Kasus korupsi terus mengalami peningkatan dari waktu ke waktu di Indonesia. Korupsi yang terjadi tidak hanya berdampak terhadap kerugian bagi keuangan negara, akan tetapi juga menghambat pembangunan serta kesejahteraan masyarakat. Melihat dampak korupsi yang begitu besar, tidaklah berlebihan jika korupsi disebut sebagai kejahatan luar biasa. Penanganan terhadap kejahatan luar biasa ini memerlukan upaya yang luar biasa pula. Upaya luar biasa yang dimaksud adalah tidak lagi memfokuskan pemberantasan korupsi pada pemidanaan terhadap koruptor, akan tetapi dengan mengejar dan menyita aset-aset ilegal hasil korupsi.

Perkembangan kecerdasan buatan (AI) yang pesat menimbulkan tantangan baru dalam sistem hukum pidana, terutama terkait dengan statusnya sebagai subjek hukum dan aspek pertanggungjawaban pidana. Saat ini, hukum pidana Indonesia, termasuk dalam KUHP Baru (UU No. 1 Tahun 2023), belum mengakomodasi AI sebagai subjek hukum. Hal ini menimbulkan pertanyaan mengenai bagaimana mempertanggungjawabkan tindak pidana yang melibatkan AI, baik sebagai alat maupun sebagai pelaku utama. Penelitian ini bertujuan untuk menganalisis konsep subjek hukum dan kemungkinan atribusi pertanggungjawaban pidana terhadap AI dalam sistem hukum Indonesia. Metode penelitian yang digunakan adalah pendekatan normatif dengan analisis terhadap peraturan perundang-undangan, doktrin hukum, serta praktik di beberapa negara yang telah mengakui AI dalam sistem hukumnya. Hasil penelitian menunjukkan bahwa beberapa negara telah mulai memasukkan AI dalam kategori subjek hukum, baik secara langsung maupun melalui konsep tanggung jawab perantara. Di Indonesia, belum terdapat regulasi yang mengatur secara khusus AI dalam hukum pidana, sehingga masih terdapat kekosongan hukum dalam aspek pertanggungjawaban pidana AI.

Corruption poses a persistent threat to the foundations of good governance and public integrity. One of the common modes used in corruption practices is trading in influence and gratification. Trading in influence occurs when a person leverages their influence over a public official to obtain certain benefits; unlike bribery, the object of trading in influence is influence itself, not direct authority. Meanwhile, gratification encompasses all forms of gifts or benefits that may affect the independence of officials in making decisions. Both practices have the potential to undermine bureaucratic systems and diminish public trust in the government. This study aims to analyze the correlation between trading in influence and gratification as forms of corruption, as well as to review their impact and implications on the legal and governmental system. The research method used is a normative juridical approach, analyzing relevant legislation and case studies of corruption incidents involving these two practices. The results show that trading in influence and gratification often serve as the entry points for more severe corruption practices. In this context, Article 18 of the UNCAC provides an important conceptual basis for the development of national legal norms to specifically define and address trading in influence. Therefore, there is a need for stronger regulations and more effective law enforcement to prevent and combat these practices

The increasing frequency and scale of environmental destruction in Indonesia, such as deforestation, mining disasters, and pollution of vital ecosystems, reveal the inadequacy of existing environmental criminal law to address crimes with transboundary and long-term ecological impacts. While Indonesian law recognizes environmental violations, it does not yet criminalize ecocide—a grave act of environmental harm—either as an extraordinary crime or as an international offense. This paper aims to explore the urgency of incorporating ecocide as a distinct criminal category in Indonesia’s legal system by analyzing the legal gaps and limitations in current legislation, particularly Law No. 32 of 2009 on Environmental Protection and Management. Employing a normative juridical method with a comparative legal approach, the study examines developments in countries such as Belgium and France that have begun codifying ecocide, as well as international efforts to include ecocide under the Rome Statute. The research finds that the absence of ecocide in Indonesian criminal law limits the state’s ability to deter and prosecute large-scale environmental crimes effectively. It concludes that the criminalization of ecocide, both nationally and as part of global legal harmonization, is crucial to achieving ecological justice and long-term environmental protection in Indonesia.

This study aims to explore the concept of judicial lawmaking within the framework of progressive jurisprudence, which emphasizes the dynamic application of law that is responsive to social change and the pursuit of substantive justice. Judicial lawmaking often becomes necessary when legal issues arise that are not sufficiently addressed by existing statutes or case law. In the context of progressive jurisprudence, judges are expected to go beyond mechanical application of legal provisions and to interpret the law in a manner that reflects evolving societal values. This research employs a normative legal methodology, using a doctrinal and interpretative approach to analyze judicial decisions that exemplify progressive legal reasoning. Key rulings in cases concerning human rights, environmental law, and social justice are examined to uncover the progressive legal principles articulated by judges. The findings suggest that in certain instances, judges have successfully exercised judicial creativity, interpreting the law in a way that provides equitable and contextually relevant solutions, even when these decisions diverge from the literal text of the law. Judicial lawmaking in the progressive jurisprudential framework highlights that the law is not a static system but one that is adaptive, evolving, and aimed at ensuring substantive justice.

