Abstract

Science and technology are increasingly developing rapidly and advancing, offering various interactions in human life. Information and communication technology continues to develop in the digital era, especially the internet, which has a big influence on people's life patterns. The development of the internet has triggered the emergence of a type of cyber crime which is usually known as Cyber Crime. Various cases of cyber crime (Cyber Crime) have emerged in Indonesia, especially in the banking sector. In the following years until now, in Indonesia there have been many incidents of Cyber Crime, for example computer program piracy, cracking, bank burglary (banking fraud), unauthorized use of other parties' credit cards (carding), pornography, including crimes against domain names (domain names). Cyber Crime could happen because unlimited internet access. Apart from that, computer user negligence is also often the cause of this Cyber Crime. This is something that is often overlooked, namely a weak network security system. In fact, a weak network security system creates a big loophole for people who intend to commit crimes. Currently, what is used as the legal basis for Cyber ??Crime cases in Indonesia isLaw Number 11 of 2008 concerning Information and Electronic Transactions (ITE). The ITE Law consists of 13 chapters and 54 articles which explain in detail the rules for living in cyberspace and the transactions that occur therein. Prohibited acts (cybercrime) are explained in Chapter VII (Articles 27-37)

Abstract

In this article, the author discusses the issues pertaining to piracy jure gentium and armed robbery at sea. Focus shall be given on the incidence of both crimes occurring offshore Somalia during a certain time period. It is noted that Somalia is unable or unwilling to enforce its law to protect international (commercial) shipping passing through its waters. This inability to enforce the law has been the primary reason, Somalia was forced to seek legal assistance from the international community. By taking lessons from Somalia and comparing these two crimes, the author seeks to propose a model of how to tackle the problem at hand. To be discussed and analysed is a number of United Nations Security Council Resolutions which provide the international community with a guideline how to handle both crimes.

Abstract

Technological advances and high human activity in the field of aviation have the potential to cause violations of a country’s air sovereignty. One of which is the flight of Chinese hot air balloons without a valid permit in the air space of the United States. The research aims to analyze, explain and determine the form of enforcement of United States airspace sovereignty against Chinese hot air balloons based on the 1944 Chicago Convention Concerning International Civil Aviation. This research is normative juridical research in which the data is explained descriptively qualitatively. The results of this research show that China has violated the sovereignty of United States air space by flying its hot air balloons without permission over United States air space. Chinese hot air balloons are among the state aircraft used to spy on the United States, so they are called spy craft. The shooting carried out by the United States was necessary to uphold its sovereignty and maintain the security of its air space. The shooting down of the Chinese hot air balloon has raised diplomatic tensions between the two countries. Therefore, this problem should be resolved further through the Council of the International Civil Aviation Organization (ICAO) so that both countries can obtain firm rights and sanctions for violations that have been committed.

Abstract

War and conflict have become an inseparable part of human history. One of the victims of war is children who are actually the forerunners of the continuation of life and the future of mankind .It is on this basis that various provisions in international law emerged to recognize children's rights and protect children from armed conflicts, including the 1989 Convention on the Rights of the Child. Nevertheless, exploitation of children in armed conflicts still occurs in various parts of the world. This study aims to re-examine the mechanism of child protection in the 1989 Convention on the Rights of the Child and related provisions and to look at its implementation and weaknesses in order to find solutions to increase the effectiveness of implementing these provisions. The main source of this research is the 1989 Convention on the Rights of the Child and its additional Protocols, accompanied by UN reports on various gross violations of children's rights in various countries.Based on the results of the research, it was found that in various countries in the world the number of uses of children in armed conflicts is still very concerning, Thus, it was concluded that a better approach and more concrete efforts from various parties are needed to reach a resolution and stop conflicts that continue to victimize children.

Abstract

Although Law Number 6 of 2014 concerning Villages gives authority to the Village Head and Village Consultative Body to be able to form Village Regulations, in fact no Village Regulations have been produced. The objectives of this activity include: a) providing knowledge about aspects that need to be regulated in Village Regulations; b) providing knowledge about the process of forming Village Regulations; c) providing knowledge and skills to find and determine problems that can be regulated in a Village Regulation; and d) providing knowledge about the systematics, sentences and legal language in Village Regulations. This activity was carried out using the survey method, briefing and interactive question and answer/dialogue which were divided into two stages, namely the preparation stage and the implementation stage. This activity involved 40 participants consisting of the Village Head, Village Apparatus, Village Consultative Body (BPD), and the community. The training activity on Village Regulation drafting techniques in Penfui Timur Village is a solution for solving the problems faced. Through this activity, it is hoped that there will be an increase in knowledge and skills in drafting Village Regulations in Penfui Timur Village.

