Abstract

The existence of political parties is a means of governing political communication and government, namely the community. The function of political communication is intended as one party that formulates interests (interests articulation) and challenges or distributes interest (aggregation interest) of the community to be conveyed and fought for by the government through available channels, while in other positions it also explains and disseminates government policies to the public (specifically member of the political party concerned). Law Number 2 of 2011 concerning Amendments to Law Number 2 of 2008 concerning Political Parties, requires legal entities or new political parties to register as legal entities in accordance with Law Number 2 of 2011 concerning Political Parties, This is a circle to further institutionalize the structure of national political party management. Therefore, the provisions of article 3 paragraph (2) stipulate that political parties become police bodies that have a police force of atleast 75% of the total provinces, 50% of the total number of districts/ cities in each province that discuss, and 50% of the total number of sub-districts in each province, district/ city in the area concerned.

Abstract

Tujuan dari penelitian ini adalah adalah untuk mengetahui faktor-faktor apa saja sehingga Petugas Pemasyarakatan dengan mudahnya meloloskan peredaran narkotika di Lembaga Pemasyarakatan Kelas II A Karawang dan untuk mengetahui pencegahan peredaran narkotika di Lembaga Pemasyarakatan Kelas II A Karawang. Dalam penulisan skripsi ini penulis menggunakan jenis penelitian yuridis empiris yaitu penelitian hukum yang bertujuan untuk melihat bagaimana bekerjanya hukum di masyarakat terhadap fakta hukum yang terjadi di lapangan dengan melakukan metode pengumpulan data dari wawancara dan observasi. Faktor-faktor penyebab petugas pemasyarakatan dengan mudah meloloskan peredaran narkotika lapas yaitu kelalaian petugas pemasyarakatan dalam melakukan penggeledahan pengunjung lembaga pemasyarakatan yang belum dilakukan secara menyeluruh sehingga mudah untuk dikelabuhi oleh pengunjung lembaga pemasyarakatan, sarana dan prasarana, dan kualitas SDM petugas pemasyarakatan. Pencegahan peredaran narkotika di lembaga pemasyarakatan kelas II A Karawang dengan yaitu dengan memaksimalkan penggeledahan dan melakukan pendataan narapidana yang tersangkut masalah narkotika. Kemudian yaitu Pihak Kepolisian dapat melakukan sidak secara mendadak yang dilakukan secara rutin bersama petugas pemasyarakatan dan melaksanakan pembinaan narapidana untuk membentuk kepribadian di Lembaga Pemasyarakatan Kelas II A Karawang yaitu pembinaan keagamaan, pembinaan kesadaran dalam berbagsa dan bernegara, dan pembinaan intelektual

Abstract

Dinamisnya perekonomian Pasar Modal pada suatu negara, merupakan wadah bagi para pengusaha swasta dan BUMN dalam pengembangan usahanya. Salah satu hal yang sangat mendasar dalam industri pasar modal adalah keberadaan prinsip keterbukaan informasi sebagai prinsip yang harus dijaga dan diatur untuk kepentingan semua pihak yang terlibat dalam industri pasar modal, untuk menjaga kepercayaan investor lokal maupun asing. Penelitian ini mengangkat tentang perlindungan hukum bagi investor melalui penerapan prinsip-prinisp keterbukaan informasi di pasar modal Indonesia. Penelitian ini merupakan penelitian hukum normatif (doktrinal) dengan pendekatan perundang-undangan dan juga studi kasus. Hasil penelitian menunjukkan prinsip-prinsip keterbukaan informasi di pasar modal Indonesia yang dituangkan dalam UUPM No.8 Tahun 1995 dan beberapa POJK dalam hal keterbukaan informasi yang wajib dilakukan oleh para Emiten. Dan pengaturan POJK ini perlu dilakukan penyesuaian dengan perkembangan dan dinamika pasar modal di Indonesia. Ini menunjukkan bahwa penerapan prinsip-prinsip keterbukaan informasi terus dioptimalkan dalam memberikan perlindungan hukum bagi investor, dan memberikan efek jera bagi para emiten yang melakukan pelanggaran dimaksud

Abstract

Fiduciary security agreements grant creditors the right to execute secured assets without prior judicial authorization, provided that the security has been duly registered and evidenced by a Fiduciary Security Certificate under Law No. 42 of 1999. However, the execution of fiduciary collateral in debtor default disputes continues to raise questions regarding the limits of creditor authority and the protection of debtor rights. This study examines the legal basis and procedural mechanism of fiduciary security execution in cases of default, with particular attention to the principles of legal certainty, utility, and justice. Employing a normative legal method, the research analyzes statutory provisions, doctrinal interpretations, and judicial reasoning, focusing on Decision No. 297/PDT.G/2023/PN Bpp. The findings indicate that courts recognize the enforceability of fiduciary execution without litigation when formal registration requirements are satisfied, while rejecting additional claims such as material damages and coercive penalties due to insufficient legal grounds. The study concludes that fiduciary execution remains legally valid within the existing statutory framework but must be conducted proportionally and in a manner that respects debtor protections. Clear procedural standards and consistent oversight are therefore necessary to ensure a balanced and predictable secured transactions regime.

Abstract

Copyright is an essential instrument within the Intellectual Property Rights (IPR) system, providing legal protection for works of art, literature, and science, including the economic and moral rights of the creator. In Indonesia, copyright regulation has evolved from Law No. 6 of 1982 to Law No. 28 of 2014, which affirms that copyright arises automatically based on the declarative principle and grants creators exclusive rights to exploit, use, and derive economic benefits from their works. This study employs a normative legal method by examining primary, secondary, and tertiary legal materials, including relevant legislation and court decisions. Copyright protection plays a crucial role in ensuring that creators receive recognition, control, and economic benefits from their works. The use of artistic works for commercial products without permission, such as the silhouette sketch of the “Tugu Selamat Datang” by PT Martina Berto Tbk, constitutes a violation of the creator’s economic and moral rights. Law No. 28 of 2014 emphasizes that copyright arises automatically once a work is realized, so any adaptation or use of a work still requires permission from the rights holder. The analysis indicates that copyright protection is vital for preventing unilateral exploitation of artistic works, ensuring legal certainty for creators, and promoting compliance within the creative industry
