Abstract

Pembentukan Badan Pelayanan Perizinan Terpadu Satu Pintu (BPPTSP) sebagai institusi yang khusus bertugas memberikan pelayanan perizinan langsung kepada masyarakat, pada dasarnya dapat dikatakan sebagai inovasi manajemen pemerintahan dan upaya yang dilakukan pemerintah untuk meningkatkan kualitas pelayanan publik di daerah. Namun pada kenyataan yang dirasakan pada masa sekarang, masyarakat yang belum terlayani masih lebih besar dibandingkan masyarakat yang sudah terlayani. Kenyataan tersebut disebabkan selain karena faktor geografis juga oleh lemahnya pelayanan oleh petugas baik secara administratif maupun teknis. Begitu pula dengan harga pelayanan. Harga bisa berbeda-beda tergantung pada banyak faktor yang tidak sepenuhnya bisa dikendalikan oleh para pengguna jasa. Baik harga ataupun waktu seringkali tidak bisa terjangkau oleh masyarakat sehingga banyak orang yang kemudian malas berurusan dengan birokrasi publik. Sehingga bagaimana upaya peningkatan pelayanan publik melalui pelayanan perizinan terpadu satu pintu yang dilaksanakan oleh Badan Pelayanan Perizinan Terpadu Satu Pintu (BPPTSP) di Kota Samarinda, dan faktor kendala apa saja yang dihadapi oleh BPPTSP Kota Samarinda. Dengan menggunakan penelitian metode Normatif, penelitian ini bertujuan untuk mengidentifikasi dan menganalisa apa upaya yang dilakukan oleh BPPTSP dan kendala apa saja yang dihadapi oleh BPPTSP tersebut. Karenanya perlu dalam sistem pelayanan perizinan terpadu kota samarinda dalam memberikan pelayanan prima telah meningkatkan sarana dan prasarana bagi masyarakat pengguna pelayanan.

Abstract

Republik Indonesia, batasan kewenangan Ombudsman Republik Indonesia dalam melaksanakan fungsi pengawasan, kendala yang dihadapi dan upaya yang ditempuh untuk mengatasi kendala dalam mewujudkan good governance. Penelitian ini merupakan penelitian hukum normatif. Data penelitian ini terdiri dari data sekunder dan ditunjang dengan data lapangan. Data sekunder diperoleh melalui studi dokumen terhadap bahan hukum primer, sekunder, dan tersier. Data lapangan diperoleh melalui wawancara terhadap narasumber yaitu Ombudsman Bidang Pencegahan. Hasil penelitian menunjukkan bahwa fungsi pengawasan Ombudsman Republik Indonesia yang dilakukan secara pasif, aktif, dan mediasi terhadap penyelenggara negara dan pemerintah menjadi peran penting di dalam mewujudkan good governance. Rekomendasi merupakan salah satu bentuk kewenangan Ombudsman Republik Indonesia dalam melaksanakan fungsi pengawasan. Kendala yang dihadapi Ombudsman Republik Indonesia antara lain: masih ada resistensi aparatur negara dan benturan kewenangan dengan lembaga negara lain. Selain itu keterbatasan dana dan sumber daya manusia yang berpengaruh pada optimalisasi kerja Ombudsman Republik Indonesia di daerah. Upaya yang harus ditempuh yaitu dengan mengadakan jaringan kerjasama dan koordinasi dengan beberapa pihak aparatur negara dan lembaga negara lainnya. Melakukan upaya pengembangan perwakilan di daerah dan mengadakan berbagai bentuk sosialisasi tentang Ombudsman Republik Indonesia.

Abstract

The Unitary Republic of Indonesia's Republic of Indonesia in organizing the system of government embraces the principle of Decentralization by providing opportunities and freedom to the regions to organize Regional Autonomy. Indonesia is a regional entity consisting of central government and local government, as regulated in the provisions of Article 18 paragraph (1) of the 1945 Constitution which states that the Unitary State of the Republic of Indonesia is divided into provinces and provinces are divided into districts and city, where each province, district, and city have local government, which is regulated by law. The district / municipality government comprises the subdistrict area, and each sub-district has village / village in it, the village's new face becomes the hope of accompanying the establishment of Law No. 6 of 2014 on the Village which becomes the starting point of the village's hope to be able to determine the position, role and authority over himself so that the village can be politically and politically swayed as the foundation of village democracy, as well as economically and culturally dignified as the face of village self-reliance and rural development. Article 26 has given the village chief the opportunity to manage the finances and assets owned by the village. The stages of the village financial management have been regulated by the Minister of Home Affairs Regulation No. 113 of 2014 on Village Financial Management, and the Regulation of the Minister of Home Affairs of the Republic of Indonesia No. 1 of 2016 on Village Asset Management regulates the procedures for managing village assets. The management of village finances and assets can’t be separated from the ability of the Village Head and other village apparatus. The responsibility of the Village Head in managing village finances and assets properly, transparently and in accordance with applicable laws and regulations is necessary to promote the development and economy of the village, including Karang Tunggal village as one of government under Kutai Kartanegara.

