Abstract

Penelitian ini bertujuan untuk meneliti dan menganalisis Bagaimana kedudukan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris terhadap Penyimpanan Protokol Notaris Berbasis digital Dan Apa akibat yang akan timbul apabila notaris mengunakan teknologi digital dalam praktiknya. Metode penelitian yang digunakan dalam penelitian ini menggunakan metode penelitian hukum normatif. Sumber bahan hukum primernya adalah Undang-undang Nomor 2 Tahun 2014 tentang jabatan notaris dan peraturan perundang-undangn tentang teknologi digital yang di atur dalam Undang-undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik serta Undang-undang nomer 43 tahun 2009 tentang kearsipan. sumber bahan hukum sekundernya menggunakan Bahan hukum sekunder terdiri dari buku- buku atau teks hukum, hasil penelitian hukum, jurnal hukum. hasil penelitian menunjukkan, perlu dibuatkan peraturan mengenai penyimpanan protokol notaris digital, agar mengatur mekanisme, standar, dan legitimasi hukum penyimpanan protokol notaris secara digital.

Abstract

This research analyzes the legal consequences of not removing Fiduciary guarantees registered in the online system in the province of Bali. The implementation of the elimination of Fiduciary guarantees registered in the online system is the obligation of Fiduciary recipients as creditors, this provision is regulated in Article 16 paragraph (2) of Government Regulation Number 21 of 2015 concerning Procedures for Registration of Fiduciary Guarantees And the cost of making a Fiduciary Guarantee Deed. However, in practice there are still fiduciary recipients, namely creditors who do not fulfill their obligations to abolish the fiduciary guarantee after the fiduciary giver, namely the debtor, has fulfilled all his achievements. There is no sanction that regulates related if the Fiduciary recipient does not eliminate the Fiduciary guarantee which results in this obligation being disobeyed. The study of this research is related to the implementation of the elimination of Fiduciary guarantees registered in the online system and the legal consequences of the negligence of the Fiduciary recipients for not notifying the Fiduciary guarantee deletion to the Minister registered in the online system. The method used is an empirical legal research method. The analytical knife of legal issues in this thesis is the theory of legal effectiveness, the theory of legal certainty and the theory of legal protection. The results that can be concluded in this study are if the Fiduciary recipient, his proxy or his representative does not notify the removal of the Fiduciary guarantee, then the Fiduciary guarantee concerned cannot be re-registered.

Abstract

Praktek ibu pengganti (surrogacy) di Indonesia masih menjadi isu yang kompleks dan belum memiliki regulasi yang jelas. Jurnal ini bertujuan untuk membahas berbagai aspek hukum terkait ibu pengganti, ditinjau dari aspek hak asasi manusia, aspek hukum kesehatan, analisis berdasarkan hukum perjanjian, dan tinjauan dari perspektif moral dan etika. Penelitian ini merupakan penelitian hukum normatif, menggunakan pendekatan peraturan perundang-undangan, pendekatan perbandingan dan pendekatan konseptual. Sebagai pisau analisis menggunakan teori hak asasi manusia dan teori utilitas dari Jeremy Bentham bahwa hukum harus memberi kebahagiaan bagi umat manusia. Bahwa Praktik surrogate mother di Indonesia menimbulkan dilema hukum, etika dan moral untuk itu dibutuhkan kajian yang mendalam agar dapat menghasilkan regulasi yang jelas dan komprehensif untuk melindungi hak dan kepentingan semua pihak yang terlibat surrogate mother. Regulasi tersebut harus mempertimbangkan aspek hukum, etika, moral dan sosial terhadap praktik surrogate mother.

