Abstract

Law colleges are educational institutions that have a crucial role in shaping human resources who are ready to become law enforcers by prioritizing integrity, and being able to adapt to technology. This is in line with the world that is facing an era where there is a massive change taking place very quickly in various sectors which is called the era of disruption. One of the sectors experiencing the impact of the era of disruption is technology. The era of technological disruption certainly brings its own challenges and opportunities for various elements, one of which is law universities. In terms of challenges, in the era of technological disruption, law colleges as educational institutions must be able to prepare their students to be technology literate so that later when they graduate, they can compete in the global world of work. The era of technological disruption besides bringing challenges, of course also brings opportunities if it can be utilized to the maximum extent possible by the university, one of which is by utilizing digital technology with artificial intelligence (AI) to change teaching and learning procedures with innovations that can make it easier for students. This study aims to answer 2 problem formulations, namely: 1). How is the Law College as an educational institution that can produce law graduates with integrity and Pancasila character?, and 2).How is the strategy of law universities in preparing prospective law enforcement officers in the era of technological disruption?. This study uses the Statute Approach and Case Approach in providing an overview of law colleges as educational institutions in facing the era of technological disruption.

Abstract

The existence of law universities is very essential in producing law graduates who are expected to be able to become professional law enforcement officers. This is because the law college is the only educational institution that provides legal education both holistically and integrally. It is hoped that law graduates produced by law universities will be able to fill professional positions that are only carried out by professional law graduates such as prosecutors, advocates, curators, judges, and notaries. In reality, the goal of law colleges in producing professional law graduates has not been fully realized. There are still law graduates who are printed by law colleges who are considered to have failed to become professional law enforcers. In recent years, many law enforcers have doubted their integrity. Legal universities are responsible for producing law graduates with an image and integrity based on Pancasila. In addition to integrity issues, law universities are also required to encourage the development of national law in the era of information technology. Given, the process of development of the times is certainly unavoidable. This study aims to answer two problem formulations, namely: how are law universities as printers of professional and integrity law graduates based on Pancasila both in the education system and practice?; and, what is the role of law universities in the development of national law in the era of information technology? This paper uses a juridical-normative approach in providing an overview of law universities in producing law graduates with integrity in the era of information technology.

Abstract

Perlawanan pihak ketiga (derden verzet) sebagai upaya hukum luar biasa yang diberikan kepada pihak di luar perkara yang merasa dirugikan haknya oleh pelaksanaan eksekusi Pengadilan, dalam sistem peradilan perdata di Indonesia masih merupakan sarana yang diakui untuk memberikan perlindungan bagi pihak ketiga yang bertugas sebagai penentang sejati penangguhan eksekusi. Penulis melakukan penelitian terhadap Putusan Nomor 118/Pdt.G/2020/PA.Kds Pengadilan Agama Kudus tentang derden verzet terkait sita eksekusi. Penelitian ini bertujuan untuk mengetahui alasan terjadinya perlawanan, mengetahui putusan hakim dalam menolak perlawanan dan mengetahui perlindungan hukum yang diberikan bagi pemenang lelang dengan adanya perlawanan pihak ketiga. Penulis mengkaji kasus ini dengan menggunakan metode penelitian yuridis-sosiologis. Berdasarkan penelitian Penulis memperoleh hasil bahwa Majelis Hakim menerima sebagian gugatan dan menangguhkan sebagian dengan pertimbangan bahwa pihak lawan merupakan pihak lawan yang tepat, akan tetapi dalam perkara ini pihak lawan I yang menyita jaminan yang sebelumnya telah menjual tanah tersebut kepada pihak lawan oleh Pihak Lawan II dan hal tersebut tidak diketahui oleh Pelawan.

