Abstract

Berdasarkan observasi dan survey yang dilakukan di Kecamatan Pusomaen Kabupaten Minahasa Tenggara, ditemukan sebagian besar masyarakat tersebut masih belum mengetahui dan memahami perihal perkawinan yang diatur dalam Undang-Undang Perkawinan di Indonesia. Konsekuensi yang ditimbulkan dari ketidaktahuan dan ketidakpahaman UUP adalah hadirnya fenomena perkawinan di bawah umur. Poin tersebut kemudian, mendorong pengabdi dan tim untuk melakukan pengabdian berupa penyuluhan pada Masyarakat Pusomaen, agar masalah tentang pengetahuan dan pemahan terkait UUP, serta perkawinan di bawah umur dapat diselesaikan. Metode yang digunakan dalam melakukan pengabdian tersusun dari tiga hal, diantaranya; Ceramah, Diskusi, dan Pelayanan Konsultasi Hukum. Dari rangkaian agenda kegiatan pengabdian yang dilakukan, maka dapat ditarik kesimpulan bahwa, Asas, rukun, dan syarat perkawinan yang terkandung dalam UUP perlu diketahui dan diimplementasikan kepada masyarakat, khususnya masyarakat di Kecamatan Posumaen Kabupaten Minahasa Tenggara. Prosedur permohonan dan alur putusan permohonan mengenai DISKA yang terkandung dalam UUP juga perlu untuk diketahui, agar permasalahan yang nantinya akan ditimbulkan akibat perkawinan tidak tercatat dapat diminimalisir. Selain itu, perlu adanya peranan aktif dari tokoh agama, guru, dan orang tua untuk melakukan himbauan kepada para remaja agar dapat mencegah fenomena perkawinan di bawah umur.

Abstract

Tujuan dari penelitian ini adalah untuk menganalisis praktik transaksi jual beli tanah dan menilai kesesuaiannya dengan prinsip hukum ekonomi syariah, menggunakan kasus sengketa tanah Nomor. 6/PDT.G/2023/PN KTG sebagai studi kasus. Metode penelitian yang digunakan adalah kualitatif, dengan data dikumpulkan melalui wawancara mendalam, observasi lapangan, dan studi dokumen yang berkaitan dengan kasus tersebut. Hasil penelitian menunjukkan bahwa transaksi jual beli tanah yang dilakukan belum sepenuhnya memenuhi syarat dan rukun jual beli syariah, terutama karena mengandung unsur gharar (ketidakpastian) akibat tidak adanya ketetapan jangka waktu pembayaran. Penelitian ini mengungkapkan bahwa ketidakjelasan dalam transaksi dapat menimbulkan sengketa dan merugikan salah satu pihak, yang mana dalam konteks ini adalah pembeli tanah. Artinya, transaksi yang dilakukan dalam kasus ini tidak sepenuhnya sah menurut hukum ekonomi syariah dan memerlukan peninjauan serta penyesuaian lebih lanjut untuk memastikan keadilan dan kepatuhan syariah. Kontribusi penelitian ini terletak pada penerapan hukum ekonomi syariah dalam kasus nyata transaksi tanah, memberikan wawasan baru tentang praktik jual beli tanah di Indonesia, serta rekomendasi bagi para pihak yang terlibat untuk menghindari sengketa di masa depan. Penelitian ini juga memberikan masukan pada pembentukan kebijakan yang lebih baik dalam regulasi jual beli tanah di bawah hukum ekonomi syariah.

Abstract

This study evaluates the effectiveness of implementing the Prodeo and Sidang Keliling at the Boroko Religious Court in PERMA No. 1 of 2014. The research method used is qualitative with a juridical-empirical approach, including data collection through in-depth interviews, observations, and document analysis. The results showed that implementing the two programs significantly increased access to justice for the underprivileged. However, fluctuations were found in the realization of annual cases, highlighting the need for budget adjustments and more effective socialization strategies. The discussion emphasized the importance of adapting legal services to the needs of local communities and integrating the provider approach into the broader justice system. The conclusion of this study suggests that with improved management and socialization, the Prodeo and Sidang keliling can continue to effectively support the principles of social justice and broader access to legal services. The implications of this study lead to policy recommendations to optimize resource allocation and socialization strategies in the Indonesian judicial system, especially in the Boroko Religious Court.

