Abstract

Indonesia merupakan negara dengan sistem pemerintahan presidensil, sehingga Presiden memiliki kekuasaan yang besar sebagai Kepala Negara dan Kepala Pemerintahan. Dalam rapat BPUPKI tersebut diusulkan adanya jabatan Wakil Presiden. Ide awal jabatan Wakil Presiden menyatakan bahwa jabatan Wakil Presiden menjalankan fungi pembantuan atas jabatan Presiden. Pada tahun 2005 Wakil Presiden Jusuf Kalla mengeluarkan Surat Keputusan Wakil Presiden tentang Pembentukan Tim Nasional Penanganan Bencana Aceh. Adanya Surat Keputusan Wakil Presiden tersebut menimbulkan kontroversi karena dalam hukum tata negara Indonesia yang memiliki kewenangan mengeluarkan Surat Keputusan pada tataran lembaga eksekutif tingkat pusat hanyalah Presiden dan Menteri, kejadian tahun 2005 tersebut melahirkan istilah “matahari kembar”. Penelitian ini merupakan penelitian yuridis normatif, dengan pendekatan berupa statute approach dan hitorical approach, data dikumpulkan melalui studi pustaka dan kemudian dianalisis secara kualitatif. Hasil penelitian menyatakan bahwa kedudukan Wakil Presiden dalam Undang-Undang Dasar Tahun 1945 tidak secara tegas diatur, tetapi dapat diartikan bahwa Wakil Presiden merupakan pembantu sekaligus pendamping Presiden, dalam sistem presidensil dikenal prinsip concentration of power and responsibility upon the President, sehingga Wakil Presiden bertanggungjawab kepada Presiden. Diperlukan adanya pengaturan yang jelas mengenai batasan dan hubungan kerja Presiden dengan Wakil Presiden serta adanya pengaturan pertanggungjawaban Wakil Presiden agar jabatan Wakil Presiden benar-benar dirasakan oleh masyarakat.

Abstract

The process of forming regulations is often not in line with existing theories. Based on Article 56 paragraph (2) of Law Number 12 of 2011, it basically states that Regional Regulations need to be accompanied by information and/or Academic Papers. This can raise doubts about the position and importance of Academic Manuscripts in the preparation of the Draft Regional Regulations. The results of the study state that the position of the Academic Manuscript in the formulation process of the current Regional Regulation formation is a mandatory requirement to provide a scientific basis to support data-based decision-making and objective analysis for the making of Regional Regulations that reflect community participation. After the promulgation of Law Number 13 of 2022, the preparation of Academic Manuscripts not only applies normative juridical and empirical juridical methods, but should also be accompanied by an impact analysis method from the presence of Regional Regulations that are being prepared through the RIA and ROCCIPI methods.

Abstract

Children are important national asset who require special protection from all forms of violence, including sexual crimes. Although Indonesia has established legal framework at both national and international levels, sexual violence against children remains a persistent problem. The imposition of severe criminal sanctions, including chemical castration, has not sufficiently addressed the problem and produced an optimal deterrent effect. Consequently, child protection continues to face various challenges, particularly in relation to post-sentencing supervision of offenders, low public awareness, and limited access to victim assistance services. The research questions of this study are: how effective is the legal protection for child victims of sexual violence, and what constitutes an effective supervisory model for offenders after serving their sentences in order to prevent recidivism? This study employs legal research with a socio-legal approach, combining normative juridical analysis with perspectives from information technology and social sciences. The findings indicate the need to strengthen post-sentencing supervision through the development of a Three-Pillar Supervision Model that integrates legal, technological, and societal dimensions. This model includes the optimization of technologies such as GPS tracking and public databases, the strengthening of regulatory frameworks, and the societal involvement in early detection mechanisms. The implementation of this model is expected to reduce the risk of recidivism and strengthen sustainable protection for children. Accordingly, reform of the child protection system must be carried out in a collaborative, preventive, and sustainable manner to ensure justice and security for future generations.

Abstract

The bloated structure of government bureaucracy, characterized by overlapping authorities among ministries, significantly impacts inefficiency in policymaking, resource wastage, and inter-ministerial conflicts, ultimately slowing down public services and disadvantaging society. This study aims to explore the application of lean governance principles as an approach to streamline the bureaucratic structure of state ministries, focusing on waste reduction and workflow optimization. This study employs a normative juridical method with a doctrinal approach to analyze and understand the principles of lean governance in the context of efficient public administration. Data were collected through a literature review encompassing legal literature, scholarly journals, and relevant policy documents. The data analysis was conducted qualitatively using a descriptive-comparative method to assess the alignment of regulatory frameworks governing ministerial authority with the principles of lean governance. The implications of this study include the need for regulatory adjustments to support authority restructuring and enhanced information technology to improve transparency and accountability. Consistent implementation of lean governance is expected to create a more responsive and adaptive government, ultimately fostering greater public trust in the public sector.

Abstract

Transitions of presidential powers often create policy uncertainty, which can disrupt the stability of the administration of government and violate the principle of legal certainty. State administrative law, as the main instrument in maintaining policy stability, has not been fully effective in ensuring policy continuity in Indonesia during the transition of power. The study aims to analyze the role of state administrative law in maintaining the continuity of public policy during the presidential transition of power. Using normative legal research methods, the study analyzed various regulations, such as Law Number 30 of 2014 on Government Administration, as well as conducting comparative studies with administrative legal systems in the United States and Germany. The results show that, despite efforts to provide a clear legal foundation for policy continuity, implementation on the ground is still weak, especially in terms of oversight and policy evaluation procedures. Countries such as the United States and Germany have succeeded in creating systems that allow policy continuity during the transition of power through stronger oversight mechanisms and transparent evaluations. The implication of this study is the need to reform administrative law in Indonesia, by adding more specific regulations to ensure policy stability and protect public interests during the transition of power.