Abstract

This paper examines the concept of ecological justice within the framework of Pancasila, the philosophical foundation of the Indonesian state. While Pancasila emphasizes socio-cultural harmony and collective welfare, its application to ecological issues poses significant challenges. This analysis delves into the complexities of achieving ecological justice within the Pancasila framework, identifying key problems and challenges. Beginning with an exploration of Pancasila's core principles, the paper highlights its emphasis on social justice, democracy, and collective responsibility. It then discusses the intersection between Pancasila and environmental concerns, emphasizing the need for ecological justice to address issues such as environmental degradation, biodiversity loss, and climate change. Drawing on case studies and theoretical perspectives, the paper identifies several challenges in applying Pancasila to ecological justice. These challenges include reconciling traditional values with modern environmental imperatives, balancing economic development with environmental sustainability, and addressing power disparities in environmental decision-making. Furthermore, the paper examines the role of governance structures, policy frameworks, and civil society in promoting ecological justice within the Pancasila framework. It discusses potential pathways for integrating environmental considerations into Pancasila-based policies and practices. Through this analysis, the paper contributes to the discourse on ecological justice by exploring its intersection with indigenous philosophical frameworks like Pancasila. It underscores the importance of incorporating environmental concerns into Pancasila-based governance to ensure a more sustainable and equitable future for Indonesia and beyond.

Abstract

This research was conducted on corporate criminal liability arrangements in Indonesian legislation, with the long-term goal of harmonization of corporate criminal liability arrangements, so as to realize certainty, expediency and legal justice in law enforcement in Indonesia. To support the realization of harmonization in corporate criminal liability arrangements in the legislation, it is necessary to review corporate criminal liability arrangements in other countries, both those with the same legal system as Indonesia and with countries with a common law system, namely Australia. The research method used to achieve the research goals and targets is normative legal research with a statutory, and comparative approach method. The projected results of this study are in the form of real data on the implementation of corporate penal regulations for the National Legal System. The output of this research is in the form of published articles in accredited national journals

Abstract

This paper discusses the legal development policy in the Government's Procurement of Goods and Services and to reveal the legal development sector in the regulation as well as a comparison of the Government's Procurement of Goods and Services policy between Indonesia and the Philippines. The method used in this paper is normative juridical with a statutory study approach (statue apporouch). The results of this study indicate that the direction of the government's procurement of goods and services policy is the achievement of the output and outcome of government agencies, economic improvement for both business actors and the community through economic equity and sustainable development, as well as comparisons related to government procurement of goods and services in Indonesia during the New Order era with integrity. The State Budget, however, is entering the decentralized Reform period and there are new regulations in the Government's Procurement of Goods and Services with the formation of an auction committee at each Office/Work Unit/Project Leader/Project Section. In the Philippines, it is formed in the Government Procurement Reform Act which is the basis for the regulation of Government Procurement of Goods and Services in the Philippines.

Abstract

Pemindahan Ibu Kota Negara (selanjutnya disingkat IKN) Republik Indonesia berpengaruh terhadap seluruh aspek kehidupan masyarakat adat di wilayah IKN Nusantara, khususnya bidang pertanahan. Tujuan dari penelitian ini adalah menelaah bagaimana implikasi pembangunan IKN Nusantara terhadap bidang tanah masyarakat hukum adat serta bagaimana solusi efektif dalam melindungi hak masyarakat hukum adat. Pembahasan karya tulis ini, yaitu mengenai implikasi dan tantangan yang akan dihadapi masyarakat hukum adat terhadap pembangunan IKN Nusantara dan upaya perlindungan hukum preventif terhadap masyarakat hukum adat di wilayah IKN Nusantara. Metode penelitian yang digunakan adalah yuridis normatif dengan teknik pengumpulan data melalui studi kepustakaan. Bahan yang dikumpulkan berupa bahan hukum primer dan bahan hukum sekunder. Adapun simpulan berdasarkan jabaran pembahasan adalah masyarakat hukum adat di wilayah IKN mempunyai problematika setifikat tanah, permasalahan degradasi pemilikan tanah, konsensi tanah, dan kebijakan yang saling tumpang tindih. Perlindungan hukum preventif yang dilakukan, yaitu mempertahankan living law, menerbitkan aturan Rencana Tata Ruang, dan mengadakan pendaftaran tanah bagi masyarakat yang belum memiliki sertifikat. Adapun rekomendasi yang ditawarkan adalah perlu dimasukkan muatan mekanisme pengadaan tanah masyarakat adat di wilayah IKN Nusantara dalam aturan mengenai Rencana Tata Ruang Kawasan Strategis Nasional dan diwujudkan dalam bentuk Perpres serta menghormati living law yang selama ini masih dipegang oleh masyarakat hukum adat.