Abstract

The Marriage Law, which fundamentally aims to make divorce difficult, when confronted with the reality of a high divorce rate in the Denpasar District Court, indicates concerns about the erosion of the sanctity of marriage. This transformation of the sanctity of marriage towards an undesirable direction is undoubtedly worrisome. Stemming from this issue, the research aims to analyze the sanctity of marriage and the role of the judicial system in preserving the sanctity of marriage by preventing and complicating divorce. This research employs empirical legal research methods. The procedures involve collecting data consisting of factual or social phenomena and legal norms. Primary data collection includes observation to gather data on divorce cases, followed by interviews with informants who are judges at the Denpasar District Court and lawyers who have litigated at the same court. Additionally, a questionnaire was administered to 29 respondents through a focus group discussion. In addition to primary data, the study also collects secondary data derived from legal regulations and related literature. The collected data is then analyzed using qualitative techniques to provide sound arguments in analyzing the research issues. The research findings indicate that the sanctity of marriage originates from its validation based on religious and cultural customs. The bitter reality of the high number of divorce cases in the Denpasar District Court suggests a decline in the understanding of marriage sanctity. To optimize marital sanctity, three solutions are proposed in this study: maximizing the role of judges at the Denpasar District Court in earnestly preventing divorce in every session, reforming mediation regulations to make them mandatory without exceptions, and fostering societal efforts to understand the importance of preserving marital sanctity.

Abstract

Digital nomadism has emerged as a growing trend within the global tourism landscape, offering unique opportunities for Bali’s cultural tourism sector. By attracting remote workers who seek immersive travel experiences, Bali can develop cultural tourism rooted in local wisdom, thus revitalizing its tourism industry. This approach is particularly relevant as the sector recovers from the severe impacts of the Covid-19 pandemic. However, technological advancements have provided support to the tourism and creative economy sectors in navigating the pandemic. The purpose of this research is to understand the legal impacts and government influences on the concept of cultural tourism in Bali. This study employs normative legal research based on secondary data. The research focuses on analyzing legal standards to provide fresh claims, hypotheses, or ideas as guidelines for addressing issues, making it a more in-depth study. The findings indicate that the presence of digital nomads in Bali significantly impacts the preservation of cultural tourism centered on tradition and local wisdom. While this phenomenon brings positive economic effects, such as increased consumption and local investment, the negative impacts on culture and the environment must also be considered. The commercialization of culture, changes in social landscapes, value conflicts, and environmental pressures are the main challenges for Bali in maintaining its cultural identity.

Abstract

Law No. 22 of 2009 concerning Traffic and Road Transportation in Article 106 paragraph (1) states that every person who drives a vehicle is obliged to obey traffic regulations and create road safety. But in reality, there are still traffic violations, especially illegal modifications to motor vehicles that endanger the safety and comfort of other drivers. Empirical legal research, or law as a social or cultural reality, is the methodology used. The conclusion of this study is that there are two methods used by law enforcement to combat traffic violations and unauthorized modifications to motor vehicles: indirect action, which involves giving warnings to violators. Law enforcement efforts and challenges, including repressive, preventive, and anticipatory measures. Factors of facility or infrastructure constraints and, factors of community constraints.

Abstract

This study aims to analyze the urgency of reformulating tourism policy in Bali in order to address environmental damage and the erosion of local culture. The mass tourism development model that has been implemented thus far has proven to have negative effects, such as infrastructure overcapacity, ecosystem degradation, and the commodification of sacred values. Using normative legal research methods, this study examines laws and regulations related to sustainable tourism and cultural preservation. The results show a gap between regulations and implementation that requires a review of the basic principles of tourism policy. Reformulation must emphasize tourism based on the values of Tri Hita Karana, limit quantity, improve quality, and involve the active participation of local communities in management and supervision.

