Abstract

Telah terjadi ketidakjelasan hukum mengenai pengaturan penyelesaian sengketa antara pasien dan dokter , adanyahubungan hukum terapeutik dalam layanan kesehatan. Tujuan penelitian mencari kejelasan hukum penyelesaiansengketa akibat pemakaian produk teknologi kesehatan pada layanan kesehatan dalam perspektif perlindungankonsumen Metode yang digunakan dalam penelitian ini adalah Metode Penelitia Hukum Yuridis Normatif karenamenganalisa bahan hukum primer perundang-undangan layanan kesehatan , menggunakan analisis secarapreskriptif analitik dan secara sistematik. Hasil penelitian menujukkan adanya keharusan penyelesaian sengketaantara pasien dan dokter terlebih dahulu melalui mediasi di Majelis Kehormatan Disiplin Kedokteran Indonesiahanya menentukan ada tidaknya kesalahan yang dilakukan dokter dan dokter gigi dalam penerapan disiplin ilmukedokteran dan kedokteran gigi, dan menetapkan sanksi pelanggaran disiplin, sehingga mediasi sebagai alternatifpenyelesaian sengketa di luar pengadilan bersifat sukarela dan mampu menghasilkan putusan yang bersifat win-winsolution belum menawarkan solusi penyelesaian sengketa bagi pasien sebagai konsumen yang memiliki sengketadengan dokter terhadap adanya kerugian pasien, dan hukum kesehatan menyerahkan penyelesaian sengketa perdatadan pidana melalui cara penyelesaian di pengadilan yang seharusnya penyelesaian di pengadilan merupakan carapenyelesaian yang terakhir (Ultimum remidium). Kesimpulan pengaturan penyelesaian sengketa layanan kesehatanyang merupakan lex specialis derogat legi generali hukum perlindungan konsumen belum memberikanperlindungan bagi konsumen.Kata Kunci : Penyelesaian Sengketa, Layanan Kesehatan, Konsumen

Abstract

Coliform bacteria is a one of a kind negative bacteria that is commonly found marine waters, the presence of coliform bacteria can be an indicator of biology that is important to know the environmental conditions. This study aims to determine the environmental conditions based on biological indicators in the form of an abundance of coliform bacteria in the waters of the River right District Labuhanbatu Selatan. The main ingredient in this study is the River right and sediment. The results of the analysis showed the density of coliform bacteria in the study site ranged from 500-700 colonies/ml for the sample waters and 27-120 MPN/g for sediment samples. The results obtained are still below the quality standard so that the river right in good condition biologically. The presence of coliform bacteria in the river can affect human and biota. So it needs to be considered in the efforts of the management of the coastal environment, particularly in efforts to maintain the sustainability of fisheries resources

Abstract

As one of the Penta Helix elements in crisis management, Muhammadiyah conducted humanitarian efforts throughout the pandemic, notably in East Kalimantan, through the Muhammadiyah COVID-19 Command Center (MCCC). As a collective humanitarian memory of East Kalimantan during the height of the COVID-19 pandemic, this study attempts to present an overview of all the volunteer activities conducted by MCCC in Balikpapan and Samarinda during the pandemic. Descriptive analysis and qualitative technique are utilized in this study. To gather primary data, two informants from Balikpapan and four informants from Samarinda were interviewed. Secondary data came from reporting documents from the Muhammadiyah Disaster Management Center (MDMC) in East Kalimantan, which were located through a Google search for pertinent terms. The following are the study's findings: (1) In Balikpapan and Samarinda, MCCC volunteers took part in emergency response and disaster risk mitigation operations. (2) They give medical aid, apply disinfectants, and conduct out programs related to food security. (3) They go a long way to help others. They are all living examples of that since they have all survived COVID. During the peak of the COVID-19 pandemic, one individual was hospitalized, others were forced to self-isolate, and there were no reports in the media about any philanthropic activities. In conclusion, as volunteers are at high danger during the COVID-19 pandemic, their goodness cannot be questioned.

