Abstract

Indonesian Government confronts a multifaceted challenge in repatriating former ISIS members, necessitating a delicate equilibrium between advocacy, citizenship status, and human rights principles. International conventions uphold the fundamental right to nationality, articulated in Article 15 of the Universal Declaration of Human Rights, yet over 500 former ISIS members from Indonesia remain stranded in Syria, having illegally departed and destroyed their official documentation. While several countries in Southeast Asia and Europe have undertaken repatriation efforts under rigorous conditions, Indonesia faces a quandary. These individuals do not qualify as People with Social Welfare Problems under domestic law, complicating their reintegration. This classification divergence conflicts with international obligations requiring nations to accept and restore nationality to their citizens, notwithstanding their affiliation with extremist groups not recognized as refugees by the UNHCR. This paper delves into the legal and humanitarian imperatives compelling Indonesia to address this issue. It examines international frameworks and national legislation to argue for the necessity of repatriation, while also exploring the preventive and repressive measures Indonesia employs. Balancing the imperative to safeguard human rights with national security concerns presents a formidable task, demanding a nuanced approach that ensures compliance with international standards while safeguarding domestic stability and security.

Abstract

The transformation of international criminal justice principles into Indonesia's national criminal justice system reflects the country's commitment to aligning domestic law with global human rights and accountability standards. Indonesia, as a member of the international community, has progressively incorporated international norms and principles into its legal framework, particularly in response to the rise of international crimes such as genocide, war crimes, and crimes against humanity. The adoption of these global values in domestic law requires a nuanced approach, as Indonesia navigates its national sovereignty, cultural context, and legal traditions while integrating the broader principles of international justice. The study examines the mechanisms through which Indonesia has absorbed international criminal justice norms, focusing on key developments such as the ratification of the Rome Statute of the International Criminal Court (ICC) and the establishment of domestic legal provisions for addressing crimes under international law. It also evaluates the challenges Indonesia faces in harmonizing its criminal justice system with international standards, such as issues related to jurisdiction, the independence of the judiciary, and the political will to prosecute international crimes effectively. This paper analyzes the legal reforms in Indonesia’s national criminal justice system, exploring both the successes and limitations of these efforts. It highlights the role of international treaties, national legislation, and judicial practice in shaping a more comprehensive and fair criminal justice system. Moreover, the research emphasizes the importance of fostering international cooperation and strengthening domestic institutions to ensure the effective implementation of global principles. Ultimately, this study underscores the dynamic interaction between domestic law and international criminal justice, emphasizing the need for continuous adaptation to uphold global human rights values in a national context.

This research found and highlighted that the execution of the court’s decision on the status of the evidence carried out by the Prosecutor after the adjudicator's decision has been signed. There are four factors that influence the level of effectiveness of the Prosecutor as the executor of court decisions with regard to evidence, including the legal factor itself, the community factor, the law enforcement officer factor, as well as the legal facilities and facilities factor. Various regulations have been drafted, however, none of them have explicitly regulated the threat of sanctions for prosecutors who do not immediately carry out executions, lack of coordination between related parties, and limited legal facilities and facilities are factors that affect the effectiveness of prosecutors in carrying out their duties.

Nuclear weapons can become weapons of mass destruction which of course threaten the stability of international security. As one of the nuclear-armed countries, North Korea is modernizing the country by focusing its strength on the planning economy, heavy industry, and military development. Abstract

Saudi Arabia's intervention in the internal conflict in Yemen has been the focus of attention due to its significant humanitarian and political implications. The continuation of this conflict has raised the need for an objective evaluation of the role played by Saudi Arabia, especially the extent to which it complies with United Nations (UN) rules and regulations. The conflict in Yemen has created profound humanitarian impacts, including starvation and the suffering of countless people. Therefore, this essay aims to conduct a thorough analysis of Saudi Arabia's intervention in Yemen with a particular focus on the legality and effectiveness of their actions. By examining Saudi Arabia's level of compliance with international law, especially the norms upheld by the UN, we can better understand whether their actions are in line with prevailing international norms. In addition, the impact of this intervention on the Yemeni population as a whole will also be explored. This comprehensive analysis is expected to provide an in-depth understanding of Saudi Arabia's contribution to the Yemen conflict, both in terms of its legality and humanitarian impact. In this way, we can develop a balanced and rational view of Saudi Arabia's role in the context of the protracted conflict in Yemen.