Abstract

Keberadaan salah satu kawasan kampung di wilayah Kota Samarinda yang menjadi pusat atau markas dari anak remaja untuk melakukan aktivitas menghisap lem,  yang sebelumnya dikenal dengan istilah Kampung Zombie, terletak di Kelurahan Mangkupalas, Kecamatan Samarinda Seberang Kota Samarinda, menjadi sebuah fenomena sosial yang cukup memprihatinkan. Dalam menyikapinya, diperlukan korelasi yang bersinergi dengan semua stakeholder dalam rangka mewujudkan efektifitas penegakan hukum terhadap perilaku ngelem pada anak remaja melalui upaya-upaya penegakan hukum terhadap perilaku “ngelem” yang menjadi tolak ukur keberhasilan penegakan hukum pada perilaku anak remaja “ngelem” sebagai pelaku sekaligus korban (self victimizing) khususnya di Kawasan Kampung Zombie, Kota Samarinda.

Abstract

The purpose of this study is to review and analyze the legal consequences of acquisitions made on limited liability companies; and based on theconsiderations used by KPPU to determine that PT Nippon Indosari Corpindo, Tbk. Has violated Law Number 5 of 1999 .This research is normative legal research. Secondary data collection in library research is done by studying documents. The data analysis method used in this study is descriptive and analyzed qualitatively.The results of this study are: (1) Acquisition or Acquisition of Limited Liability Companies can also provide legal consequences affecting the Limited Liability Company. The legal consequences referred to in the Limited Liability Company are the legal consequences both institutionally, namely shareholders, employees, and third parties, as well as the legal consequences of certain parties, especially to third parties or creditors from the acquired limited liability company. In practice that has happened so far, the status of creditors' receivables in a limited liability company that has been acquired is the responsibility of the new Shareholders ; and (2) In the reading of the decision it was also explained that the reported party had acquired / taken over shares of PT Prima Top Boga on January 24, 2018, amounting to 32,051 shares (issuance of new shares) taken over by adding capital worth Rp31,499,722,800 , 00 (thirty one billion four hundred ninety nine million seven hundred twenty thousand eight hundred rupiahs) by Pt Nippon Indosari Corpindo, Tbk. After a long process, through the Merger Directorate, it was conveyed that based on the calculation of calendar days, notices of the takeover of shares of the PT Prima Top Boga company should be notified to the Commission no later than March 23, 2018. However, the reported report took place on March 29, 2018. In accordance with PP No. 57 of 2010 that the reported party is obliged to notify the Commission of the acquisition of shares no later than 30 (thirty) working calendar days from the date the juridically effective Business Entity, Business Entity Consolidation or Takeover of Company Shares are effective.

Conspiracy use various way for coordinate activities they like through settings production, determination price horizontally, collusive tendering, division area, division consumer as a non-territorial, and division share market, even though similarly we need realize it that effective conspiracy it is not easy for achieved. However there trend the perpetrators business will always attempted maximizing profit his company respectively. Must there is some requirement in occurrence a conspiracy is must existence deal agreement or collusion between perpetrators effort. There is two form collusion in conspiracy, namely: collusion explicit, where the member communicate and coordinate deal they on real/live can declared with some document agreement already they agree, the data regarding the joint audit, management conspiracy, policies-policies writing, sales data and other data. There is also collusion secretly, where the perpetrators business member conspiracy no communicate on blatant, usually meetings too held on secret. And regular use as the media is association industry, so meetings member conspiracy camouflaged with legal meetings such as meeting associations. Form the second collusion this very difficult for detected by enforcer law. However experience from various country prove that at least 30% of conspiracy is involve associations.

Abstract

Kejahatan narkotika saat ini terus mengalami perkembangan bahkan telah menyerang segala bidang kehidupan apalagi saat ini banyak melibatkankan generasi muda. Teori restorative justice merupakan salah satu teori dalam hukum untuk menutup celah kelemahan dalam penyelesaian perkara pidana konvensional yaitu pendekatan represif yang sebagaimana dilaksanakan dalam Sistem Peradilan Pidana. Metode penelitian yang digunakan adalah yuridis empiris yaitu bahwa dalam menganalisis permasalahan dilakukan dengan cara memadukan bahan-bahan hukum yang merupakan data sekunder dengan data primer yang diperoleh di lapangan yang berkaitan dengan pembuktian penyalahguna narkotika dalam rangka penerapan asas restorative justice. Hasil Penelitian Studi Kasus Dalam Perkara Tindak Pidana Nomor : 396/Pid.Sus/2021/PN Smr yang didakwa karena telah ditemukannya Narkotika jenis sabu - sabu yang beratnya seberat 0,62 gr (nol koma enam puluh dua) gram bruto atau yang tidak melebihi 1 gram, dan tujuan penggunaan Narkotika jenis sabu - sabu untuk diri sendiri seharusnya dilakukan assesment terlebih dahulu agar dapat di terapkannya keadilan restorative. Namun faktanya terlihat bahwa tidak semua orang yang kedapatan menggunakan Narkotika jenis sabu - sabu yang beratnya tidak melebihi 1 gram dengan tujuan penggunaan Narkotika jenis sabu – sabu tersebut untuk diri sendiri dapat dikategorikan sebagai penyalahguna atau pengguna. Kesimpulan pembuktian penyalahguna narkotika dalam rangka penerapan asas restorative justice dalam pelaksanaannya dalam sistem peradilan pidana Indonesia masih belum optimal. Upaya pembuktian terhadap penyalahguna atau pecandu adalah pembuktian jumlah Narkotika tidak melebihi dari yang ditentukan dalam Keputusan Dirjen Badilum MA No. 1691/DJU/SK/PS.00/12/2020, keterangan saksi-saksi saat dalam penyidikan, dan saksi yang melihat yang mengetahui dan mendengar bahwasanya seseorang itu telah mengkonsumsi narkotika.

