Abstract

Early marriage is a growing phenomenon in many countries, including countries with a Muslim majority. In the perspective of Islamic law, marriage is a part of worship that is highly valued, but there are provisions that must be considered so as not to harm the parties involved, especially in the context of early marriage. One approach used to assess whether early marriage is permitted or not in Islamic law is through the concept of maslahat mursalat, which is an effort to achieve public welfare that is not explicitly regulated in the Shari'a, but can be taken based on the goals and basic principles of Islam. This paper aims to analyze the application of the concept of maslahat mursalat in the context of early marriage, as well as its implications for the implementation of Islamic law. This study includes an analysis of the social, economic, and health impacts associated with early marriage, and discusses how Islamic law assesses young marriage by considering maslahat and mudarat (benefits and disadvantages). This study also seeks to examine how the orientation of maslahat mursalat can help align Islamic law with the needs of today's society, amidst the challenges of early marriage that often ignore the emotional, social, and physical readiness of individuals. The results of this study indicate that from the perspective of maslahat mursalat, early marriage is only permitted if it meets the criteria of greater welfare and does not bring harm to the parties involved. In addition, policy recommendations regarding early marriage need to consider various factors that support individual welfare, including education, mental readiness, and social and economic support. Therefore, the implementation of early marriage must be carried out carefully and wisely, ensuring that it does not violate the basic principles of Islamic law which emphasize the welfare of humanity.

Abstract

Maraknya kasus penyalagunaan data pribadi untuk melakukan pinjaman pada paylater e-commerce merupakan akibat dari kurang ketatnya sistem keamanan yang dimiliki oleh perusahaan- perusahaan digital di Indonesia, saat ini kasus penyalagunaan data ini menimpa konsumen traveloka, dimana banyak diantara mereka tidak mengaktifkan fitur paylater di aplikasinya namun ketika mereka mengajukan pinjaman ke bank pengajuan mereka ditolak karena nilai kredit yang buruk. Penelitian ini bertujuan untuk menganalisa upaya perlindungan hukum yang diberikan atas penyalagunaan data pribadi konsumen pada fitur traveloka paylater. Penulis menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual yang dianalisis melalui bahan hukum. Berdasarkan hasil penelitian menunjukkan bahwa Traveloka sebagai penyelenggara layanan berperan sebagai pengumpul dan pengelola data konsumen yang wajib melindungi data yang dihimpun sejak data tersebut dikumpulkan hingga data tersebut dimusnahkan. Namun dalam pelaksanaannya, traveloka telah gagal melindungi data konsumen yang mengakibatkan kosumen mengalami kerugian karena data pribadinya digunakan untuk melakukan pinjaman paylater traveloka, sehingga perlu adanya perlindungan hukum bagi konsumen, baik dalam bentuk perlindungan hukum internal atau perlindungan hukum eksternal. Perlindungan hukum internal yang dilakukan dengan melihat perjanjian yang disepakati antara konsumen dan perusahaan traveloka dan ditemukan bahwa terdapat klausula eksonerasi dalam perjanjian tersebut, karena mengilangkan tanggung jawab dari traveloka, jika terjadi penyalagunaan data konsumen, sehingga mengakibatkan perjanjian dapat batal demi hukum. Sedangkan perlindungan hukum eksternal dilakukan dengan memberikan sanksi kepada traveloka selaku pengumpul dan pemroses data pribadi kosumen sesuai dengan ketentuan yang ada dalam Undang-Undang Nomor 27 Tahun 2022 Tentang Pelindungan Data Pribadi.

Abstract

The digital era has had a significant impact on family life, including the way parents interact with their children. While open access to information offers positive opportunities for children's learning, it also raises various issues, such as the potential for technology misuse, exposure to inappropriate content, and a decline in moral values. In the context of Islamic family law in Indonesia, parents' obligations extend beyond meeting material needs to safeguarding children's moral and spiritual well-being. This research focuses on analyzing the role of parents in providing child protection in the digital era, drawing on Islamic and national legal perspectives. The method used is a literature review using a descriptive-qualitative approach and deductive analysis. The research findings confirm that parental responsibility aligns with the five main objectives of the maqāṣid al-syarī‘ah, namely safeguarding religion (ḥifẓ al-dīn), safeguarding the soul (ḥifẓ al-nafs), safeguarding reason (ḥifẓ al-‘aql), safeguarding honor (ḥifẓ al-‘irḍ), and safeguarding property (ḥifẓ al-māl). These values are also in line with the provisions of Law Number 35 of 2014 concerning Child Protection. Therefore, parents are required to be actively involved in the process of educating, supervising, and protecting their children so that they can develop into a generation that is faithful, has good morals, and is capable of utilizing technology.