Abstract

Tourism development in Bali increasingly confronts structural challenges generated by the persistent tension between economic growth imperatives, environmental sustainability, and the preservation of local cultural identity. However Bali’s Spatial Planning Regulation (RTRW) 2023–2043 integrates the Tri Hita Karana philosophy and the principle of “one island, one plan, one management,” its implementation remains constrained by fragmented inter-agency coordination, limited law enforcement capacity, and a development orientation that privileges economic interests over socio-ecological balance. In response, this study examines how an integrated spatial governance framework can harmonize national legal instruments with local wisdom to support sustainable tourism development in Bali. Using a normative juridical research method, the study employs conceptual analysis, statutory review, and comparative legal approaches. The findings demonstrate, first, that local regulatory instruments, particularly awig-awig and community-based zoning mechanisms, contribute significantly to maintaining spatial equilibrium and protect cultural identity and environmental values at the community level. Second, the study finds that the effectiveness of these local instruments remains limited by inadequate formal regulatory recognition and weak alignment with central government mechanisms, including risk-based business licensing systems and spatial conformity approval processes. Third, comparative analysis of Thailand’s sustainable tourism governance, especially the Designated Areas for Sustainable Tourism Administration (DASTA) model, reveals that effective spatial governance depends on robust multi-actor collaboration and institutional coherence that formally integrates local governance structures within designated tourism areas.

Abstract

Good Corporate Governance (GCG) dan kepatuhan finansial merupakan elemen penting dalam memperkuat keberlanjutan perusahaan, meningkatkan nilai perusahaan, serta melindungi kepentingan investor. Namun, hubungan antara kedua variabel tersebut dalam konteks dinamika regulasi di Indonesia masih relatif terbatas, terutama setelah reformasi sektor keuangan yang ditandai dengan pembentukan Pusat Finansial Internasional Indonesia (PFII). Penelitian ini bertujuan menganalisis pengaruh penerapan GCG dan kepatuhan finansial terhadap nilai perusahaan dan perlindungan investor, sekaligus menguji peran moderasi dinamika regulasi. Penelitian menggunakan pendekatan hukum normatif-empiris dengan desain yuridis sosiologis yang mengintegrasikan analisis hukum dan analisis kuantitatif. Analisis empiris dilakukan terhadap 150 perusahaan yang terdaftar di Bursa Efek Indonesia (BEI) selama periode 2019–2026 menggunakan teknik purposive sampling. Data sekunder diperoleh dari laporan tahunan, laporan keuangan, laporan keberlanjutan, dan Corporate Governance Perception Index (CGPI), sedangkan data primer diperoleh melalui wawancara dengan regulator, praktisi hukum, akademisi, dan pejabat kepatuhan perusahaan. GCG diukur menggunakan skor CGPI, proporsi komisaris independen, dan efektivitas komite audit; kepatuhan finansial diukur melalui kepatuhan perpajakan dan kualitas pelaporan keuangan; nilai perusahaan diproksikan dengan Tobin's Q; perlindungan investor diukur melalui kepemilikan institusional dan volume perdagangan; sedangkan dinamika regulasi diukur menggunakan variabel dummy perubahan regulasi. Analisis dilakukan menggunakan regresi data panel dan Moderated Regression Analysis (MRA). Hasil penelitian menunjukkan bahwa GCG dan kepatuhan finansial berpengaruh positif dan signifikan terhadap nilai perusahaan serta perlindungan investor. Dinamika regulasi terbukti memoderasi hubungan tersebut, sehingga pada masa transisi regulasi manfaat tata kelola cenderung menurun akibat biaya adaptasi dan kepatuhan. Abstract

The issue on violence and discrimination against child and female workers in Indonesia remains significant to date. The government aims to protect children and women, prevent violence and discrimination, and address these issues through legal instruments and other promotion. This study centers its objective on identifying the factors contributing to human rights violations against child and female workers, as well as promotion to prevent and address these violations. The study employs normative juridical methods and data collection techniques based on journals, articles, laws, and conceptual approaches. The results indicate that poverty, culture, low levels of education, and economic pressure are factors contributing to human rights violations against children. The marginalization of women in the workplace, their subordinate position in society and culture, stereotypes against them, low education, patriarchal culture, and the interests of the authorities are all factors behind human rights violations against female workers. Promotion to prevent such violations include making laws regarding the protection of children and women, among other measures. Keywords: Child and Female Workers, Human Rights, Legal Protection
