Abstract

The transformation of mining law policy in Law No. 3 of 2020 concerning Minerals and Coal has broad implications for mining law, including illegal tin mining. The high dependence of the tin extractive economy in Bangka Belitung has changed the landscape of this archipelago province as an area with a high level of natural damage and social disasters. The ability of governments through regulatory instruments to tackle illegal mining is an important ideal goal. This research was conducted using socio-legal methods, to produce a comprehensive analysis related to the environmental and social impacts of illegal tin mining after the renewal of the mineral and coal law. This study found that the transition of mining authority from the central government to the regional government directly has an impact on the proliferation of illegal mining activities. Substantive changes in the mineral and coal law have not provided a strategic solution because the tug-of-war over authority ends with the continued delegation of authority to grant community mining permits to local governments. Meanwhile, the unpreparedness of local governments has resulted in the continued marginalization of mining communities and has an impact on widespread environmental damage. The lack of fair decision-making processes for people mining licences is indicative of an immature tin mining management in Bangka Belitung. The purpose of this study is to provide a comprehensive overview of the implications of the latest mineral and coal policies on illegal tin mining activities, as a reference and consideration in strategic policy making to create an ideal and sustainable tin mining ecosystem.

Abstract

Basically, humans are always required to use their minds to think about God's creation, because thinking is an activity that humans cannot avoid in their lives. From this thought process, Intellectual Property Rights (IPR) were born which differ from one human to another because each human has different intellectual abilities. On the other hand, violations of IPR, such as unauthorized use or purchase of pirated works, continue to occur. This violation is not only against norms, but also morals and ethics. This research examines the relationship between ownership of IPR and violations of IPR from a moral and ethical perspective. From the results of the study conducted, the results show that violations of IPR are not only violations of norms, but also ethics. One form of ethical violation is the use of other people's work without mentioning the name of the rights holder, for example the creator. Ethically, this is contrary to moral values.

Abstract

Indonesia memiliki keberagaman hayati, salah satunya dipengaruhi oleh faktor geografis yang berbeda, dan ini mengindikasikan banyak komoditas atau produk potensi indikasi geografis yang berpotensi untuk dilindungi. Dengan potensi yang dimiliki, sudah seharusnya Indonesia memiliki sistem perlindungan indikasi geografis yang memadai. Pada Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, pemohon indikasi geografis diperluas meliputi di antaranya adalah pemerintah daerah provinsi dan kabupaten/ kota, sebaliknya menghapus kelompok konsumen sebagai pemohon. Dijadikannya pemerintah daerah sebagai salah satu pihak yang dapat berperan sebagai pemohon dalam proses pendaftaran indikasi geografis, tentu didasari dengan dasar dan pertimbangan. Di lain sisi, diberikannya kewenangan kepada pemerintah daerah sebagai pemohon, ternyata tidak berbanding lurus dengan jumlah indikasi terdaftar di Indonesia. Dengan kata lain, tidak ada peningkatan yang terlalu signifikan dari sebelum diberikannya kewenangan kepada pemerintah daerah, sampai diberikannya kewenangan itu kepada pemerintah daerah. Penelitian ini bertujuan untuk mengetahui dan menganalisis urgensi dan implikasi diberikannya kewenangan kepada pemerintah daerah sebagai pemohon dalam proses pendaftaran indikasi geografis. Penelitian dilakukan dengan metode yuridis normatif dengan pendekatan undang-undang, sumber data berupa undang-undang sebagai bahan hukum primer, serta bahan hukum sekunder yang terdiri berupa undang-undang, serta didukung oleh bahan hukum sekunder berupa naskah akademik, risalah rapat, buku-buku hukum, jurnal-jurnal, dan data indikasi geografis yang terdaftar di DJKI, kemudian dianalisis secara kualitatif. Hasilnya, diberikannya kewenangan ini urgensinya adalah masyarakat lokal perlu difasilitasi oleh pemerintah daerah agar lebih mudah mendaftarkan indikasi geografis sehingga jumlah indikasi geografis yang terdaftar meningkat pula. Akan tetapi, berdasarkan data yang ada, tujuan pemberian kewenangan ini belum tercapai, meskipun hal ini menunjukkan bahwa kesadaran kolektif hukum masyarakat mulai terbangun ditandai dengan banyaknya indikasi geografis yang diajukan oleh masyarakat secara kolektif melalui MPIG.