Abstract

This research focuses on the development of competition law in Indonesia, specifically examining the role and impact of Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition, also known as the Business Competition Law. The objective of this research is to provide an overview of the various changes in business competition law in Indonesia, particularly the establishment of the Business Competition Supervisory Commission (KPPU), responsible for enforcing the law against business competition violations committed by companies or individuals. Additionally, this article will compare Indonesian competition law with that of other countries, such as Australia and Singapore. The research adopts two main methods: a statute approach and a comparative approach. The statute approach involves analyzing three statutory regulations: Law No. 5 of 1999 (Indonesia), Australia Competition and Consumer Amendment Act 2013 (Australia), and Singapore Competition Act 2004 (Singapore). The findings of this study reveal two key weaknesses in Indonesia's Business Competition Law. First, there are deficiencies in both the material and formal aspects of determining prohibitions per se or employing the rule of reason theory. Secondly, there are concerns related to the definition of dominant market positions, necessitating a review of the Business Competition Law to align it with best practices. Additionally, there are issues regarding the neutrality of KPPU as a Quasi-Judicial institution, and the need to safeguard the rights of the reported parties during the judicial process at KPPU. Furthermore, a legal comparison with Australia and Singapore highlights that Indonesia's Business Competition Law lags behind in several areas, resulting in a legal vacuum concerning Mergers and Acquisitions Regulations, Horizontal and Vertical Agreements, Dispute Resolution, and Consumer Protection. In conclusion, this research emphasizes the significance of robust competition laws in promoting fair business competition, economic growth, and foreign investment. It sheds light on the weaknesses of Indonesia's current Business Competition Law and suggests potential areas for improvement based on a comparison with competition laws in Australia and Singapore. Addressing these issues would strengthen Indonesia's competitive landscape and foster a more conducive business environment.

Abstract

Social transformation focusing on youth through Pancasila-based legal education has been implemented in Desa Kenteng using the Street Law model. This study aims to evaluate the effectiveness of this model in strengthening nationalism and national awareness among village youth. The Street Law method, which integrates Pancasila principles with legal theory and practice, is designed to enhance legal understanding while instilling national values in a local context. The results of the program indicate a significant increase in legal knowledge, with basic legal understanding rising from 30% to 75% after six months. Additionally, there was a substantial increase in nationalism and awareness of Pancasila values, from 40% to 85%, and a rise in social participation from 20% to 60% among village youth. Despite these positive outcomes, challenges such as uncertainty in practical legal application and the need for ongoing support from government and local legal institutions remain. This study recommends integrating national values into legal education policies and adapting program models to local contexts to ensure broader and sustainable impact in other regions.

Abstract

The semiconductor industry plays an important role in the development of global technology, so the need for intellectual property rights protection for Integrated Circuit Layout Design (ICLD) is important. In Indonesia, regulations regarding ICLD still have weak protection for designers. This affects the low number of DTLST registration applications. Meanwhile, in Japan, the regulation of DTLST has mature and structured protection regulations for designers and business actors. This study uses a normative legal research method with a comparative approach and a statutory approach. The results of this study indicate that the DTLST Regulations in Indonesia and Japan have several similarities. However, there are differences between them; Definition of DTLST, Exclusive and Non-Exclusive Exploitation Rights, Reserve Engineering, Compensation Rights Regulations, Regulation of Institutional/Legal Entity Registration. DTLST is very important in the semiconductor industry, especially for IC Chips used in various electronic devices. Large investments in DTLST research and development drive innovation and efficiency in IC Chip production. Japan, with strict regulations and strong government support, has succeeded in increasing its semiconductor market. Japan's DTLST Law protects IPR through comprehensive regulations, in contrast to Indonesia which still faces weaknesses in Law No. 32 of 2000. The lack of substantive examination and understanding of technology in Indonesia hampers the effectiveness of legal protection. Based on this, it can be concluded that the regulation on DTLST in Indonesia still has several weaknesses and can seek to revise Law No. 32 of 2000 by transplanting laws from Japan with adjustments to Indonesia's national interests. Indonesia should strengthen legal protection of intellectual property rights for DTLST designers and business actors in the semiconductor industry.
