Abstract

Penelitian ini bertujuan untuk meneliti dan menganalisis Bagaimana kedudukan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris terhadap Penyimpanan Protokol Notaris Berbasis digital Dan Apa akibat yang akan timbul apabila notaris mengunakan teknologi digital dalam praktiknya. Metode penelitian yang digunakan dalam penelitian ini menggunakan metode penelitian hukum normatif. Sumber bahan hukum primernya adalah Undang-undang Nomor 2 Tahun 2014 tentang jabatan notaris dan peraturan perundang-undangn tentang teknologi digital yang di atur dalam Undang-undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik serta Undang-undang nomer 43 tahun 2009 tentang kearsipan. sumber bahan hukum sekundernya menggunakan Bahan hukum sekunder terdiri dari buku- buku atau teks hukum, hasil penelitian hukum, jurnal hukum. hasil penelitian menunjukkan, perlu dibuatkan peraturan mengenai penyimpanan protokol notaris digital, agar mengatur mekanisme, standar, dan legitimasi hukum penyimpanan protokol notaris secara digital.

Abstract

The issue on violence and discrimination against child and female workers in Indonesia remains significant to date. The government aims to protect children and women, prevent violence and discrimination, and address these issues through legal instruments and other promotion. This study centers its objective on identifying the factors contributing to human rights violations against child and female workers, as well as promotion to prevent and address these violations. The study employs normative juridical methods and data collection techniques based on journals, articles, laws, and conceptual approaches. The results indicate that poverty, culture, low levels of education, and economic pressure are factors contributing to human rights violations against children. The marginalization of women in the workplace, their subordinate position in society and culture, stereotypes against them, low education, patriarchal culture, and the interests of the authorities are all factors behind human rights violations against female workers. Promotion to prevent such violations include making laws regarding the protection of children and women, among other measures. Keywords: Child and Female Workers, Human Rights, Legal Protection

Abstract

This research analyzes the legal consequences of not removing Fiduciary guarantees registered in the online system in the province of Bali. The implementation of the elimination of Fiduciary guarantees registered in the online system is the obligation of Fiduciary recipients as creditors, this provision is regulated in Article 16 paragraph (2) of Government Regulation Number 21 of 2015 concerning Procedures for Registration of Fiduciary Guarantees And the cost of making a Fiduciary Guarantee Deed. However, in practice there are still fiduciary recipients, namely creditors who do not fulfill their obligations to abolish the fiduciary guarantee after the fiduciary giver, namely the debtor, has fulfilled all his achievements. There is no sanction that regulates related if the Fiduciary recipient does not eliminate the Fiduciary guarantee which results in this obligation being disobeyed. The study of this research is related to the implementation of the elimination of Fiduciary guarantees registered in the online system and the legal consequences of the negligence of the Fiduciary recipients for not notifying the Fiduciary guarantee deletion to the Minister registered in the online system. The method used is an empirical legal research method. The analytical knife of legal issues in this thesis is the theory of legal effectiveness, the theory of legal certainty and the theory of legal protection. The results that can be concluded in this study are if the Fiduciary recipient, his proxy or his representative does not notify the removal of the Fiduciary guarantee, then the Fiduciary guarantee concerned cannot be re-registered.

Abstract

Praktek ibu pengganti (surrogacy) di Indonesia masih menjadi isu yang kompleks dan belum memiliki regulasi yang jelas. Jurnal ini bertujuan untuk membahas berbagai aspek hukum terkait ibu pengganti, ditinjau dari aspek hak asasi manusia, aspek hukum kesehatan, analisis berdasarkan hukum perjanjian, dan tinjauan dari perspektif moral dan etika. Penelitian ini merupakan penelitian hukum normatif, menggunakan pendekatan peraturan perundang-undangan, pendekatan perbandingan dan pendekatan konseptual. Sebagai pisau analisis menggunakan teori hak asasi manusia dan teori utilitas dari Jeremy Bentham bahwa hukum harus memberi kebahagiaan bagi umat manusia. Bahwa Praktik surrogate mother di Indonesia menimbulkan dilema hukum, etika dan moral untuk itu dibutuhkan kajian yang mendalam agar dapat menghasilkan regulasi yang jelas dan komprehensif untuk melindungi hak dan kepentingan semua pihak yang terlibat surrogate mother. Regulasi tersebut harus mempertimbangkan aspek hukum, etika, moral dan sosial terhadap praktik surrogate mother.

Abstract

Tourism development in Bali has increasingly faced challenges arising from the tension between economic growth, environmental sustainability, and the preservation of local cultural identity. Despite the integration of the Tri Hita Karana philosophy and the “one island, one plan, one management” principle into Bali’s Spatial Planning Regulation (RTRW) 2023–2043, weak inter-agency coordination, limited law enforcement, and an economy-centered approach continue to undermine implementation. This study employs a normative juridical method, drawing on conceptual, legislative, and comparative approaches, to examine how integrated spatial governance can harmonize national legal frameworks with local wisdom. The analysis reveals that local instruments such as awig-awig and community-based zoning play a significant role in maintaining spatial balance. However, their effectiveness remains constrained without regulatory support and alignment with central government mechanisms such as OSS-RBA and KKPR. Comparative insights from Thailand demonstrate the importance of multi-actor collaboration and institutional coherence through models like DASTA (Designated Areas for Sustainable Tourism Administration), which integrates local governance into sustainable tourism zones. Accordingly, an integrated spatial governance model for Bali should provide clear local autonomy, participatory spatial mapping, and inclusive consultation forums to ensure legal synchronization and community-based monitoring. Such an approach positions spatial policy not merely as an economic instrument but as a practical pathway to uphold ecological integrity, cultural identity, and spatial justice in sustainable tourism development.
