Abstract

Copyright is one part of intellectual property that has the widest scope of protected objects. The rapid development of information and communication technology requires rules that support copyright, especially with the rampant piracies. Therefore, copyright must have a legal protection as other rights. This paper is dedicated to outlining the concept of piracy of works in the field of copyright using an integrated review of Islamic law and the Indonesian Law No. 28 of 2014 concerning Copyright. By using a deductive framework and normative approach, this paper formulates one finding that copyright piracy even though there are no clear and standard rules in Islamic law, by using analogy (qiyās) method, the copyright rule is in accordance with the law against the perpetrator of theft (saraqah). However, because a pirator of copyrights is not the same as a theft, its rule enters ta’zīr domain where all provisions for sanctions are determined by the government. In Indonesia, the actualization of sanctions is regulated in Law No. 28 of 2014, which essentially strives to create justice and guarantee of every individual right that leads to widespread benefit. Islamic law (in this case saraqah rules) becomes the theological basis for Law No. 28 of 2014 in a normativity context, where the integration points of Islamic law and Indonesian law can be established.

Abstract

Qat'i and zanni consist of two elements; al-thubut (the truth of the source) and al-dalalah (meaning). There are no differences in arguments about the truth of the Al-Qur'an source. The problems are in the contents since it depends on the intellectual capacity of mufassir.

Abstract

Contemporary discussion among Moslem scholars about the way to understand, interprest, and apply al-Qur’an in daily life is based on a belief that al Qur’an as the last bible of God’s revelation can be adjusted at anytime and anywhere. It accordance to understand God’s revelation objectively, moslems have to concern about the language and socio-cultural setting factors.

Abstract

Kehidupan masyarakat pada masa kejayaan Islam tertata mapan dan teratur terutama di bidang ekonomi. Jaminan sosial (daman ijtima’i) menjadi salah satu kunci kejayaan ekonomi tersebut. Ibn Hazm (384-456 H / 994-1064 M) merupakan seorang pemikir muslim yang turut meyumbangkan pemikirannya dalam konsep jaminan sosial. Makalah ini mengulas tentang adanya kewajiban bagi kaum kaya (aghniya’) untuk menanggung kebutuhan orang miskin (fuqara/masakin). Pemerintah sebagai penyelenggara jaminan sosial wajib menjamin kebutuhan dasar (basic needs) seperti sandang, pangan, perumahan, dan rasa aman kepada orang miskin. Sumber utama pendapatan negara yang dapat dikelola untuk membiayai program ini adalah dari dana zakat, dan harta muslim lainnya yang terkumpul dalam bait al-mal. Kemudian pemerintah mempunyai otoritas mengambil tindakan hukum terhadap warga yang tidak mau membayar zakat.

Abstract

Now the issue of ijtihad proposed as one of the key themes of reform efforts and refreshment understanding of religion. Ibn Hazm perform ijtihad in certain respects a more contextual approach, rather than textual. This means, he was prosecuted for not only active and proactive, but at the same time progressive. Methodology renewal of Islamic religious thought, according to Ibn Hazm always connects normativitas tradeoffs between the dimensions of the verses of the Qur'an and Sunnah as the dimensions of the historicity of understanding these verses at the level of socio-historical life of the local muslim community.

Abstract

The objective revelation of Islamic law is to create public interest (maṣlaḥat), both individually and collectively. The public interest that mentioned in Islamic law is the true goodness, not the pseudo benefit which influenced human desires. The Public interest here includes physical and spiritual. The public interest that intended by Islamic law is the goodness in this life and in the hereafter, not solely in the world live. maslahah in the Shariah perspective is based on five principles called al-mabādi'al-khamsah or al-uṣūl alkhamsah namely: keeping religion (hifẓ al-dīn), keeping the soul (hifẓ al-nafs), keeping mind (hifẓ al-‘aql), keeping property (hifẓ al-māl), and keeping descent (hifẓ al-nasl). Maqāṣid al-sharī’ah implementation of some economic problems is to answer the reality of modern society to face the challenges of basic needs such as clothing, food, shelter, health, education, employment, sanitation, energy, transport and information. Crucial needs of modern man is the spiritual and ethical, because modern society only measure the welfare just from the outer side only, that is to meet the needs according to the principle of utility and pragmatism

Abstract

This research is motivated by the DSN-MUI Fatwa Number 108/DSN-MUI/X/2016 as the basis for the concept of halal tourism in the trend of sharia tourism management models, sharia tourism development in Baturraden Banyumas. The research method used in this study is the constructivist paradigm used to see the phenomenon of community behavior around tourist sites. The results showed that the tourism potential in Baturraden Banyumas to be developed into sharia tourism. First, the public can understand the meaning of sharia tourism, tourism is carried out for recreational purposes in accordance with the concept of halal tourism in the DSN - MUI fatwa. Second, tourism activities and tourist sites are sufficiently protected from immoral activities, only a few things need to be improved, namely the application of the rules of no dating and the implementation of a stricter curfew. Third, tourist sites are quite comfortable and safe. Fourth, in tourist sites there are many facilities for places of worship, restaurants, souvenir shops.

Abstract

The advent of globalization, ushering in the era of Society 5.0, has turned marriage events into a focal point of cultural dynamics. An example of this is evident in the celebration of weddings, known as walīmatul ‘urs. This study delves into the walīmatul ‘urs festivities organized by various Muslim celebrities in Indonesia. While these celebrities uphold the Islamic marital contract, they also hold extravagant wedding ceremonies infused with Western-inspired themes that come with significant costs. This study is a qualitative phenomenological study with an approach to Islamic law. This study analyzes media content to get an overview of the phenomenon of marriage among celebrities. The data collection process uses three techniques: observation, interviews from digital sources, and documentation. This study concludes that the purpose and main meaning of walīmatul ‘urs according to Islamic family law is as a sacred and strong bond (mithāqan ghalīdhan), a form of expression of gratitude to God and happiness in addition to providing benefits to society. The meaning of walimatul 'urs then underwent a shift in essence in the context of Indonesian Muslim celebrities, which were partly influenced by technological advances in the Society 5.0 era. Open (explicit) and implicit transformations and shifts in interpretation, when walimatul 'urs develops into a symbolic representation of social status, which is often characterized by luxury and functions as a venue to elevate one's social status.

Abstract

The emergence of the term sandwich generation is believed to be a phenomenon that is common in Indonesian society. What's more, the number of baby boomers has become a concern both from a social and economic perspective for the generations below them. Therefore, many dilemmas arise regarding how the Indonesian people respond to sandwich generation, whether this position is a burden or a gift for the perpetrators of sandwich generation. This paper will later answer how the history of the emergence of the term sandwich generation and its development in Indonesia and the perception of sandwich generation on Islamic law perspective. This study uses a qualitative method by collecting library data sourced from related books and journals so as to produce a discussion where the term sandwich generation is a generation that directly supports the generation above and below (the other two generations). The current sandwich generation has actually existed for a long time, even in the era of Prophet Muhammad SAW. The concept of sandwich generation can be interpreted the same as the concept of birrul walidain or devoted to parents. Of course, the concept of birrul walidain is a practice that is highly recommended to be done for every Muslim.
