Abstract

Seiring dengan lajunya pertumbuhan penduduk yang sedemikian besar dan luas tanah yang relatif tidak bertambah, sehingga menyebabkan tanah dan berbagai masalah Agraria yang timbul Pendaftaran atas suatu tanah merupakan hal yang harus dilakukan oleh siapa saja yang melakukan transaksi jual beli, sewa menyewa maupun lain sebagainya. Pendaftaran atas tanah harus dilakukan sesuai dengan prosedur sebagaimana yang telah di tetapkan dalam peraturan perundang-undangan pokok Agraria Nomor 5 Tahun 1960. Di Kecamatan Beruntung Baru, Kabupaten Banjar sebagian warganya belum memahami pentingnya pendaftaran kepemilikan sertifikat tanah salah satu contohnya yaitu terjadinya Sengketa Tanah di Desa Handil Purai. Hal ini disebabkan oleh minimnya pengetahuan hukum masyarakat mengenai pendaftaran tanah dalam perlindungan kepemilikan sertifikat tanah. Menggunakan metode pendekatan-pendekatan sosial yuridis (socio-legal) dan menggunakan pendekatan interdisipliner atau “hibrida” antara aspek penelitian normatif dengan pendekatan sosiologis dan menggunakan analisis kualitatif, yakni dengan menganalisis suatu data secara mendalam dan holistik. Maka nantinya yang diharapkan dari kegiatan ini adalah Pemahaman mengenai Urgensi Terhadap Pendaftaran Tanah dalam Perlindungan Hukum Kepemilikan Sertifikat Tanah di Desa Handil Purai.

Abstract

The existence of the State of Indonesia as an Agrarian State has been mandated in the Constitution of the Republic of Indonesia which gives the State the responsibility to guarantee the right to food as the right to food security and sovereignty. The State's obligation to maintain food security is faced with the challenge of meeting increasing food needs, and especially due to the increasingly rapid increase in population, it is necessary to make efforts to prevent land degradation, with the enactment of Law Number 41 of 2009 concerning the Protection of Sustainable Food Agricultural Land. In the Explanation of Law Number 41 of 2009 it is stated that the conversion of agricultural land is a threat to the achievement of food security and sovereignty. The purpose of this PKM is to provide knowledge, understanding and legal awareness to the community about the legal aspects of Sustainable Food Agricultural Land Protection. The method used is the Presentation Method with the concept of partnering with the Babirik village office and presenting several community leaders interactively with the community to understand the importance of legal protection for Sustainable Food Agricultural Land. The results of the implementation of the activity are that the community understands the legal basis for the Protection of Sustainable Food Agricultural Land in the Babirik Village area, namely Law Number 41 of 2009 concerning the Protection of Sustainable Food Agricultural Land and Banjar Regency Regional Regulation Number 9 of 2012 concerning the Protection of Sustainable Food Agricultural Land which stipulates agricultural land that must be protected, including monitoring mechanisms and sanctions for violations. The conclusion of this Activity has succeeded in helping the community understand the various incentives available to support agricultural activities, as well as the importance of complying with provisions regarding land conversion to prevent violations of the law. Eksistensi Negara Indonesia sebagai Negara Agraris telah dimanatkan dalam Konstitusi Negara Republik Indonesia yang memberikan tanggung jawab kepada Negara untuk menjamin hak atas pangan sebagai hak ketahanan dan kedaulatan pangan. Kewajiban Negara dalam menjaga ketahanan pangan dihadapkan pada tantangan pemenuhan kebutuhan pangan yang semakin meningkat, dan terutama disebabkan oleh peningkatan populasi yang semakin cepat, maka perlu dilakukan upaya pencegahan terjadinya degradasi lahan, dengan ditetapkannya Undang-Undang Nomor 41 Tahun 2009 tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan. Dalam Penjelasan Atas Undang-Undang Nomor 41 Tahun 2009 disebutkan bahwa alih fungsi lahan pertanian merupakan ancaman terhadap pencapaian ketahanan dan kedaulatan pangan. Tujuan dari PKM ini untuk memberikan pengetahuan, pemahaman dan kesadaran hukum kepada masyarakat tentang aspek hukum Perlindungan Lahan Pertanian Pangan Berkelanjutan. Metode yang digunakan adalah Metode Presentasi dengan konsep bermitra dengan kantor desa Babirik dan menghadirkan beberapa tokoh masyarakat secara interaktif bersama masyarakat untuk memahami pentingnya perlindungan hukum atas Lahan Pertanian Pangan Berkelanjutan. Hasil pelaksanaan kegiatan yaitu masyarakat memahami dasar hukum Perlindungan Lahan Pertanian Pangan Berkelanjutan di wilayah Desa Babirik yaitu Undang-Undang Nomor 41 Tahun 2009 tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan dan Peraturan Daerah Kabupaten Banjar Nomor 9 Tahun 2012 tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan yang menetapkan lahan pertanian yang harus dilindungi, termasuk mekanisme pengawasan dan sanksi bagi pelanggaran. Kesimpulan dari Kegiatan ini telah berhasil membantu masyarakat memahami berbagai insentif yang tersedia untuk mendukung kegiatan pertanian, serta pentingnya mematuhi ketentuan mengenai alih fungsi lahan untuk mencegah pelanggaran hukum