Abstract

Tri Dharma Perguruan Tinggi menetapkan kewajiban para dosen untuk melakukan pengajaran, pengabdian, dan penelitian. Pengabdian ini dilakukan selain untuk menyebarluaskan ilmu pengetahuan kepada setiap lapisan masyarakat, juga untuk membagikan hasil penelitian yang telah dilakukan terlebih dahulu. Meskipun hasil penelitian tersebut juga telah dipublikasikan lewat jurnal, namun penyelenggara menyadari bahwa terdapat keterbatasan pembaca jurnal maka perlu dilakukan sosialisasi dengan mempergunakan media siaran radio. Adapun tujuan dari sosialisasi adalah setelah  kegiatan pengabdian ini, masyarakat mengetahui berbagai bentuk kerjasama yang dapat dilakukan negara-negara untuk menangkap dan mengembalikan terpidana TIPIKOR yang kabur ke luar negeri. Metode kegiatan ini adalah dengan mempergunakan radio sebagai media penyebarluasan informasi. Radio dipilih karena merupakan media yang masih banyak dipergunakan masyarakat umum dalam kesehariannya, dan dapat menjangkau berbagai lapisan masyarakat. Hasil kegiatan sosialisasi kerjasama internasional dalam menangkap terpidana TIPIKOR yang kabur ke luar negeri, yang diselenggarakan pada 27 Agustus 2024 di Radio Suara Kupang 96 FM, menunjukkan pentingnya hukum internasional dalam menangani pelarian terpidana ke negara-negara seperti Singapura. Diskusi meliputi urgensi mempelajari hukum internasional, tantangan ekstradisi, dan pentingnya kerja sama antarnegara. Selain itu, topik seperti Red Notice, perbedaan ekstradisi dan deportasi juga dibahas, memberikan pemahaman tentang proses hukum internasional dan upaya internasional untuk melacak pelaku kejahatan lintas negara. Dari kegiatan pengabdian ini disimpulkan bahwa terdapat keterbatasan yurisdiksi negara dalam melaksanakan penegakan hukum bagi terpidana TIPIKOR yang melarikan diri ke luar negeri.

Abstract

This paper examines the regulation of piracy and armed robbery at sea in international law applicable globally and applicable only in a certain region. This research will review the elements of piracy and armed robbery at sea then made a distinction between both crimes. It will be found that there are problems that still not legally regulated in existing international regulation concerning piracy and armed robbery at sea or it has been regulated but still cause a problem in the prosecution of both crimes. It is a normative research which concludes that the regulation of armed robbery at sea is found only in regional international legal rules, unlike the regulation of piracy that exists in international rules that applied globally. The existing regulations leave problems concerning areas where a crime such as piracy-like act will be difficult to categorize as piracy or armed robbery at sea.

Abstract

One country that is often a transit country for people seeking asylum elsewhere is Indonesia. Due to its location, Indonesia can become an illicit trade corridor and a stopover for people seeking asylum in Australia. As the influx of these refugees is deemed to pose a danger to national security and resilience, these illegal arrivals are certainly bad for Indonesia. Every person entering or leaving Indonesia is required by law to have a valid travel document. Indonesian laws and regulations governing the treatment of international refugees are inadequate. The purpose of this study is to analyse the role of IOM in fulfilling the basic needs of refugees in Kupang City in terms of Presidential Regulation Number 125 of 2016 concerning the handling of refugees from abroad". Normative-Empirical (applied) legal research. Researchers apply qualitative data analysis methods. The approaches used in this legal research are statutory approach, historical approach and conceptual approach. The result of this research is that IOM in Indonesia has supported the Indonesian government in its efforts to overcome migration problems, both domestic and international. In Indonesia, IOM fulfils its policies regarding protection and a rights-based approach, by assisting migrants and refugees directly in accordance with the references or referrals given by the Indonesian Government to IOM. As a country that did not ratify the 1951 Refugee Convention, Indonesia still respects the rights of refugees including the right to fulfil basic needs for refugees in Kupang City. As referred to in Presidential Regulation No. 125 of 2016 concerning the handling of refugees from abroad.
