Abstract

Sebagai pemikir pembaharuan, Muhammad ‘Abduh telah menawarkan suatu paradigma dalam pemikiran hukum Islam dengan menepatkan akal sebagai basis utama dalam menginterpretasi pesan-pesan al-Qur’an dan as-Sunnah. Subtansi yang ditekankan dalam merespon berbagai perubahan yang terjadi adalah memproduk hukum Islam yang sejalan dengan missi ajaran yang diperjuangkan Rasulullah, yakni terwujudnya kemaslahatan dan kesejahteraan umat. Atas dasar paradigma inilah ‘Abduh menilai dibolehkannya poligami dalam ajaran Islam merupakan tindakan yang dibatasi dengan persyaratan yang sangat ketat, hal itu menunnjukkan, praktek poligami merupakan tindakan darurat. Dari ketatnya persyaratan yang harus dipenuhi untuk berpoligami, menurutnya, sangat kecil kemungkinan untuk memenuhinya di era modern ini, apalagi, praktek poligami acapkali diikuti oleh akibat negatif yang dapat berakibat pada rusaknya tatanan kehidupan rumah tangga yang bertujuan kedamaian dan ketentraman. Karena itu menurutnya, poligami merupakan suatu tindakan yang tidak boleh (haram) kecuali dalam hal-hal tertentu. Agaknya, ‘Abduh berpendapat bahwa asas monogami merupakan salah satu asas perkawinan dalam Islam sebagai landasan dan modal utama dalam membina keharmonisan kehidupan rumah tangga.

Abstract

The existence of the effort of the Islamic family law reform in a number of Muslim countries in the 20th century has resulted a number of Islamic law, which has been conceived and began to change, though many of the changes are not so radical. One of the changes is the emergence of the open principle of monogamous as manifested in Undang-Undang No. 1 year 1974 about marital contract. It is mentioned that the original principle of marriage is monogamous. However, in the next article, Undang-Undang about marital contract is likely to open a way for husband to do polygamy which is then called an open principle of monogamous. In fact, there is a similarity between understanding of classical jurisprudence and Undang-Undang of marital contract, it is allowing conducting polygamy. However, Undang-Undang of marital contract initiates that every husband who wants to be polygamous must gain the permission from religion court. This permission is the intersection between both since it is a manifestation of one of the conditions that must be met by a husband when he is about polygamy, which is fair to all wives. The purpose of all above considerations is indeed to minimize the chance of conducting polygamy that is in line with the purpose of the renewal of Islamic law itself, namely the improvement of the woman's status. [Adanya usaha pembaharuan Hukum Keluarga Islam di sejumlah negara Muslim pada abad ke-20 ini mengakibatkan sejumlah pokok-pokok Hukum Islam yang selama ini dipahami, mulai mengalami perubahan, meskipun banyak dari perubahan tersebut tidak begitu radikal (mendasar). Salah satu perubahannya adalah munculnya asas monogami terbuka dalam perundang-undangan perkawinan di Indonesia. Undang-undang No.1 Tahun 1974 Tentang Perkawinan menyebutkan, bahwa asas perkawinan itu monogami. Akan tetapi, pada pasal selanjutnya, UU Perkawinan tersebut masih membuka jalan bagi para suami yang ingin berpoligami. Inilah yang dinamakan asas monogami terbuka. Pada dasarnya, pemahaman dalam fikih klasik dan pemahaman dalam UU Perkawinan tidaklah berbeda, yakni sama-sama membolehkan poligami. Hanya saja, UU Perkawinan berinisiatif agar setiap suami yang hendak berpoligami, harus melalui izin pengadilan. Izin pengadilan inilah yang menjadi titik temu antara UU perkawinan dan fikih klasik, karena dalam izin pengadilan mangandung manifestasi salah satu syarat yang harus dipenuhi oleh suami tatkala hendak berpoligami, yakni adil terhadap semua istri. Tujuan daripada semua ketentuan tersebut adalah mempersempit peluang terjadinya poligami sehingga berbanding lurus dengan tujuan pembaharuan Hukum Islam itu sendiri, yakni peningkatan status wanita di abad ini.]