Abstract

The problem of plagiarism in the academic environment is currently one of the problems that must be anticipated, technological developments have 2 conflicting impacts on students and lecturers, technology provides openness to all the information needed so that it can produce something positive if used and utilized properly but on the contrary, it will have a negative impact if misused in making scientific works. So that the Role and Legal Responsibility of Thesis Supervisors Against Plagiarism of Students' Final Assignments is deemed necessary to be studied, in this research article raises the formulation of the problem in the form of how the legal responsibility of the thesis supervisor to students who are proven to have committed plagiarism. The research method used is normative legal research, namely legal research that uses secondary data sources or data obtained through library materials in the form of laws and regulations, books or scientific research results. The results of this study are the responsibility of the thesis supervisor for plagiarism of students' final assignments regulated in the Regulation of the Minister of Education, Culture, Research and Technology Number 53 of 2023 concerning Quality Assurance of Higher Education and Law Number 28 of 2014 concerning Copyright. If a student's final assignment is proven to be plagiarized, legally the thesis supervisor is not held responsible. Still, there is an exception if the final assignment is developed into an article published in a scientific journal and includes the supervisor's name. The lecturer has violated academic integrity and must be held legally responsible in the form of administrative, civil and criminal cases.

Abstract

Laut Timor memiliki peran geostrategis yang sangat tinggi bagi negara Indonesia dan Australia. Latihan survey bersama perdana antara kedua negara diberi nama Coordinated Hydrography Survey Exercise (CHSE) diselenggarakan pada tahun 2023. CHSE dilaksanakan dengan menggerakkan kapal riset perang KRI Spica milik TNI-AL Indonesia dan HMS Leeuwin milik Royal Navy Australia, yang masing-masing melakukan survey hidro-oseanografi dan meteorologi di wilayah teritorialnya. Data arus dan angin dari hasil survey kemudian dibandingkan dengan data sekunder Copernicus, sedangkan untuk data angin terhadap prediksi BMKG. Tidak terjadi kemunculan siklon selama kegiatan latihan, Kondisi batimetri di Perairan Laut Timor dalam penelitian ini bervariasi dari kedalaman 16,8 s.d. 218,7meter, dengan luas area sebesar 302NM2. Sirkulasi arus diukur menggunakan underway vessel mounted ADCP hingga kedalaman 40 meter, dengan interval rekaman data bervariasi antara 1 menit sampai 45 menit. Selain itu dipasang pula fix mooring current meter pada satu stasiun tetap. Hasil pengukuran menunjukkan pola sirkulasi arus dominan bergerak antara Timur Laut dan Barat Daya, dengan pola keseragaman secara vertikal. Kecepatan arus maksimum 0,273m/s, dan minimum 0,005m/s ke arah Barat Daya. Hal ini sejalan dengan data klimatologis yang menunjukkan pola arus dominan menuju ke Barat Daya dengan kecepatan 0,1 – 0,5 knot. Pola sirkulasi tersebut menunjukkan bahwa Laut Timor dipengaruhi oleh Indonesian Throughflow (ITF), dengan 30% dari variabilitasnya dipengaruhi oleh siklus musiman dari angin monsoon. Laut Timor, pada lapisan kolom airnya, mendapatkan pengaruh lokal dari gelombang kelvin pada kedalaman di bawah 600 meter, dilapisan yang lebih dangkal, arus dibangkitkan oleh kopling siklus gaya pasang surut diurnal dari Laut Banda, semidiurnal dari Samudera Hindia, dan siklus musiman dari gaya angin monsoon.

Abstract

law Number 5 of 1960 concerning Agrarian Principles has provided a legal basis for both the government in its duties as the implementer of laws and regulations and for individuals or legal entities who wish to obtain legality in the form of land certificates as proof of ownership of a plot of land must carry out the land registration process. The process of issuing land rights must be based on physical data and legal data that can be legally accounted for. An administratively inaccurate certificate is one type of certificate that is problematic due to administrative defects, so an administratively inaccurate certificate can be submitted for cancellation of the certificate by a party who feels that their rights have been harmed due to the issuance of an administratively defective certificate. The formulation of the first problem in this study is How is the legal basis for the cancellation of a certificate of ownership due to administrative defects and how is the legal certainty of the cancellation of a certificate of ownership due to administrative defects. This study uses a Juridical-Normative research type because the problem will be analyzed by reviewing the laws and regulations related to Law Number 5 of 1960 concerning Agrarian Principles, Government Regulation Number 24 of 1997 concerning Land Registration, Government Regulation of the Republic of Indonesia Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases. The results of the study are that the legal provisions as the basis for the cancellation of land rights, namely the Certificate of Ownership Rights, are Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles, Government Regulation No. 24 of 1997 concerning Land Registration, Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Land Registration, Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases and Normatively overlapping regulations on the cancellation of Land Ownership Certificates create legal uncertainty for parties who are harmed due to the issuance or ratification of Land Ownership Certificates that are suspected or known to have administrative data defects such as physical data defects and legal data defects so that there is a need for regulatory codification that provides clear and firm rules regarding the cancellation of Land Ownership Certificates due to administrative defects and there is a need for good system integration in land rights registration as a manifestation of the general principles of good governance and normative sanctions for officials who are involved intentionally knowing that the application for issuance of land ownership certificates has administrative and legal defects but is still issued, normative sanctions regulations function as preventive measures so that officials or government officials do not abuse their authority (abuse of power).