Abstract

Background: According to Article 7 paragraph (1) of Law Number 1 of 1974, marriage is permitted if the man has reached the age of 19 and the woman has reached the age of 16. These provisions have been amended, namely in Article 7 paragraph (1) of Law Number 16 of 2019, it is explained that marriage is only permitted if a man and a woman have reached the age of 19. Marriage maturity is a program of the Family Planning Population Agency (BKKBN) as an effort to increase the minimum age of 20 years for women and 25 years for men to have their first marriage. Marriage dispensation is a legal policy that allows minors to be able to enter into legal marriages in Indonesia as stipulated in Article 7 paragraph (2) of the Marriage Law. Research Method: In this study the authors used normative research methods with conceptual approaches to laws, cases. Findings: Marriage Age Maturity (PUP) is an effort to increase the age of the first marriage, so that it reaches a minimum age at the time of marriage, namely 21 years for women and 25 years for men. Maturity of marriage age is not just delaying until a certain age, but trying to make the first pregnancy occur at a fairly mature age. With permission from the court or related officials for someone who is not yet 19 years old and wants to get married for certain reasons and accompanied by supporting evidence. So that the provisions for the legal age limit for marriage can be dissolved with the dispensation of marriage, it does not rule out the possibility that child marriages will continue to occur. Conclusion: The application of the marriage dispensation is in stark contrast to efforts to prevent child marriage in the marriage-age maturity program and contradicts Article 26 paragraph 1 letter c, the 2002 Child Protection Law which mandates preventing marriage at a young age. This provision opens a legal loophole for the implementation of child marriages.

Abstract

Background: Bawaslu Samarinda efforts to prevent general election violations are a series of activities carried out in carrying out the task of preventing election violations which include coordinating with relevant government agencies, providing advice and increasing public participation in election supervision related to preventing election violations. This research examines and analyzes first, the readiness of the Bawaslu in facing the 2024 Simultaneous General Election, second, the form of preventing General Election Violations carried out by the Bawaslu by using Research Method: The research method used is non-doctrinal, data collection is carried out by library research and field research using observation, then it will be analyzed descriptively qualitatively. By basing existing data, the author describes systematically, factually and accurately the facts and relationships between existing phenomena. Findings: The research results show that the Samarinda City Bawaslu has made efforts to prevent violations at stages throughout 2022. In accordance with its task, namely coordinating and increasing community participation in election supervision. Potential violations and disputes in the election process are very likely to occur at each stage, so efforts with various forms of prevention must continue to be carried out, such as socializing legal regulations to all elements of society, as part of increasing participatory supervision as well as minimizing the occurrence of suspected election violations at each stage of the election. for the sake of creating honest and fair elections. Conclusion: Bawaslu readiness to face the 2024 Simultaneous General Election Bawaslu with the establishment of the Samarinda City Integrated Law Enforcement Center which consists of elements of the Samarinda District Prosecutor's Office, Samarinda Police Elements and Bawaslu Elements. Bawaslu prepares standards for work procedures for supervising the stages of election administration as work guidelines for election supervisors at every level.

Abstract

Based on the Constitution of the Republic of Indonesia, the implementation of general elections is a reflection of the application of the concept of democracy which is emphasized in Article 1 paragraph (2) which reads "sovereignty is in the hands of the people and is implemented according to the Constitution", which is further confirmed in Article 22 E paragraph (1) which states that "general elections are held directly, publicly, freely and secretly". During elections, the possibility of violations or unlawful acts does not rule out the possibility. Bawaslu is an ad hoc institution formed during the first stage of the election, namely at the voter registration stage which begins and is disbanded after the candidates selected in the election have been inaugurated. An election supervisory committee (Panwaslu) was formed to supervise the election stages, receive complaints, and handle cases of administrative violations and criminal election violations. The approach method used is a doctrinal approach, using primary legal materials and secondary legal materials, which are then analyzed qualitatively and described. Forms of violations included in supervision by Bawaslu consist of Election Administration Violations, Election Crime Violations, Violations of the Code of Ethics. The form of action against election violations is basically that the City Bawaslu provides recommendations according to the level of the violation.
