Abstract

The disputes resolution in the sharia financial institution gives opportunity and challenge for the Religious Court. Society tends to use ash-shulh by conducting deliberation in solving every dispute. This dispute resolution is taken because of the given legal freedom for society. Its purpose is to analyze the information on opportunities and challenges of the Religious Court as the judicial institution that has absolute authority in solving sharia economic disputes. This is qualitative research by studying secondary data and doing online and offline interviews with the informant. The Religious Court also plays a role in solving the disputes in the sharia microfinance institutions which generally choose the alternative way in disputes resolution by doing the negotiation. The study reveals that the sharia microfinance institutions depend on alternative ways in their dispute resolution such as negotiation and mediation by involving religious figures like Kyai. Madura society puts their trust in the religious figures more than the official institutions appointed in the Supreme Court Regulation No. 1 of 2016 concerning the Mediation in Court. However, the disputes resolution taken by society with the involvement of Kyai, is still based on the decree of the Religious Court in solving sharia disputes as a legal reference and a procedure taken by the judges.Penyelesaian sengketa di lembaga keuangan syariah memberikan peluang dan tantangan tersendiri bagi Pengadilan Agama. Masyarakat memiliki kecenderungan menggunakan ash-shulh dengan cara musyawarah mufakat dalam menyelesaikan setiap sengketa. Upaya penyelesaian sengketa ini dipilih karena kebebasan hukum bagi masyarakat untuk memilih jalan penyelesaian sengketa. Penelitian ini dilakukan dengan menggunakan metode kualitatif melalui data sekunder serta wawancara kepada informan, baik secara online maupun offline. Hasil dan pembahasan menunjukkan bahwa lembaga keuangan mikro syariah memilih jalur alternatif penyelesaian sengketa seperti perundingan dan mediasi dengan melibatkan melibatkan seorang tokoh agama seperti Kyai. Masyarakat Madura lebih percaya terhadap tokoh agama dibandingkan lembaga resmi yang telah ditetapkan oleh Peraturan Mahkamah Agung Nomor 1 tahun 2016 tentang Mediasi di Peradilan. Namun, penyelesaian sengketa yang diambil masyarakat dengan melibatkan Kyai, tetap mengacu pada keputusan pengadilan agama dalam menyelesaikan sengketa syariah sebagai acuan hukum dan cara yang diambil oleh para hakim.

Abstract

In line with rapid economic progress, in the world of banking. The main function of banking is as a collector and distributor of public funds. BMT UGT Nusantara distributes funds to the community in the form of financing products. The development of financing can cause problems that must be addressed and resolved. The author is interested in researching financing problems that are in accordance with Islamic banking science. The researcher's curiosity at the heart of the problem is the causes of financing problems at BMT UGT Nusantara and what is the solution to solving financing problems at BMT UGT Nusantara. Research Objectives 1. To find out what are the factors of default in financing at BMT UGT Nusantara head of Batuurip Jember. 2 To find out how to resolve defaults in financing at BMT UGT Nusantara head of Batuurip Jember. The approach taken in this research uses qualitative research, with a case study type of research. Data collection techniques using observation, interviews and documentation, to find out directly from the researcher's location how defaults on financing products are resolved at BMT UGT Nusantara Capem Batuurip. This research concludes that the resolution of defaults that occur at BMT UGT Nusantara Capem Batuurip is by being billed regularly once a week, given a time slot/extension of time, given capital back if collateral allows, and finally the sale of collateral or assets that are guaranteed.

Abstract

The identification of the Madurese local concept, Bhuppa’-Bhâbhu’-Ghuru-Rato, is a part of the conflict resolution instrument based on social construction theory. This concept serves as a strong foundation underlying the social relationships and moral structure of the Madurese community, which remains deeply rooted in various aspects of daily life. This research aims to analyze the significant role of the socio-cultural value system of the Madurese community in shaping the behavioral compliance of Madurese families. The research is qualitative in nature, relying on both primary and secondary data. Primary data is obtained from field studies, including direct observations and mapping of research aspects. The research findings indicate that there has been controversy in the interpretation of threats related to social inequality, economic family issues, and the pandemic already experienced. This interpretational controversy has been caused by differences in understanding, conflicting interests, and varying traditions or practices. Differences in understanding are evident from the varying levels of comprehension between groups in the community, which also highlights differences in literacy levels when interpreting these issues. The four important elements of Bhuppa’-Bhâbhu’-Ghuru-Rato play a vital role in controlling and providing guidance through families to enhance compliance. These elements are actualized in daily praxis as binding normative rules.

Abstract

This study aims to describe integrated curriculum management in Ma’had Tahfiz al-Qur'an Al-Amien Prenduan, Sumenep, Indonesia, including integrated curriculum planning, integrated curriculum implementation, and integrated curriculum evaluation. This study uses a qualitative approach with case study. The data collection is conducted with participatory observation, interview, and documentation. Data analysis uses data reduction techniques, data presentation, and conclusion. The results of the research in Ma'had Tahfiz al-Qur’an Al-Amien Prenduan are: 1) integrated curriculum planning are applied by integrating the objectives of the pesantren curriculum, tahfiz al-Qur’an curriculum, and school curriculum, as well as integrating the curriculum content organizing by grouping common subject, dirasat islamiyah, and tahfiz Qur'an. 2) Implementation of an integrated curriculum are done by unifying the education calendar and academic activity plans, both pesantren, tahfiz, and schools, as well as the integration of supervision. 3) Integrated curriculum evaluation which include: a) evaluation of curriculum context, b) evaluation of curriculum input, c) evaluation of curriculum process and d) evaluation of the curriculum products.

Abstract

Fintech lending in Indonesia is experiencing rapid growth, but there are significant variations in growth dynamics between Java, outside Java, and overseas segments. This study aims to explore and project the growth patterns of Islamic and conventional fintech using spatial-temporal analysis. Quantitative research methods were applied with data analysis of the number of lender accounts and funds disbursed from January 2022 to May 2024. Results show that Java experienced market consolidation with an increase in disbursed funds, while outside Java showed moderate growth, and the overseas segment experienced high fluctuations but with significant expansion potential. Policy implications include the need for increased penetration outside Java, development of a cross-border regulatory framework, and incentives for fintech innovation. The findings highlight the importance of diversified policies to support inclusive growth and stability of the national financial system.
