Abstract

In environmental protection and management, the main effort is to prevent pollution and damage on environment instead of repressing the damages occurred. Permit is one of preventive measures and becomes a principle in Administrative Law. Permits can be seen as government’s tool as judicial preventive and used as an administrative instrument to control people's behavior. Environmental permit can be seen as preventive measure, because it always related to orders and obligations that must be obeyed by the holder. On the other hand, environmental permit also function as repressive instrument to counter environmental problems due to human activities, including mining. The norm’s obscurity on the supervision of environmental permits in in Law No. 32 Year 2009 on Environmental Protection and Management (hereafter will refer as UUPPLH) is an indicator for the lack of the objective results.Based on type, this research  focuses the study on the Environmental permit as an absolute requirement. Normatively, the principle of environmental permit as stipulated in Environmental Law regulates that every business and/or activity which required an Environmental Impact Analysis document or UKL-UPL should also hold an environmental permit. The purpose of Environmental permits is to maintain the preservation of environmental functions while also prevent and counter environmental pollution and damage due to human activities. Based on this construction, permits plays a very important role in environmental activity. Exploitation of natural resources has a significant impact on the environment, thus based on Article 22 paragraph (1) of Environmental Law these activities requires an Environment Impact Analysis. Important impacts as detailed in Article 22 paragraph (2) at empirical level still occurs so the goal of preventing pollution and damage as the objective of environmental permits still has not been achieved.

Abstract

Kegiatan ini berawal dari hasil survey terhadap kondisi lingkungan di Kecamatan Bumi Makmur yang menjadi lokasi KKN Mahasiswa UNISKA. Dari hasil survey tersebut terdata bahwa kehidupan masyarakt setempat cukup komunal. Kearifan tradisional merupakan salah satu warisan budaya yang ada di masyarakat (tradisional) dan secara turun-temurun dilaksanakan oleh masyarakat yang bersangkutan. Kegiatan KKN yang mengkondisikan tim banyak berinteraksi dengan seluruh Kepala Desa di Kecamatan Bumi Makmur menjadi wahana diskusi berkaitan dengan permasalahan desa. Solusi yang menjadi prioritas dalam pelaksanaan kegiatan Pengabdian Kepada Masyarakat skema Program Pemberdayaan Masyarakat yang bermitra dengan Kepala-Kepala Desa di Kecamatan Bumi Makmur adalah Sosialisasi Perma Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan dan memberikan pemahaman pentingnya menyelesaikan sengketa lewat jalur mediasi serta melatih para Kepala Desa agar terampil dalam merundingkan sengketa-sengketa keperdataan (bukan masalah pidana) dalam upaya menjaga kondisi masyarakat tetap aman tenteram; Hasil kegiatan PkM diharapkan mampu mencapai target luaran dalam bentuk publikasi dan rekayasa sosial.

Abstract

Pengabdian kepada masyarakat ini bertujuan memberikan advokasi publik untuk meningkatkan Pemahaman dan Kesadaran tentang rentannya lingkungan Hidup dan seberapa penting untuk menjaganya. Mencakup pemahaman ketentuan peraturan perundang-undangan bagaimana tindakan manusia yang mempengaruhi lingkungan, dan tanggung jawab atas tindakan yang akan dilakukan. Perubahan pengaturan dan perundang-undangan keselamatan lingkungan sering terjadi dapat melemahkan pemahaman dan kesadaran perbaikan lingkungan di masyarakat. Hal ini juga terjadi pada Kelompok Usaha Laundry yang telah tumbuh dan berkembang pesat di Kota Banjarmasin. Karena usaha ini selalu berkaitan dengan penggunaan Detergen dan air merupakan limbah usaha yang dapat menimbulkan masalah pencemaran lingkungan. UU Cipta Kerja dan peraturan turunannya PP No. 22 Tahun 2021 Tentang Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup telah mengubah ketentuan pengaturan tanggung jawab Pengelolaan Limbah sebelumnya. Pendampingan dalam bentuk Advokasi Publik bagi usaha kecil dan menengah Kelompok Laundry “Rumah Cuci Kita” sangat membantu dan dapat memotivasi dalam mengatasi permasalahan kelompok usaha kecil laundry dalam memahami peraturan baru dan melaksanakannya berdasarkan PP 22 Tahun 2021, baik dalam hal aturan pengelolaan limbah maupun tahapan upaya pengelolaan limbah bagi kelompok Usaha laundry dimaksud.