Abstract

Cryptocurrency, as a rapidly evolving digital asset, has sparked significant debates regarding its legality and compliance with Islamic law. This study examines the intersection of Indonesian positive law and Islamic principles in regulating cryptocurrency as a tradable commodity (Sil’ah). Using a qualitative library research approach, the research explores regulatory frameworks such as Peraturan Menteri Perdagangan Nomor 99 Tahun 2018 and Peraturan BAPPEBTI Nomor 5 Tahun 2019, alongside Islamic legal standards for Sil’ah. Findings reveal that while Indonesian law has established a robust regulatory system ensuring transparency and security, compliance with Islamic principles requires further alignment, particularly in addressing challenges like volatility, lack of physical form, and potential gharar (uncertainty). However, digital documentation and blockchain technology provide opportunities for cryptocurrency to meet Sil’ah criteria, including ownership clarity and economic utility. The study emphasizes the potential for harmonizing positive law and Islamic law through adaptive regulations and innovative technologies such as blockchain-based smart contracts and halal asset tokenization. This integration could support a sharia-compliant digital economy, fostering inclusivity and trust among Muslim investors. The research contributes to bridging gaps in understanding cryptocurrency's role within Islamic finance and its future in the global economic landscape.

Abstract

The increasing divorce rate among Polri personnel presents a critical challenge affecting individual well-being and institutional performance. As an advisory body within the Polri institution, the Badan Pembantu Penasehat Perkawinan, Perceraian, dan Rujuk (BP4R) is crucial in providing marital counseling and mediation services to support family stability. This study examines the effectiveness of BP4R in resolving family conflicts among Polri personnel through an Islamic law framework. Employing a qualitative approach with a descriptive-analytical design, data were collected through in-depth interviews, field observations, and document analysis at Polres Bolaang Mongondow Selatan. Findings indicate that BP4R's impact is constrained by limited training for its personnel, inadequate awareness among Polri members about its services, and cultural barriers that hinder open discussions about marital conflicts. To enhance BP4R’s role, this study proposes three key strategies: intensive training in Islamic law-based mediation, digitalization of counseling services, and multidisciplinary collaboration with religious leaders and psychologists. These recommendations aim to strengthen BP4R’s capacity to promote marital harmony, reduce divorce rates, and ensure Polri personnel's and their families well-being. The study contributes practical insights for institutional policy-making and theoretical perspectives on integrating Islamic law into family conflict resolution.

Abstract

Progressive law demands more open-mindedness to the possibility of alternative solutions in solving legal problems. In this case, the application of restorative justice is expected to have a positive impact on justice, not only in the formal legal context, but also in a broader social context. The purpose of this paper is to analyze the changes to criminal law in Law Number 1 of 2023 (later referred to as the National Criminal Law). How the application of restorative justice in the National Criminal Law is viewed from the perspective of progressive law. The method used is descriptive-normative, by collecting normative legal data, such as laws or regulations, to identify and understand its application in practice. The results show that Restorative justice offers a more humanist approach in resolving criminal cases, which focuses not only on punishment, but also on restoring the relationship between the perpetrator, the victim, and the community. Articles in the National Criminal Law indicate the existence of restorative justice in Article 54, Article 132 Paragraph 1 Letter g, Article 82, Articles 76, 77, and 80 (Reason for Termination of Prosecution), 132 Paragraph 1 Letters d and e. Restorative Justice in the National Criminal Law with a progressive legal approach provides opportunities for non-criminal settlements (diversion), recognition of victims, restorative justice, settlement with a substantive justice approach, alternative criminal sanctions. Through the application of restorative justice, the Indonesian criminal justice system has the potential to focus more on recovery and rehabilitation, reduce the burden on the courts, and support the social reintegration of offenders, which will create a more harmonious and just society. ___ References Books with an author: Dahl, R.