Abstract

Landslides potential analysis is very serious issue in disaster mitigation processes. The risk of landslide potential in a slope can be assessed through the calculation of Slope Safety Factors, involving data on soil physical properties, soil mechanics (geotechnical properties), and slope geometry. Research was conducted using a combination of resistivity and Bishop geotechnical methods. The geoelectric method was employed to determine the lithology of landslide materials and the geometry of the sliding plane. The Bishop geotechnical method was used to calculate the slope safety factor based on geoelectric data, soil mechanics data, and rock mechanics data obtained in the study area. A total of 2 geoelectric measurement profiles, each 120-150 meters long, were taken in the Imogiri region of Yogyakarta. The research results indicate that the sliding plane is located at a depth of 10 meters with clay lithology. The calculated slope safety factor using the Bishop method was performed under two conditions: saturated and unsaturated. The saturated slope safety factor has a low value, less than 1.07, while the unsaturated condition yields a higher value, greater than 1.25.

Abstract

Ring of fire passes through Indonesia, causing the presence of abundant mineral resource potential. Potential minerals in Indonesia are formed by hydrothermal processes. One of the hydrothermal deposits is a high-sulfidation epithermal (HSE) deposit. The appropriate geophysical methods can be used to find potential mineral resources. The geomagnetic method can detect mineralization by analyzing the development of structural pattern control. Tilt derivative filters used in magnetic data can clarify anomalous boundaries, especially structural straightness boundaries. The analysis showed that the mineralized zone had a distribution of low susceptibility values of 0.0054 to -0.0178cgs. due to destructive magnetite minerals in the advanced argillic alteration zone. Tilt derivative analysis shows the shape of a low circular anomalous pattern that extends north-south towards the boundary of the left horizontal fault, which develops into a faulty fault complex as control of mineralization. The method integration produces an HSE precipitate conceptual model, in which the presence of alteration and mineralization is controlled by a left horizontal fault zone that forms a fault complex descending in it and develops into a northwest-southeast tension vein plating dipping opening as estimation of mineralized pathways in the "X" Region, West Java, Indonesia.

Abstract

Background: Communal Intellectual Property (KIK) as a wealth of Indonesian cultural heritage must be protected, preserved, developed, and/or utilized through an inventory, which will then be collected into the KIK Data Center in Indonesia. For the regions with KIK protection is not only a form of legal protection but also aims to encourage the economy of the community in an area and as an effort to protect cultural heritage as the identity of a region. The purpose of this study was to identify the potential and constraints in the KIK inventory in East Kalimantan Province and explore the efforts of the East Kalimantan local government in implementing the KIK inventory. Research Methods: The type of research used was socio-legal with a statutory approach and a social approach to get the maximum form of inventory implementation. The technique of data analysis was carried out, namely by analyzing statutory regulations that had been inventoried to obtain legal certainty for the implementation of the KIK inventory. Furthermore, analyzing factual data in the implementation of KIK protection and problems in the community, and offering strategic steps in organizing KIK inventory in providing legal protection for KIK in East Kalimantan. Findings: The findings after the discussion were, first, the identification of the KIK potential in East Kalimantan was carried out with an inventory. The inventory of KIK in East Kalimantan as an effort to protect the law of cultural works was carried out on a defensive basis. Second, implementation of KIK potential inventory in East Kalimantan are in two forms, namely, an inventory carried out by the Ministry of Law and Human Rights through the KIK registration mechanism, then entered into the KIK Data Center, and Education and Culture Office through a recording mechanism which was then determined become WBTB. Then, there were still differences in perceptions within the internal government and the lack of public understanding regarding the substance of the KIK inventory, which is the main obstacle in implementing the inventory. Conclusion: Conclusion from the discussion, namely, first, the inventory of potential KIK is still experiencing problems and has an impact on the non-optimal legal protection of cultural works in East Kalimantan. Second, various efforts have been made by the Ministry of Law and Human Rights, the Department of Education and Culture, and the community, but have not been able to synergize the entire system in implementing the inventory. As a recommendation regarding this matter, the first is to share perceptions and synergize between the Ministry of Law and Human Rights and the Education and Culture Office. Second, the inventory system must accommodate all social facts, objective realities, and consider local cultural values. Besides, special treatment is needed for the community by maximizing socialization, education, and assisting in the KIK inventory.