Abstract

Background:The problem of river water resource management between upstream and downstream areas is a problem in the era of decentralization and regional autonomy. The era of regional autonomy has changed various authorities in the environmental sector which are increasingly limited at the central and provincial government levels but have become greater at the Regency/City level. Law Number 23 of 2014 concerning Regional Government basically places the authority of the Regency/City Regional Government.Methods:The primary data obtained from the researcher's field research is expected to be able to answer these objectives. Furthermore, with secondary data, the researcher will conduct an inventory of primary legal materials in the form of regulations at both the national and regional levels that regulate river management and how the legal culture of the Banjarmasin City community utilizes and maintains rivers.Findings:The river culture in Banjarmasin City is not only marked by community activities carried out on the river, but also marked by the presence of settlements on the banks of the river, such as residential areas, places of worship, floating markets, siring, museums and other places on the banks of the river. In each sub-district there is a river caretaker whose job is to maintain and preserve it and as the first party to report if there is a problem related to the river. Conclusion:River culture is certainly a demand for society to be able to maintain the sustainability of rivers, because culture is not only about the activities and characteristics of a society, but is also seen from the behavior of its people in utilizing rivers, because rivers as a source of life must of course be utilized properly.Novelty/Originality of this article:An environmentally aware culture is crucial to improve so that there are no more people who do not care about preserving rivers and throwing garbage into rivers. River culture is certainly a demand for society to be able to maintain the sustainability of rivers, because culture is not only about the activities and characteristics of a society, but is also seen from the behavior of its people in utilizing rivers, because rivers as a source of life must of course be utilized properly.

Abstract

Abstract Community Service Activities startedfrom the results of a survey of environmental conditions in Bumi Makmur District which is a fostered village of the Islamic University of Kalimantan Muhammad Arsyad Al Banjar. From the results of the survey it was recorded that the life of the local community was quite communal.Traditional wisdom is one of the cultural heritages that exists in society (traditional) and is carried out from generation to generation by the Bumi Makmur community.In society, it is not uncommon for radicalism to develop. The rise of radicalism in society can have implications for stability and security between religious communities. Radicalism and terrorism both use open violence as instruments to achieve their interests. Radicalism can be carried out through brainwashing mechanisms and rejection of the law and Pancasila. The service method is carried out in stages, namely the preparation stage and the implementation stage. Village officials are an important component in society, because they are in direct contact with the community, village officials have various benefits, one of which is in terms of prevention. This service activity aims to provide counseling and training to educate and improve the skills of the Bumi Makmur village head in preventing the development of radicalism. Kearifan tradisional merupakan salah satu warisan budaya yang ada di masyarakat (tradisional) dan secara turun-temurun dilaksanakan oleh masyarakat Bumi Makmur. Di dalam masyarakat tidak jarang berkembangnya paham-paham radikalisme. Maraknya radikalime di masyarakat dapat berimplikasi pada stabilitas dan keamanan antar umat beragama Radikalisme maupun terorisme sama-sama menggunakan instrumen kekerasan terbuka dalam mencapai kepentingannya. Radikalisme dapat dilakukan dengan mekanisme pencucian otak dan penolakan terhadap hukum maupun pancasila. Metode pengabdian dilaksanakan dalam tahap, yaitu tahap persiapan dan tahap pelaksaaan. Perangkat desa adalah komponen penting didalam masyarakat, karena langsung bersentuhan dengan masyarakat, perangkat desa memiliki berbagai manfaat salah satunya yaitu dalam hal pencegahan. kegiatan pengabdian ini bertujuan untuk memberikan penyuluhan dan pelatihan guna mengedukasi dan meningkatkan keterampilan kepala desa Bumi Makmur dalam mencegah berkembangnya radikalisme.

Abstract

Isu Hukum yang diangkat berkaitan dengan persoalan tidak terpadunya penyelenggaraan perizinan di Indonesia yang salah satu indikatornya disebabkan ketidakkonsistenan penerapan konsep lingkungan hidup sebagaimana makna dan ruang lingkupnya. Dengan ketidakterpaduan pengaturan perizinan tersebut, maka masing-masing sektor memiliki kewenangan sendiri untuk mengatur persyaratan, prosedur, waktu dan biaya pengurusan perizinan. Melalui pendekatan perudang-undangan dan konseptual, peneliti mengkaji problematika perizinan dalam kegiatan pertambangan yang memberikan celah terjadinya tindak pidana korupsi tersebut. Ketidakterpaduan membuat proses penerbitan izin pertambangan yang panjang dan rumit. Perizinan yang terpadu dengan penyatuan wewenang (fusion of competence) yang dilaksanakan dengan cara koordinasi, yakni kerjasama dalam pelaksanaan wewenang yang bersifat mandiri (working together in the exertion of autonomous competences). diharapkan menjadi langkah untuk mencegah terjadinya praktek gratifikasi yang dilakukan oleh pemohon izin usaha pertambangan kepada pejabat yang berwenang untuk mengeluarkan izin tersebut.

Abstract

Freedom of expression is a human right guaranteed by the constitution and various national and international legal instruments. In the era of technological advancement and the rapid use of social media, digital space has become the primary means for people to express opinions and communicate. However, in practice in Indonesia, freedom of expression on social media often experiences conflicts between human rights protections and positive law, particularly Law Number 19 of 2016 concerning Electronic Information and Transactions. Method: Using a normative juridical method with a comparative legal approach and qualitative analysis of primary, secondary, and tertiary legal materials. Materials were collected through a literature review, as well as a literature search related to the regulation of freedom presented both from a human rights perspective and the provisions of the Electronic Information and Transactions Law. Conclusion: While Human Rights provide broad protection for freedom of expression, the Electronic Information and Transactions Law sets limits on the dissemination of information, which has the potential to trigger legal conflicts when restricting expression in the digital space. Harmonization is needed between the protections that state freedom and the regulations of the Electronic Information and Transactions Law to ensure that human rights and public security are maintained on social media.

