for each other.