Abstract

Penelitian ini membahas bagaimana upaya dinamika migrasi yang terjadi di sekitar wilayah tambang timah dan tantangan yang dihadapi dalam upaya reklamasi lahan bekas tambang di Bangka Belitung. Tujuan penelitian adalah untuk menganalisis hambatan yang dihadapi dalam upaya mereklamasi lahan bekas tambang demi kesejahteraan komunitas dan lingkungan, serta mengidentifikasi migrasi pertambangan timah terhadap usaha reklamasi. Penelitian ini menggunakan metode kualitatif deskriptif, yaitu pendekatan penelitian yang berfokus pada pemahaman mendalam terhadap fenomena yang diteliti. Serta, wawancara mendalam dengan penambang timah, serta Focus Group Discussion (FGD) dengan para narasumber yang sudah ditentukan bersadarkan karakteristik penelitian. Hasil analisis dalam upaya mereklamasi lahan bekas tambang untuk kesejahteraan komunitas dan lingkungan, terdapat beberapa hambatan utama, yaitu penolakan oleh 30% masyarakat yang khawatir akan penguasaan lahan oleh perusahaan, luasnya void pada 60 lahan eks tambang, jual beli dan klaim tanah oleh penambang rakyat pada 80% area eks tambang, serta maraknya tambang ilegal akibat tingginya harga timah dunia. Hambatan terbesar adalah tambang ilegal yang meskipun merusak lingkungan, tetap dilakukan karena tekanan ekonomi. Penulis dan PT Timah Tbk berupaya memberikan solusi untuk mengatasi hambatan-hambatan dan mengurangi dampak buruk pertambangan bagi lingkungan. Sedangkan, pengaruh migrasi terhadap struktur sosial dan ekonomi komunitas telah mengubah struktur sosial dan ekonomi komunitas dengan menciptakan peluang pekerjaan baru, meningkatkan produktivitas lahan, dan mengembangkan potensi wisata serta konservasi lingkungan. Hal ini berkontribusi pada kesejahteraan komunitas dan kelestarian lingkungan secara berkelanjutan. Sehingga dapat ditarik kesimpulan reklamasi pertambangan di Bangka Belitung adalah langkah positif menuju masa depan yang lebih berkelanjutan.

Abstract

Sampai saat ini, ada sekitar 92 indikasi geografis yang terdaftar di Direktorat Jenderal Hak Kekayaan Intelektual Kementerian Hukum dan Hak Asai Manusia Republik Indonesia. Salah satu di antaranya adalah Lada Putih Muntok (Muntok White Pepper) yang terdaftar oleh Badan Pengelola, Pengembangan dan Pemasaran Lada (BP3L) Provinsi Kepulauan Bangka Belitung dengan ID G 000000004 pada 28 April 2010. Sesuai dengan ketentuan Pasal 70 Ayat (1) Undang-Undang Republik Indonesia Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, pembinaan indikasi geografis dilakukan oleh pemerintah pusat dan/atau pemerintah daerah sesuai dengan kewenangannya, meliputi di antaranya inventarisasi potensi produk indikasi geografis. Hanya saja, bila merujuk pada Lada Putih Muntok yang menjadi satu-satunya indikasi geografis terdaftar dari Kepulauan Bangka Belitung di Direktorat Jenderal Hak Kekayaan Intelektual Kementerian Hukum dan Hak Asasi Manusia, timbul pertanyaan terkait pembinaan berupa inventarisasi potensi produk indikasi geografis, terutama yang dilakukan oleh pemerintah daerah di Kepulauan Bangka Belitung. Penelitian ini dilakukan berdasarkan metode penelitian yang sudah disusun sedemikian rupa, yakni bersifat yuridis empiris. Dari hasil penelitian yang dilakukan di seluruh pemerintah daerah kabupaten/ kota yang ada di Kepulauan Bangka Belitung, secara umum dapat dikatakan bahwa pemerintah daerah kabupaten/ kota belum melakukan upaya optimal terkait inventarisasi. Belum optimalnya upaya inventarisasi diakibatkan oleh banyak hal, di antaranya adalah tugas pokok dan fungsi yang dianggap tidak ada kaitanya dengan kekayaan intelektual terutama indikasi georafis, tidak ada program kerja yang berkaitan dengan kekayaan intelektual terutama indikasi geografis, secara kelembagaan terjadi miss-persepsi instansi mana yang dianggap berwenang.

