Abstract

Penelitian ini bertujuan untuk mengetahui kriteria yang bisa menjadi korban pencemaran limbah oleh rumah sakit, untuk mengetahui dan menganalisis upaya hukum yang dilakukan terhadap pencemaran limbah oleh rumah sakit, dan untuk mengetahui tanggung jawab pihak rumah sakit terhadap pencemaran limbah. Hasil penelitian: bahwa (1) Korban atas pencemaran limbah oleh rumah sakit adalah manusia, binatang, tumbuhan dan perairan serta lembaga yang berada di sekitar pembuangan limbah oleh rumah sakit tersebut, termasuk pula lembaga rumah sakit itu sendiri. (2) Upaya hukum yang dapat dilakukan adalah dengan memberikan sosialisasi atas pengelolaan dan perizinan IPLC (izin pengelolaan limbah cair) dan TPS (tempat penyimpanan sementara) limbah bahan beracun dan berbahaya (B3) dan memberikan sanksi bagi Rumah Sakit yang melakukan pencemaran lingkungan. (3) Tanggungjawab dari Pihak Rumah Sakit dapat berupa evaluasi kinerja pihak Rumah Sakit agar mematuhi prosedur yang telah ditetapkan dan memenuhi perizinan sepertu AMDAL, IPAL, IPLC dan TPS limbah bahan beracun dan berbahaya (B3). This study aims to determine the criteria that can be victims of waste pollution by hospitals, to know and analyze legal efforts made against waste pollution by hospitals, and to determine the responsibility of the hospital for waste pollution. The results of the study: that (1) Victims of waste pollution by hospitals are humans, animals, plants and waters as well as institutions that are in the vicinity of waste disposal by the hospital, including hospital institutions themselves. (2) Legal efforts that can be carried out are by providing socialization on the management and licensing of IPLC (liquid waste management permit) and TPS (temporary storage place) of toxic and hazardous material (B3) waste and imposing sanctions on Hospitals that pollute the environment. (3) The responsibility of the Hospital can be in the form of evaluating the performance of the Hospital in order to comply with established procedures and fulfill permits such as AMDAL, IPAL, IPLC and TPS for toxic and hazardous waste (B3).

Abstract

In making an authentic deed, the Notary must guarantee certainty, order, and legal protection based on Law Number 2 of 2014. This research aims to determine the indicators so that the Notary can be held accountable for the contents of the Authentic Deed he made and explain the form of accountability that can be imposed on Notary regarding the contents of the Authentic Deed, which are inconsistent with the facts. The type of research used in this research is normative research and is supported by interview data. This study uses a statutory approach, a case approach, and a comparative approach. This study uses secondary data sources consisting of primary, secondary, and tertiary legal materials. The method of analysis in this study is to use qualitative analysis. The results show that the indicator so that the Notary can be held accountable for the contents of the Authentic Deed he makes is the intention or negligence of the Notary in making the authentic deed. Furthermore, the forms of accountability that can be passed on to the Notary for the contents of the Authentic Deed that are not following the facts, among others, are Civil, Criminal, and Administrative Liability/Code of Ethics. Based on these conclusions, it is recommended that notaries make authentic deeds based on morals, ethics and prudence, thoroughness, objectivity, and good faith to comply with all applicable legal provisions. Besides, it is necessary to renew the Law related to the cumulation or incorporation of the application of sanctions as a form of accountability for a notary public because the regulation of the cumulation or merger of the application of these sanctions will undoubtedly provide more protection and legal certainty for the injured parties, including the Notary itself.

Abstract

This study aims to analyze the role of madrasah head management in improving the quality of Islamic Religious Education (PAI) teachers at Madrasah Ibtidaiyah Muhammadiyah Buntu Barana, Enrekang Regency. The primary focus of the research is to identify the management strategies implemented by the madrasah head, measure the impact of such management on teacher performance, and discover the supporting and inhibiting factors in the management implementation. The research employs a qualitative descriptive method with data collection techniques including observation, interviews, and documentation. Research participants consist of the madrasah head, PAI teachers, and administrative staff directly involved in the management and development of teacher competencies. The research findings indicate that the madrasah head plays a strategic role in enhancing PAI teacher competencies through various professional development programs, such as internal and external training, as well as regular evaluations of teacher performance. The management strategies applied involve a transformational leadership approach, where the madrasah head not only provides direction and supervision but also serves as an inspiration for teachers to continue learning and improving the quality of education. The main supporting factor in the implementation of this management is the commitment of the madrasah head and the collaborative spirit among teachers. However, challenges such as limited facilities and financial resources still pose significant obstacles. In conclusion, effective management by the madrasah head has a significant impact on improving the quality of PAI teachers. To strengthen these outcomes, ongoing efforts are needed in teacher capacity development, enhancing external collaboration, and optimizing available resources.