Abstract

Wasting in children under five remains a significant public health problem, especially in developing countries like Indonesia, where nutritional issues such as wasting, stunting, and underweight are still prevalent. This study aimed to develop and implement a community-based innovation program named Tangan Baliku (Integrated Management of Underweight Children) to address the high incidence of wasting in the working area of Purbaratu Primary Health Center. This innovation was designed and implemented in April 2022 through cross-sectoral collaboration, focusing on promotive, preventive, curative, and educational approaches. The methodology used was a descriptive participatory approach involving community empowerment through optimizing the existing mother–toddler class, home visits, nutrition counseling, supplementary feeding, and regular monitoring. The results show that Tangan Baliku effectively increases early detection and management of underweight children, improves mothers' knowledge of nutrition, and encourages higher participation in toddler health services. It also helps in reducing the number of children with poor nutritional status through structured follow-up and referral systems. In conclusion, the Tangan Baliku program is a comprehensive and sustainable strategy that addresses wasting by strengthening maternal involvement, community participation, and cross-sector collaboration in child nutrition improvement. This program contributes to better health outcomes for children under five and supports the development of a healthy and high-quality future generation.

Abstract

The Consumer Protection Law in Indonesia has so far focused more on transactions between consumers and business actors without distinguishing between commercial products and subsidized products . In fact, subsidized products such as clean water from PDAM, subsidized electricity, and subsidized fuel have different legal characteristics because The price is set by the government and monitored by certain bodies . This difference has implications for price transparency, service quality standards, and dispute resolution mechanisms which is not fully regulated in the UUPK. This article aims to analyze the incompleteness of consumer protection regulations for subsidized products and propose a fairer and more effective legal reconstruction . By using normative approach , this research to study national regulations, WTO principles related to subsidies, and comparative studies with other countries . The results of the study indicate that consumer protection for subsidized products requires a more specific legal framework. to guarantee consumer rights without ignoring the interests of the government as a regulator and service provider as a special business actor . Therefore, it is necessary regulatory reconstruction that accommodates price transparency, improved service quality, and clearer dispute resolution mechanisms for consumers of subsidized products

Abstract

Fulfillment of nickel laterite needs for various industrial purposes has become a government plan that must be realized immediately. The sustainability of the nickel laterite supply is the main reason for increasing exploration activities in various nickel laterite-producing areas in Indonesia. Nickel laterite explorations have been carried out in several areas, one of which is in Pomalaa District, Kolaka Regency, Southeast Sulawesi. The ERT (Electrical Resistivity Tomography) method combined with drilling and geochemical data is very suitable for delineating nickel laterite in the subsurface in three blocks. The purpose of this study was to obtain the distribution of nickel laterite in the subsurface and analyze its characteristics. This study used the Wenner configuration and 19 exploration drill points with geochemical assay data. The results of the study showed that there were three zones based on their resistivity values, namely the saprolite zone with a low resistivity value (35 Ωm), the saprolitic rock to boulder zone with a medium resistivity value (35 - 65) Ωm, and the bedrock zone in the form of peridotite rocks with a relatively high level of serpentinization, fracture and weathering, with a high resistivity value ( 65 Ωm). For characterization, the research area is divided into three blocks, namely West, Central and East Block. West block has low Ni content (0.96%) for the saprolite zone and (0.32 - 1.27) % for the saprolitic rock zone, and high (1.65 - 3.24) % for the saprolite zone and (1.35 - 2.27) % for the saprolitic rock zone. In the Central block, the Ni content is low in the saprolite zone of (0.27 - 1.37) % and the saprolitic rock zone of (0.26 - 1.30) %. While in the East Block, the Ni content is low (0.48 - 1.25) % for the saprolite zone, (0.03 - 1.29) % for the saprolitic rock zone, and high (1.34 - 2.94) % for the saprolite zone and (1.31 - 2.84) % for the saprolitic rock zone.