Abstract

As a financial institution which as intermediating function, bank has to re-distribute credits relied on collected funding from the people, thus the funding circle works properly. Article 2 Banking Law decrees that in applying duties Indonesian banking as based on Pancasila and Constitution of Republic of Indonesia 1945 of years by using orudent principal. Abstract

Mining is one of the sectors that becomes an economic country’s support until now. Environmental issues is kind of difficult things and can’t even be separated from mining activities. Belitung island is as part of the largest tin-producing province in Indonesia that has been exploited since the 18 century. It also has experienced the environmental crisis as well as other mining areas has in Indonesia. This research is conducted as an effort to discover and unravel the problematic implementation of reclamation on the ex-tin mine’s land in Belitung Island by using a conceptual approach and legislative approach. Based on the observation’s result, it shows that the reclamation’s result in Belitung Island has not been successful. Data from PT Timah (Persero) Tbk about the reclamation in Belitung Island also shows that the realization is far from the plan. There is no target that achieved successfully every year, also there is no reclamation that reaches 50 percent, the maximum is only 25 percent in 2016. th

Abstract

Most People around this country must have their own ways and mechanism for land issues before the form of written legislation is being publicized including people in Bangka Island. For example, the plantation land in Pasirputih Village, Tukak Sadai District, South Bangka Regency is arranged orderly. There are several requirements that must be obey in order to open the plantation land, such as they must be ‘herenteng’ (equal) between one plantation land and others. Besides, there are several prohibitions when opening the plantation land that shouldn’t be break by the people, those are ‘apit’ and ‘kaet’. These prohibitions are not written, but still being obeyed by the people. Something that is still maintained in this area is interesting to examine from the perspective of law number 5 of 1960 that is concerning the Basic Regulations of Agrarian (UUPA).

Abstract

Mining activities that tend to ignore or even damage the environment indicate an anthropocentrism behavior where human interests take more precedence than the environmental sustainability. Economic interests are often the main reason for mining activity such as cutting down protected forests, damaging and polluting watersheds, and etc. As an area that has been exploited for a long time, East Belitung has experienced the increasing number of its critical land and natural disasters such as floods because of tin mining that ignores the environment. This condition show that the legal culture of the miner's environment has not been developed yet, or it’s already exists but the clash with economic interests and dependence on tin has made anthropocentrism become more dominant. Policies, prevention efforts, socialization and enforcement have been carried out but the fact shows it’s not easy to harmonize between anthropocentrism and awareness of the environmental law of the community..

Abstract

Basically, humans are born with different intellectual abilities in processing their thougths and produce somethingfrom that thought. Therefore, it is important to provide protection for the results of thought through the intellectual property rights regime. However, in practice there are still many cases where the intellectual property of a person or agroup or a legal entity is used without prior permission. This juridical normative research examines fundamental thoughts for the protection of the results of one's thinking which is called intellectual property rights. There are several thoughts which become form the basis for protecting intellectual property rights; they are the natural right protection to reputation that has been built over a long time and quite high cost and also as a form of compensation and encouragement for people to create or find something.With the basic ideas behind the protection of IPR, the protection provided will be maximized, and the results of one's thinking will be more respected, both moral rights and economic rights