Legal reasoning in Indonesia often faces challenges in achieving substantive justice due to rigid and textual interpretations of the law. Progressive law, introduced by Satjipto Rahardjo, offers a more dynamic and humanistic legal approach, emphasizing law as a tool for social change rather than merely a set of normative rules. This perspective is particularly relevant in addressing contemporary legal issues in Indonesia, where formalistic legal interpretations sometimes fail to deliver justice. This study aims to analyze the relevance of progressive law in shaping legal reasoning in Indonesia. It seeks to explore how the principles of progressive law can contribute to a more responsive and justice-oriented legal system. This study employs a normative legal research method with a conceptual approach. It examines primary and secondary legal sources, including legal doctrines, jurisprudence, and relevant literature, to understand the theoretical and practical implications of progressive law in Indonesian legal reasoning. The study finds that progressive law provides a necessary paradigm shift in Indonesian legal reasoning by encouraging judges and legal practitioners to go beyond rigid legal texts and consider social realities. It highlights that legal reasoning based on progressive law can bridge the gap between law in books and law in action, fostering legal decisions that better reflect societal needs and justice. However, challenges remain in its application, particularly in balancing legal certainty and judicial discretion. The incorporation of progressive law principles in legal reasoning can enhance the Indonesian legal system’s responsiveness to societal dynamics. Further research and judicial training are needed to optimize its implementation for a more just legal order.

Introduction: The ethical dilemma that arises due to the integration of artificial intelligence into legal services through the emergence of robot lawyers.Purposes of the Research: The purpose of this article is to examine the ethical implications of robot lawyers and evaluate the adequacy of current legal professional standards in addressing challenges posed by artificial intelligence in legal practice.Methods of the Research: This study uses normative legal research with a conceptual and statutory approach, focusing on the analysis of existing legal ethics frameworks and professional responsibility principles to assess their relevance and adequacy in regulating the use of artificial intelligence in legal practice.Results of the Research: The findings of this study show that the emergence of robot lawyers significantly challenges the ethical foundations of the legal profession, particularly concerning competence, confidentiality, independence, and accountability. Current legal ethics frameworks were designed with human practitioners in mind, leaving regulatory gaps when applied to AI-driven legal services. The study highlights the need for a revised ethical paradigm that addresses the limitations of existing rules and accommodates the unique attributes of artificial intelligence. The novelty of this research lies in its critical analysis of the intersection between legal ethics and AI technology, offering a conceptual framework for ethical governance of robot lawyers.

Salah satu point pembaruan yang terdapat dalam Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana adalah berkaitan dengan jenis-jenis sanksi pidana. Pidana mati merupakan jenis sanksi pidana yang mengalami perubahan yang semula merupakan sanksi pidana pokok sebagaimana diatur dalam Pasal 10 KUHP terjemahan WvS ini. Saat ini pidana mati merupakan pidana yang dijatuhkan secara khusus dan bersifat alternatif. Berkaitan dengan regulasi pidana mati saat ini, yang menarik untuk dibahas adalah berkaitan dengan masa percobaan pidana mati selama 10 (sepuluh) tahun. Artikel ini akan menganalisis mengenai masa percobaan pidana mati dikaitkan dengan kepastian hukum. Hasil dari penelitian ini adalah penjatuhan pidana mati dengan masa percobaan merupajan jalan tengah dari pro dan kontra mengenai pidana mati, dan hal yang perlu diperbaiki dalam mekanisme masa tunggu ini adalah batas waktu untuk Presiden dan Mahkamah Agung menentukan keputusan untuk perubahan dari pidana mati ke pidana seumur hidup.

The unfinished discussion regarding progressive law is the subject of progressive law. Progressive law pays attention to the human aspects of judging and providing protection for entities that are "those who are weak" and need protection. Ecology is included in entities that require protection, so it has the potential to be conceptualized as a progressive legal subject. This article will analyze the potential of ecology as a subject of progressive law associated with the realization of inter-generational justice. The research method used in writing this article is a normative legal research method with a conceptual approach. The results of the analysis in this article show that ecology can be conceptualized as a progressive legal subject and in accordance with the embodiment of intergenerational justice. Ecology is not only needed by this generation but also needed by future generations.

Abstract: Legal construction in Indonesia, which is largely influenced by the influence of the Continental European legal system, the Dutch heritage is identical with the nuances of legal positivism. The flow of legal positivism is in legal modernism, which is included in the form of written rules. The development of human civilization in modern times is so fast and gives birth to a modern digital civilization. The power of legal positivism is strong enough to solve legal problems that develop following the civilization of its people. The new paradigm that can be a solution to problems in this digital era is the post-modernism paradigm. Post-modernism opens up opportunities for diversity in the meaning of law. Rigid written law can be interpreted more flexibly with the context, so that within the framework of that meaning it becomes more flexible in solving problems that occur in society.Keywords: Modernism, Post-Modernism, Digital Era.Â
