Abstract

Waqf is a form of Islamic socio-religious worship which is highly recommended for Muslims, because waqf will always distribute rewards to those who donate it even though the person concerned has died. While swapping waqf is replacing the waqf property with other assets because there is benefit or indeed it must be replaced which in Islam is known as istibdal. The problems examined in this study are first, how is the practice of implementing swaps for waqf land at the Andurrahman al Jamil prayer room in Bumen Hamlet, Bumirejo Village, Mojotengah District, Wonosobo Regency. Second, how is the law of the swap practice from the perspective of Imam As-Shafi'i. to find out whether the practice of swapping is in accordance with the As-Shafi'i Madzhab or not. This research uses field research methods with data analysis and processing on objects that compare the law of Imam As-Syafi'i with the practice of swapping rolls that occur in the Bumen, Bumirejo, Mojotengah, Wonosobo neighborhoods. The results of the first study show that in the practice of exchanging waqf land that took place at the Abdurrahman Al Jamil Mosque, Bumen Hamlet, Bumirejo, Mojotengah, Wonosobo, it was a practice of exchanging waqf land at the Al Jamil Mosque and the land of one of the residents as an extension of the Abdurrahman Mosque. The reason for this exchange is to maintain the continuity of the benefits and objectives of the Al Jamil mosque waqf because the mosque is not well managed. Second, when viewed from the perspective of Imam Syafi'i this practice is not in accordance with Islamic law stipulated by Imam Syafi'i. In his opinion, the practice of back-and-forth is not allowed. The stated permissibility of swapping is not a law, but only as an alternative so that the sustainability of the benefits is not lost (more maslahah).

Abstract

This article focuses on the issue of the Indonesian Ulema Council’s (MUI) fatwa regarding boycotting products affiliated with Israel, with a focus on the epistemological construction of MUI fatwa No. 83 of 2023. To answer this problem, this article uses the theory of ijtihād. Considering that the type of research is literature with the data source being MUI fatwa 83 2023, then it is analyzed using descriptive analysis. From the results of this research, it can be concluded that the fatwa is a form of Indonesia’s support for the Palestinian struggle, one of which is an appeal to boycott products affiliated with Israel. In deciding this Fatwa, the MUI used the reasoning of Bayānī, Ta’līlī, and Iṣtislaḥī.

Abstract

Control of the pawned coconut object over the damaged plants around the pawned object. The pawnbroker demands compensation for the damage to his plants around the pawned coconut tree. The purpose of this study is to examine how the control of the parties who carry out plant pawn transactions is exercised and how the legal responsibility is when damage occurs to the plants around the collateral object. This type of research is in the form of field research in the Lima Kaum Batusangkar area of ​​Indonesia. This study is descriptive qualitative with a case study approach. Primary sources from both parties who carry out the coconut tree pawn agreement. Secondary sources from the local community. Data collection techniques through in-depth interviews and observations. Analysis techniques with qualitative descriptive analysis. Findings from the field show that the pawnbroker still has power over the land where the coconut grows and plants young plants in the form of cayenne pepper around the area, while the pawn recipient also has power over the coconut fruit that has been pawned to him. This study concludes that compensation for damaged plants cannot be justified according to Custom, because the cayenne pepper plants prevent the pawn recipient from taking the fruit, in line with the pawn recipient's power, which includes the boundaries of the coconut tree land attached to immovable objects (land). According to Islamic jurisprudence, this is a naqish (limited time) property right, only one of which is owned (material or benefit).

Abstract

Zakat is not merely a category of normative worship but also an aspect of mu’āmalah characterized by its adaptability. This notion is evident in the efforts of the National Zakat Agency (BAZNAS) of Kendal District to modernize zakat law, going far beyond what is stipulated in classical naṣ and fiqh. The modernization of zakat law at BAZNAS Kendal, the main focus of this article, is explored through empirical juridical research using a philosophical re-actualization approach, extensive interpretive analysis, and the theory of maqāṣidi ijtihād. The study finds that modernization is apparent in initiatives to mandate zakat from corporations as zakatable entities, with allocations for distribution in forms such as creative consumptive zakat for installing clean water facilities, creative productive zakat in the form of microfinance, and zakat for community development. Methodologically, Baznas Kendal employs the principles of maqāṣid al-shariֿ’ah, evident in its efforts to link normative zakat teachings (naṣ) with various dynamics of modern life (al-wāqi’) and considerations of social welfare as the essence of shari’a presence. Therefore, this study contributes to the reconstruction of pre-modern zakat law formulations whose conceptualization is no longer visible in the modern era into something more contextually meaningful, and it deepens the understanding of the conceptual framework for the modernization of zakat law that adheres to maqāṣid al-shariֿֿ’ah. Zakat bukan saja katagori ibadah kenormatifan yang given, melainkan juga mu’amalah dengan karakter adaptability (keberubahan). Anggapan ini terlihat dalam upaya Badan Amil Zakat Nasional (Baznas) Kabupaten Kendal memodernisasi hukum zakat jauh melampaui apa yang tertertuang dalam naṣ maupun fiqh klasik. Modernisasi hukum zakat di BAZNAS Kab. Kendal sebagai fokus utama dalam artikel ini menggunakan jenis penelitian yuridis empiris dengan pendekatan reaktualisasi filosofis dan analisis interpretatif ekstensif, dan teori ijtihād maqāṣidī. Penelitian ini menemukan bahwa modernisasi hukum terlihat pada upayanya mewajibkan perusahaan sebagai objek yang dikenai zakat, sementara alokasi distribusinya dalam bentuk: zakat konsumtif kreatif berupa pemasangan saluran air bersih, dan produktif kreatif berupa zakat micro finance, serta zakat community development. Secara metodologis Baznas Kendal menggunakan dalil maqāṣid al-shari’a, hal ini terlihat pada upayanya mengaitkan antara ajaran normatif zakat (naṣ) dengan berbagai faktor dinamika kehidupan modern (al-wāqi’), serta pertimbangan kemaslatan sosial sebagai intisari kehadiran shari’a. Dengan demikian penelitian ini berkontribusi merekonstruksi formulasi hukum zakat pramodern yang konseptualisasinya tidak lagi visible di masa modern menjadi lebih memberi makna aplikasi kontekstualnya, serta memperdalam pemahaman kerangka konsepsional modernisasi hukum zakat berbasis maqāṣid al-shariֿֿ’ah.
