Abstract

Abstrak: Desan Intruksional Dalam Pengajaran Bahasa Inggris Hukum. Fakultas Syariah dan Hukum telah mulai mempersiapkan siswa mampu dalam menghadapi karir mereka sebagai ilmuwan hukum tidak hanya di nasional tetapi juga internasional. Kurikulum terpadu telah menjadi pilihan sebagai sistem pendidikan. Salah satu bentuk kurikulum terpadu adalah untuk mengkorelasikan antara atau di antara mata pelajaran. Untuk memenuhi hal ini, fakultas mencoba untuk mengembangkan Program ESP sebagai program pikiran dalam proses pembelajaran. Desain pembelajaran merupakan salah satu pendekatan yang dapat menjadi metode pilihan untuk dosen bahasa Inggris dalam memberikan subjek. English II diajarkan di kedua semester. Kata kunci: ESP Program, desain instruksional, Pengajaran Bahasa Inggris Hukum, Pembelajaran Berbasis Proyek (PBL). Abstract: Intructional Design In Teaching English For Law. Sharia and Law faculty has started to prepare its students able in facing their career as a law scientist not only in national but also international. Integrated curriculum has become a define choice as educational system aims for rigor and relevance. One of the forms of integrated curriculum is to correlate between or among subjects. To fulfill this, the faculty tries to develop ESP program as the mind program in learning process. Instructional design is one of the approaches that can be an option method for English lecturer in delivering the subject. English II is taught in the second of semester. This subject is being correlated under the notion of Project Based Learning (PBL).The design involves students totally to search, analyze, and conclude what they learn. Abstract

In this modern era, sharia is still relevant in the monarchy system. Brunei Darussalam is a country that places sharia in a political monarchy that is prone to orthodoxy. This study analyzes the policy of implementing sharia in Brunei Darussalam in a monarchical political configuration. This study uses qualitative research that analyzes the phenomenon of the application of sharia in Brunei with a sociological and political approach. The research data comes from a number of documents in the form of the Brunei Constitution, Sharia Penal Code Order 2013 (SPCO), other royal regulations, and online media. Data collection was carried out using documentation techniques which were analyzed by applying the theory of political determination of law developed by Nonet and Selznick and the theory of legitimacy developed by Weber. This study found that the policy of implementing sharia in Brunei through SPCO, under a monarchical political system produced responsive legal products. This policy is based on the people's aspirations as a manifestation of the culture and religious practices of the people of Brunei. The implication is that international attacks on the implementation of sharia in Brunei have met with resistance from the people. The application of sharia nationally further strengthens the political legitimacy of the Sultan of Brunei in maintaining and preserving his power. The people were increasingly loyal to the Sultan, so there was social order without popular opposition.

Abstract

This article explores the role of Indonesia's People's Representative Council (DPR) in shaping Islamic law, employing the Taqnin theory as a guiding framework. Taqnin theory is a crucial conceptual tool in understanding how the DPR contributes to crafting legislation aligning with Islamic principles. Beyond its legislative function, the DPR serves as an interpreter of religious precepts, navigating the intersection between Islamic values and societal needs. By applying Taqnin Theory, the DPR crafts laws in line with Islamic teachings and ensures their relevance within evolving social contexts. The analysis underscores the DPR's role in formulating laws reflecting Islamic values while considering formal legal, moral, and ethical dimensions inherent in Islamic teachings. This process illustrates the active engagement of the DPR in crafting laws that not only address religious imperatives but also respond to social exigencies and communal values. Despite the constructive guidance provided by Taqnin Theory, the article also addresses challenges in its implementation, such as interpretational disparities, community resistance, and political dynamics shaping Islamic law formation in Indonesia. As outlined in the article, the historical trajectory of Islamic law legislation in Indonesia offers insight into its evolution from the colonial era to its integration into the national legal framework. By examining the status of Islamic law in Indonesia, the article delineates the dynamics of a legal system comprising national and customary laws. While Islamic law significantly influences domains such as marriage, inheritance, and Sharia-compliant financial institutions, the foundational principles of Pancasila embody a state ethos characterised by inclusivity and tolerance towards religious and cultural diversity. Moreover, the article underscores the positive legal outcomes of applying Taqnin, underscoring its significance in understanding the process of Islamic law formation in Indonesia.

Abstract

The increase in marriage dispensation applications that occurred during the Covid-19 pandemic also caused the high number of child marriage. Nevertheless, this has been strictly required in Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage (Marital Law), the minimum age limit for men and women is 19 years, and requirements of irregularities for this age that must meet urgent criteria and sufficient support evidence. This is done, to reduce underage child marriages as a form of enforcing the principle of children's best interests. This paper describes the complexity of underage children's marriage during the Covid-19 pandemic period, as a convenience requirement of marriage dispensation has been set rigid in the Marriage act. The method used in this paper is normative by using several approaches: the statute approach, conceptual approach, and case approach. The results of the government's policy during the Covid-19 pandemic period which brought massive changes to the community's order had an impact on the collapse of the family economy. This resulted in the mass number of the child's marriages in the pandemic period. The research findings of this study deliver to children's rights violations through child marriages. The risk of decreasing individual economies, maternal and infant health, and household violence become unavoidable considering the psychological conditions of children who are immature in marriage.

