Abstract

Progressive Law emerged from Satjipto Rahardjo's idea of ​​seeing the worrying reality of law enforcement in Indonesia. The law tends to favor the strong and oppress the weak, sharp downwards but dull upwards. This article discusses the importance of having behavior based on Progressive Law in law enforcement. The method used in writing this article is a normative legal research method with a conceptual approach. The results of this research are that law enforcement that improves the welfare of the people in the style of Progressive Law will be formed if law enforcement officers have progressive law enforcement behavior. The meaning of progressive behavior is law enforcement that is sensitive to the realization of the values ​​of justice, and is not confined solely to the formulation of the text of the law. Such law enforcement will create justice, benefit and welfare for society.

Abstract

Recent high-profile criminal cases in Indonesia have exposed significant gaps between the formal guarantee of the presumption of innocence and its practical application. This study aims to critically examine the “illusion” of the presumption of innocence in the criminal justice system, highlighting how public opinion and media coverage undermine this fundamental principle. The research adopts a hermeneutic approach, emphasizing interpretative analysis of legal texts, court decisions, and media representations to explore the dynamic interplay between normative law and social reality. Findings reveal that, despite its codification in the Indonesian Criminal Procedure Code, the presumption of innocence is frequently compromised in practice: suspects are often treated as guilty prior to judicial determination, influenced by sensationalist reporting and societal pressure. This discrepancy generates a gap between the formal text of the law and its lived reality, producing a sense of procedural injustice and eroding public trust in the judiciary. The study concludes that the presumption of innocence in Indonesia functions more as a normative ideal than an operational reality, particularly in cases that attract widespread media attention. Hermeneutic analysis demonstrates that restoring the principle’s substantive meaning requires a contextual understanding of law as both a normative and social phenomenon, alongside heightened awareness among legal practitioners, media actors, and the public regarding the ethical and procedural obligations inherent in criminal adjudication. The study underscores the necessity of integrating interpretive, human-centered approaches within legal practice to reconcile law’s formal prescriptions with societal realities and to strengthen the operational effectiveness of fundamental procedural rights.

Abstract

AbstractThe transformation of environmental law requires a shift from an anthropocentric to an ecocentric approach that recognizes ecology as a legal subject rather than a mere object of exploitation. Weak environmental protection in Indonesia is largely rooted in the objectification of nature within the prevailing legal framework, contributing to escalating ecological degradation. Using a normative legal research method with conceptual and philosophical approaches, this study examines the juridical foundations and feasibility of recognizing ecology as a legal subject in the Indonesian legal system. The findings demonstrate that granting legal personality to ecological entities can strengthen environmental protection by expanding legal standing, redefining legal responsibility, and reinforcing sustainability-oriented norms. The novelty of this study lies in its formulation of ecology as a juridical subject within a reconstructive framework of Indonesian positive law, rather than merely as a moral or rights-based discourse commonly found in ecocentric or rights-of-nature studies. This study concludes that such legal reconstruction is essential to advancing ecological justice and improving the effectiveness of environmental protection in Indonesia.AbstrakTransformasi hukum lingkungan menuntut pergeseran dari pendekatan antroposentris menuju ekosentris, yang mengakui ekologi sebagai subjek hukum dan bukan semata-mata objek eksploitasi. Lemahnya perlindungan lingkungan hidup di Indonesia terutama berakar pada pemaknaan alam sebagai objek dalam kerangka hukum yang berlaku, sehingga berkontribusi pada meningkatnya degradasi ekologis. Dengan menggunakan metode penelitian hukum normatif melalui pendekatan konseptual dan filosofis, penelitian ini mengkaji landasan yuridis serta kemungkinan penerapan pengakuan ekologi sebagai subjek hukum dalam sistem hukum Indonesia. Hasil penelitian menunjukkan bahwa pemberian kepribadian hukum kepada entitas ekologis dapat memperkuat perlindungan lingkungan hidup melalui perluasan legal standing, redefinisi tanggung jawab hukum, serta penguatan norma berorientasi keberlanjutan. Kebaruan penelitian ini terletak pada perumusan ekologi sebagai subjek hukum yuridis dalam kerangka rekonstruksi hukum positif Indonesia, bukan sekadar sebagai wacana moral atau hak alam sebagaimana lazim ditemukan dalam kajian ekosentrisme. Penelitian ini menyimpulkan bahwa rekonstruksi hukum tersebut merupakan langkah esensial untuk mewujudkan keadilan ekologis dan meningkatkan efektivitas perlindungan lingkungan hidup di Indonesia.

Abstract

The Trial Process at the Surakarta District Court and the Execution of Fines for Traffic Violations by the Surakarta District Attorney can be described as follows: to receive payment of ticket fines by the convict who has obtained a decision from the District Court Judge where the trial of this traffic violation case is taking place. The Public Prosecutor was not present directly in the trial process because in principle the trial of this traffic violation case was a minor crime case and the proceedings were fast, and was only attended by a single judge, clerk/substitution clerk and the accused. After the convict receives a verdict from the court judge, he then pays a ticket fine and court costs in accordance with the judge's decision. For the special treasurer of the recipient/depositor, after receiving the Minutes of Submission of Fines and Case Fees and also containing an Order for Submission of Fines/Replacement Fines/and an amount of money for fines and case fees for traffic violations, this then deposits it in the designated state treasury, namely the Office of PT. POS INDONESIA Branch Surakarta or Bank BRI. Furthermore, the special treasurer who receives money for traffic violations and case fees for traffic violations makes a report in the form of a Non-Tax Deposit Letter (SSBP) as proof that the handling of traffic violation cases and all fine money for fines and case fees have been deposited to the state treasury.Keyword: Execution, Fines, Traffic Violations

Abstract

This article analyzes the application of restorative justice before the trial based on the study of decision number 63/Pid. B/2021/PN Skm. The purpose of this article is to find out the basic considerations of judges in deciding cases with the application of retorative justice as an alternative solution to crime based on the study of decision number 63/Pid. B/2021/PN Skm. This article is a normative legal research with a prescriptive nature and uses primary legal materials and secondary legal materials. The technique for collecting legal materials is to use a literature study with a case approach. The analysis technique used is the syllogism method using a deductive mindset. The results of the study show that restorative justice has been implemented during the trial examination. The Suka Makmue district court judge’s decision has an element of legal certainty by implementing and adhering to legal values and a sense of justice that lives in society. The judge's decision also reflects a sense of justice and expediency, it is said that because all parties involved, both the accused, the victim, and the community can feel a sense of peace as in the same as condition before which is like the principle emphasized by restorative justice, by prioritizing the recovery of victims, the accused and the public.Keywords : Basic Considerations of the Judges; Restorative Justice; The crime of presecution
