Abstract

Hoax  adalah berita bohong atau berita tidak bersumber. Hoax adalah adalah informasi yang sesungguhnya tidak benar, tetapi dibuat seolah-olah benar adanya. Hoax bertujuan membuat opini publik yang disampaikan melalui informasi media cetak maupun media elektronik, diera globalisi seperti media sosial merupakan sarana pengakses berita termudah, dengan kebebasan akses internet penyebaran berita cenderung tidak terbatas namun juga tidak dapat disaring kebenarannya. Maka inilah yang menjadi dasar permasalahan yang penulis tuangkan dalam rumusan masalah yaitu : Bagaimana peranan kepolisian dalam mencegah tindak pidana penyebaran berita bohong (hoax).? Dan Bagaimanakah penyebaran berita bohong di kota Makassar. Penelitian yang dilakukan dalam penelitian ini ialah Penelitian Kualitatif. Yang dilaksanakan dengan cara mengumpulkan sejumlah data malalui wawancara langsung terhadap masyarakat setempat meliputi bahan pustaka yang bersumber dari buku-buku, serta inventarisasi peraturan-peraturan yang berkaitan dengan penyebaran berita (hoax). Peranan kepolisian dalam mencegah tindak pidana penyebaran berita bohong (hoax) salah satunya  membentuk tim pengawasan yang ciber hoax, yang kerap melakukan patrol di media sosial, kemudian mengonfirmasi kebenaran dibalik berita bohong tersebut dan memberi sanksi kepada para pembuat maupun penyebar berita bohong.

Abstract

This study aims to determine, first how the application of sanctions for people who violate the provisions of the legislation on the regulation of the mayor of Makassar in handling the covid 19 outbreak in Makassar. Second, the extent of the impact caused by the implementation of legislative provisions in handling the Covid 19 outbreak in terms of legal sociology. This research is Library research with research approach using Socio Legal Approach method.The results of this study indicate that the application of sanctions for people who violate the regulations of the mayor of Makassar in handling the Covid 19 outbreak implemented by the Makassar city government has almost completely run effectively, evidenced by the implementation of the justisi operation by the joint TNI-POLRI apparatus where every violator of health protocols is immediately sanctioned at the, penalties fines, as well as administrative sanctions.

Abstract

Permasalahan terkait rangkap jabatan bukanlah hal baru dan menjadi masalah karena melanggar peraturan perundang-undangan, terutama UU ASN, UU TNI, dan UU Polri. Oleh karena itu, terkait dengan kasus tersebut, penelitian ini dilakukan untuk meninjau pertimbangan diangkatnya ASN, TNI, dan Polri sebagai komisaris di BUMN dan meninjau akibat hukum yang timbul dari diangkatnya ASN, TNI, dan Polri menjadi komisaris di BUMN. Penelitian ini bersifat hukum normatif (library research) dengan menggunakan pendekatan perundang-undangan (statute approach) dan disajikan dalam bentuk analisis deskriptif. Hasil penelitian menunjukkan bahwa pertimbangan diangkatnya ASN, TNI, dan Polri sebagai komisaris di BUMN didasarkan pada tidak adanya aturan yang secara eksplisit melarang, sehingga dianggap dapat menjadi penyeimbang bagi BUMN. Namun, akibat hukum dari diangkatnya ASN, TNI, dan Polri sebagai Komisaris di BUMN, sesuai dengan peraturan yang dilanggar, mengharuskan pihak terkait untuk diberhentikan atau mengundurkan diri dari jabatannya.

Abstract

This study aims to evaluate the effectiveness of the Ombudsman in handling cases of maladministration in the midst of the Covid-19 pandemic and identify obstacles and efforts in the handling process. Through a qualitative approach with primary and secondary data sources, the results showed that the effectiveness of handling maladministration by the Ombudsman of the Republic of Indonesia representing South Sulawesi decreased during the pandemic. This was due to the adoption of the Work from Home Policy and the implementation of the PSBB, which resulted in delays in the completion of the report. The Ombudsman took steps such as requesting written clarification from the reported Party and opening a Covid-19 complaint post in an effort to make it easier for the public to report suspected maladministration without having to interact directly to prevent transmission of the virus.

Abstract

The aim of this research is to identify the elements of criminal acts and sanction threats associated with using smartphones while driving, as well as the underlying reasons. This study uses a case approach, which is a normative legal research method that builds legal arguments based on concrete cases. The research is a bibliographic study with a normative juridical qualitative method that refers to legal norms in statutory regulations. Using smartphones while driving violates Law No. 22 of 2009 concerning Road Traffic and Transportation, with a maximum fine of Rp. 750,000.00, which may be reduced in court. The main reasons are urgent calls from family or work and the need for GPS navigation. It is expected that the government will establish clearer guidelines for using GPS on smartphones to ensure driver safety and support jobs like online motorcycle taxis. Law enforcers should educate drivers about the penalties for violations.