Abstract

Abstract. This study analyzes the arguments for maslahah (benefit) and mafsadat (harm) in developing modern Islamic economic law in Indonesia and Morocco by exploring the practice of murabahah in banking. As this study shows, the dialogue between maslahah and mafsadat may result in the notion of emergency and needs (hajiyat) in economic activities. Using document studies, this study finds that maslahah has been used as the foundation of Islamic economic practices. These include the establishment of financial institutions, market mechanisms, hisbah institutions, and the prohibition of foreign exchange speculation. Meanwhile, maslahah al ammah is considered in using dinar and dirham in transactions. Abstrak. Penelitian ini menganalisis argumen maslahah (manfaat) dan mafsadat (kerugian) dalam pengembangan hukum ekonomi Islam modern di Indonesia dan Maroko dengan mengeksplorasi praktik murabahah di dunia perbankan. Studi ini menunjukkan bahwa dialog antara maslahah dan mafsadat dapat menghasilkan pengertian darurat (daruriyat) dan kebutuhan (hajiyat) dalam kegiatan ekonomi. Dengan menggunakan studi dokumen, penelitian ini menemukan bahwa maslahah telah digunakan sebagai landasan praktik ekonomi Islam di Indonesia dan Maroko. Abstract

This research aims to analyze the Islamic legal thoughts of Nahdlatul Ulama (NU) and Muhammadiyah concerning Islamic economics in Indonesia. The research is based on fatwa documents from Lembaga Bahtsul Masail NU  and  Majelis Tarjih Muhammadiyah from 2000 to 2019. This study found that the method of ijtihād used by NU has shifted from a textual-conservative (qawlī) approach to a contextual-progressive and methodological (manhajī) approach. Meanwhile, the method of ijtihād used by Muhammadiyah is characterized as progressive-dynamic, employing three approaches: bayani, taḥlīlī, and istiṣlāḥī. The decisions of LBM NU in Islamic economics predominantly use the qawlī method, followed by the ilḥaqī method, and subsequently, the manhajī method. The qawlī method is most frequently used because it adheres to the procedural stages of NU's traditionalist pattern, where every legal issue is ideally referenced to authoritative madhhab books. If the issue cannot be resolved using the qawlī method, the ilḥāqī and manhajī methods are employed. This indicates that the manhajī method is used when the qawlī and ilḥaqī methods cannot provide a legal answer. On the other hand, Muhammadiyah's MT method in Islamic economics has evolved. Initially, the tarjīḥ methodology was monodisciplinary, referring issues back to the Quran and the Sunnah. Subsequently, the tarjīḥ methodology became monodisciplinary-pretextual by employing various methods. Eventually, the tarjīḥ methodology became multidisciplinary regarding methods, approaches, and techniques. Abstrak: Penelitian ini bertujuan untuk menganalisis pemikiran hukum Islam Nahdlatul Ulama dan Muhammadiyah tentang ekonomi Islam Indonesia. Penelitian ini bersumber dari dokumen fatwa-fatwa Lembaga Bahtsul Masail (LBM) NU dan Mejelis Tarjih (MT) Muhammadiyah selama periode 2000-2019. Studi ini menemukan bahwa metode ijtihad NU mengalami pergeseran yang awalnya bersifat tekstual-konservatif (qawlī) berubah menjadi kontekstual-progresif dan metodologis (manhajī). Sementara itu, metode ijtihad MT Muhammadiyah bersifat progresif-dinamis dengan tiga pendekatan; bayānī, taḥlilī, dan istiṣlāḥī. Keputusan LBM NU dalam ekonomi Islam lebih banyak menggunakan metode qawlī, disusul oleh metode ilḥāqī, dan selanjutnya metode manhajī. Metode qawlī paling sering digunakan karena mengacu pada tahapan prosedur pola bermazhab NU, dimana setiap persoalan hukum sedapat mungkin merujuk pada kitab-kitab otoritatif mazhab. Jika tidak dapat diselesaikan dengan metode qawlī, maka digunakan metode ilḥāq dan metode manhajī. Ini artinya, metode manhajī digunakan dalam kondisi metode qawlī dan ilḥāq sudah tidak mampu memberikan jawaban hukum. Di sisi lain, metode MT Muhammadiyah dalam ekonomi Islam mengalami evolusi. Pada awalnya, manhaj tarjih bersifat monodisiplin dengan mengembalikan persoalan-persoalan umat kepada al-Quran dan al-Sunnah. Manhaj al-tarjīḥ bersifat monodisiplin-pratekstual dengan menggunakan sejumlah metode. Kemudian, manhaj al-tarjīḥ menjadi multidisiplin baik dari aspek metode, pendekatan, dan teknik.

Abstract

Anjing merupakan hewan yang sangat monumental. Dalam dirinya terhimpun sifat baik dan buruk. Dalam sejarah kehidupannya, anjing mempunyai beragam cerita. Ia pernah menjadi sebab bagi seseorang untuk mendapatkan keridlaan dan rahmat Allah SWT, begitu pun sebaliknya ia termasuk binatang yang masuk surga karena menemani sekelompok pemuda yang mempertahankan keimanan di tengah kerusakan moral dan kesyirikan, sebagaimana cerita ashhab al-kahfi. Di sisi lain anjing dianggap sangat menjijikkan, sehingga benda yang terkena jilatan atau sentuhannya dianggap kena najis dengan katagori najis berat (muglalladzah). Oleh karenanya, pendekatan Ta’abbudi dan Ta’aqquli dalam melihat masalah anjing tadi sangat urgen, agar diperoleh sikap arif dari semua pihak, sehingga bisa saling menghargai perbedaan pendapat yang disebabkan oleh sang anjing.