Abstract

The reasons for divorce in law of marriage in Indonesia, which has been formalized in Law no. 1 year 1974 and Compilation of Islamic Law, can be searched in munakahat Islamic jurisprudence. It is bacause both of material and formal law in Religious Courts are very accommodating to the implementation of Islamic Law, either directly or implicitly. During the time, the difference interpretation about the provisions of Article 39 paragraph (2) of Law No. 1 Year 1974 about marriage jo Article 19 Government Regulation No. 9 of 1975 jo Article 116 letter (f) Compilation of Islamic Law on continuous disputes always becomes polemic. Even the reasons for this dispute or argument dominate divorce decisions at various levels of the Religious Courts. Though there is no clear measure of this reason so it is natural that the Bangkalan Religious Court’s decision NO.0774/PDT.G/2013/PA.bkl was canceled by the Surabaya Religious High Court for the reason of this kind of divorce. Therefore it is necessary to prove that the decision taken by the judge on dispute or argument has met the criteria of nusyuz and syiqaq. In addition, the theory of benefit and maqasid of Shari’ah are also important for the consideration. This article is a review of the judge’s consideration of the Surabaya Religious High Court in canceling the decision of the Bangkalan Religious Court which decided a divorce by the reasons of continuous dispute and quarrel. [Alasan-alasan perceraian dalam hukum perkawinan di Indonesia yang sudah diformalkan dalam UU No. 1 tahun 1974 maupun Kompilasi Hukum Islam bisa dicari akarnya dalam fiqh munakahat. Karena pada dasarnya, hukum materiil maupun formil di Peradilan Agama sangat mengakomodir berlakunya Hukum Islam, baik secara langsung atau secara tersirat saja. Selama ini, perbedaan penafsiran mengenai ketentuan pasal 39 ayat (2) Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan jo Pasal 19 huruf (f) Peraturan Pemerintah Nomor 9 tahun 1975 jo Pasal 116 huruf (f) Kompilasi Hukum Islam tentang perselisihan dan pertengkaran terus-menerus selalu menjadi polemik. Bahkan alasan perselisihan atau pertengkaran ini mendominasi putusan-putusan perceraian di berbagai tingkat Peradilan Agama. Padahal tidak ada ukuran yang jelas tentang alasan ini sehingga wajar jika Putusan PA Bangkalan NO.0774/PDT.G/2013/PA.bkl dibatalkan oleh PTA Surabaya karena alasan perceraian yang satu ini. Maka dari itu perlu dibuktikan bahwa putusan yang diambil oleh hakim mengenai perselisihan atau pertengkaran sudah memenuhi kriteria Nusyuz dan Syiqaq. Selain itu, kemaslahatan dan maqashid Syari’ah juga penting untuk pertimbangan. Abstract

Islamic family law does not recognize ‘iddah (waiting period) for a husband. However, in Indonesia, he is culturally recommended to postpone remarrying until the completion of his wife's ‘iddah. This article discusses conceptualizing the husband's ‘iddah using the fatwa approach of the Indonesian Women’s Ulema Congress (KUPI). Employing a conceptual and philosophical approach, this article explores secondary data through KUPI's three main fatwa approaches: ma’ruf, mubadalah, and ultimate justice. This article demonstrates that the husband's 'iddah can be deemed obligatory. First, from the ma’ruf perspective, the husband's remarriage during the 'iddah period often harms her due to neglect in providing post-divorce financial support. Second, from a mubadalah standpoint, postponing remarriage after divorce should ideally apply to both husband and wife, allowing psychological reflection space for parties. Third, in the context of ulitimate justice, the husband's remarriage during the ‘iddah period violates the principles of true justice in fulfilling and protecting the rights of women and children. This is because women and children experience more significant and prolonged psychological and social discrimination than men. In this context, mandating ‘iddah for husbands through KUPI's fatwa approach is a pertinent recommendation in Indonesian Islamic legal reform.

Abstract

Conflict between students is an unavoidable dynamic in the school environment, especially at the primary and secondary education levels. If not managed properly, these conflicts can have a negative impact on students' social-emotional development and disrupt the creation of a conducive learning atmosphere. This study is motivated by the importance of conflict management as part of strategic efforts in creating child-friendly schools. The purpose of this study is to analyze the forms of conflict between students, evaluate the conflict management strategies used by the school, and assess the effectiveness of the approach in creating a safe, inclusive and comfortable educational environment for all learners. This study uses a descriptive qualitative approach with data collection techniques in the form of observation, in-depth interviews, and documentation in one of the public elementary schools that implement a child-friendly school program. The results showed that conflicts that often occur are related to differences of opinion, academic competition, and social dynamics. Conflict management strategies implemented include mediation by teachers, student discussion forums, and habituation of tolerance and empathy values. The conclusion of this study states that conflict management based on a humanist and participatory approach is proven to be able to reduce the intensity of conflict and strengthen social relations between students.

Abstract

Islamic education has an important role in shaping human life goals in accordance with monotheistic values. The integration of the concept of human life goals in the formulation of Islamic education aims to create an educational system that not only focuses on academic aspects, but also shapes the character and spirituality of students. This research uses a qualitative method with a library research approach, which examines various literature, journals, and references related to Islamic education and the concept of human life goals from an Islamic perspective. In addition, this study also analyzes the principles of Islamic education in shaping human life goals and how to integrate these concepts in the Islamic education curriculum. The results of the study show that the ideal Islamic education must combine religious and general science, apply learning methods based on spiritual reflection, and create a conducive educational environment. The role of educators, families, and the government is crucial in supporting the implementation of this concept. With the right integration, Islamic education can produce a generation that is knowledgeable, moral, and has an awareness of their life goals according to Islamic teachings. Therefore, synergy between various parties is needed to realize Islamic education that is able to form individuals who contribute to Islamic society and civilization