Abstract

This research examines the SISKA KU INTIP Program (Palm Oil–Cattle Integration System Based on Core–Plasma Livestock Business Partnerships) as a role model for partnerships between palm oil plantation companies and communities. This program is an alternative to the obligation to build plasma plantations of 20% of the area regulated in Law No. 39 of 2014 concerning Plantations. In practice, limited land and high levels of agrarian conflict often hinder the implementation of plasma. SISKA KU INTIP offers a more flexible and productive solution through a palm-cattle integration. This research aims to: (1) find out how the SISKA KU INTIP program is implemented in oil palm plantations, and (2) analyze the legal politics in supporting this program as a role model for developing cattle-oil palm integration as a substitute for plasma obligations in Indonesia. The research method was normative juridical, with a statutory regulation and legal policy approach. Data was obtained through a literature study of primary, secondary, and tertiary legal materials. The analysis is carried out systematically, teleologically, in legal politics, legal discovery (reasoning and interpretation), and legal certainty. The research results show that although it has not been explicitly regulated as a substitute for plasma obligations, SISKA KU INTIP has a legal basis in various supporting sectoral and regional regulations. In addition, several academic studies have been conducted regarding the results or impact of SISKA KU INTIP on the plantation sector. This program can be applied normatively, technically, and socially as a model for substituting plasma obligations, as long as there is policy harmonization between the central and regional governments. This program also supports social justice and sustainable development through the values of Pancasila and the 1945 Constitution.

Abstract

Banjar Regency as one of the second-level regions in South Kalimantan Province has an HDI value that always experiences growth and is included in the medium category. However, if we look at the average growth rate of HDI value (shortfall reduction) during this period, it is included in the low category, which is around 0.74 percent (2010-2021 period) and only ranks 11th out of 13 districts. This shows that development programs in Banjar Regency, although they have a positive impact on improving the quality of life of the population, are not large enough when compared to development programs that have been carried out by other regencies/cities.To be able to improve these conditions, of course, it is necessary to study the causes of the low rate of growth of the HDI in Banjar Regency on the three basic dimensions of forming the HDI, namely the Dimensions of Health, Dimensions of Education and Dimensions of Decent Living Standards. Where the health dimension is represented by life expectancy (AHH), the education dimension is represented by the Average Years of Schooling (RLS) and Expected Years of Schooling (HLS), and the dimension of Decent Living Standards is represented by the Adjusted Expenditure Figures (APP).The method used is descriptive quantitativequalitative, using the Partial Least Of Square (PLS) technique to determine the influence of the dimension indicators forming HDI. The results of this research are as follows: (1) Life Expectancy and Average Years of Schooling have no significant effect on the HDI Figures of Kab. Banjar, (2) Expected Years of Schooling and Adjusted Per capita Figures have a significant effect on HDI figures, (3) indicators forming HDI such as AHH, RLS, HSL and APP together have a significant effect on HDI Kab. Banjar because the significance value is (0.000) < 0.05. With a coefficient of determination (R Squared Change) of 1,000, it can be said that the variance of the HDI value is 100% influenced by the forming indicators and is not influenced by indicators other than the indicators forming the HDI, (4) The order of indicators that contribute the most to the HDI Regency. Banjar from the largest are: Expected Length of Schooling, Life Expectancy, Expenditure Per Capita and Average Length of Schooling. In this case it can be said that the attention of the district government. Banjar during the period 2010-2021 focused more on HLS, AHH and APP indicators than on RLS indicators (the indicator with the smallest contribution).

Abstract

In 2020, Law Number 11 of 2020 concerning Job Creation was introduced. From this Job Creation Act, a new agency was born, namely the Land Bank Agency, which is a special institution that manages land. Whereas previously there was a National Land Agency in charge of land affairs. With the existence of two institutions that regulate the same thing, it is feared that there will be overlapping powers. After the issuance of the Job Creation Act, in April 2021 the government issued a derivative rule Number 64 of 2021 concerning the Land Bank Agency. However, in November 2021 it turned out that the Constitutional Court issued Decision Number 91/PUU-XVIII/2020. However, despite the issuance of Decision Number 91/PUU-XVIII/2020, the president still issues presidential decrees, namely presidential regulation number 113 of 2021 concerning The Structure and Administration of The Land Bank. This is contrary to the previous decision of the constitutional court. The purpose of this study is to determine the indications of equal authority between the Land Bank Agency and the National Land Agency and how the existence of the Land Bank Agency after the Constitutional Court Decision Number 91/PUU-XVIII/2020 This research uses normative research or commonly referred to as library research. This research approach uses a law approach, a conceptual approach and a philosophical approach.Indications of the same authority between the Land Bank Agency and the National Land Agency are Land Procurement and Land Utilization Control, for the Land Bank Agency itself to obtain Management Rights so that the difference in the task area between the two institutions is visible. However, with the issuance of Presidential Decree Number 113 of 2021, it is a violation and the existence of the Land Bank Agency can be null and void by law.
