Abstract

Introduction: Cases of criminal acts of sexual abuse against children, especially those handled by the Central Maluku Police, from 2021 to 2023, there were 9 (nine) cases of criminal acts of sexual abuse.Purpose of the Research: This research aims to enable investigators to know the child's personality and make it easier to carry out examinations. At the Central Maluku Police, since the start of the investigation process, children as victims of criminal acts of sexual abuse have not received rehabilitation either physically, psychologically or socially from P2TP2A Central Maluku.Methods of the Research: This type of research is normative juridical research using several approaches including the statutory approach, conceptual approach and case approach, using primary, secondary and tertiary legal material sources. Collection procedures The legal material used in this writing is a literature study (Library Research), which is descriptive qualitative in nature. In carrying out the study, this research also conducted interviews with police officers at the Women and Children Protection Unit at the Central Maluku Police.Result of the Research: The legal protection efforts carried out by the Central Maluku Police against children as victims of criminal acts of sexual abuse include the following: Confidentiality of the victim's identity; rehabilitation efforts; victims are entitled to legal aid and other assistance: providing protection and assistance during the prosecution investigation process until the trial process; obtaining information about the progress of the trial and always monitoring the development of the situation from the area where the victim lives; taking steps to cooperate with police ranks from various regions and from the Maluku Police; providing motivation and providing the best solution for the lives of children; and establishing communication and providing supervision for victims of criminal acts of sexual abuse who are still undergoing the process or who have completed the process. The obstacles faced by the Central Maluku Police in providing legal protection to children as victims of criminal acts of sexual abuse include law enforcement factors; community factors; facilities or facilities factors; cultural factors; and legal factors.

Abstract

Introduction: There are several types of theft crimes ranging from ordinary theft crimes (Article 362 of the Criminal Code), light theft crimes (Article 364 of the Criminal Code), crimes of aggravated or qualified theft (Article 363 of the Criminal Code), crimes of violent theft (Article 365 of the Criminal Code), crimes of theft in within the family (Article 367 of the Criminal Code) with a maximum sentence of 7 years in prison.Purposes of the Research:Analyzing and reviewing the application of Article 363 Paragraph (1) of the Criminal Code in resolving cases of theft and Analyzing Article 363 Paragraph (1) of the Criminal Code can be used as a basis for consideration in cases of theft with violence, as one of the requirements in completing studies at the Faculty of Law.Results of the Research:In the application of article 363 in the case of theft, the elements of article 363 can be applied, namely: Whoever, Takes something, With the intention of being owned, is against the law and is carried out at night in a house or a closed yard with a house. When all the elements in article 363 are met, the perpetrator's actions are determined as theft with weights but in the decision N0 18/Pid.B/20202/PN Msh this is not the case because the judge's decision is still too light even though the defendant's actions meet the weighting elements. Article 363 can be used as a basis for judges' considerations because the elements in Article 363 can be used by judges as a basis for consideration before the judge decides on a theft case, but in decision N0 18/Pid.B/20202/PN, the judge does not see the elements that have been fulfilled. by the defendant's actions so that the judge handed down a decision that was not in accordance with the provisions of Article 363 of the Criminal Code.

Abstract

Introduction: So far, rehabilitation sentences have been imposed for narcotics abuse through the mechanism of examination in court and through a judge's decision or judge's decision based on a Supreme Court Circular.Purposes of the Research: This writing aims to examine and analyze the Implementation of the Prosecutor's Dominus Litis Principle in Completing the Handling of Narcotics Abuse Crime Cases and the Obstacles Faced in the Implementation of the Prosecutor's Dominus Litis Principle in Completing the Handling of Narcotics Abuse Crime Cases.Methods of the Research: The type of research in this research is empirical juridical, in other words, it is a type of sociological legal research and can also be called field research, which examines the legal provisions that apply and what actually happens in society. Supporting data and information are then identified and then systematized for interpretation and given arguments to draw conclusions on the problem.Results of the Research: The results of this study indicate that the implementation of the prosecutor's dominus litis principle in completing the handling of cases of criminal acts of narcotics abuse at the Ambon District Attorney's Office, that the implementation of the Attorney General's Guidelines Number 18 of 2021 cannot be applied. From an internal point of view, the Attorney General's Office prefers to proceed with the prosecution stage for several existing narcotics cases. The obstacles faced in implementing the principle of Dominus Litis Prosecutors in completing the handling of cases of criminal acts of narcotics abuse at the Ambon District Attorney. Which led to JA Guideline No. 18 and No. 11 has not been implemented at the Ambon District Attorney.

Abstract

Introduction: The traffic accident that happened to DH (18), a member of the community from Laha Village, Teluk Ambon District, was declared dead after the motorcycle he was driving was hit by a car driven by an RT is a crime that is not a minor crime as stated in the State Police Regulations Republic of Indonesia Number 8 of 2021 concerning the Handling of Crimes Based on Restorative Justice, however this case was resolved peacefully, and investigators stopped the legal process.Purposes of the Research: The research objective at this writing is to examine and discuss the concept of restorative justice in the criminal justice system. Reviewing and discussing restorative justice that can be applied to traffic crimes that result in the death of victims.Methods of the Research: The research method used is empirical juridical research, which is a type of research used to look at legal aspects of social interaction in society.Results of the Research: The concept of Restorative Justice is applied in the Criminal Justice System, for example the National Police Uses the National Police to issue a Circular of the Chief of Police Number: SE/8/VII/2018 dated 27 July 2018 in order to realize the public interest and a sense of justice for people who do not yet have a legal basis and can be used as a guideline for its implementation and in order to realize the non-uniform understanding and application of restorative justice within the Police. In its development, the National Police issued Republic of Indonesia National Police Regulation Number 8 of 2021 concerning Handling of Crimes Based on Restorative Justice. Restorative Justice can be applied in Traffic Crimes that result in the victim dying, using the basis of the Chief of Police Circular Letter Number: SE/8/VII/2018 which is then amended by Republic of Indonesia National Police Regulation Number 8 of 2021 concerning Handling of Crimes Based on Restorative Justice, and Article 236 of Law Number 22 of 2009 concerning Road Traffic and Transportation, as the basis for application.

Abstract

Hubungan antara suami dengan isteri seharusnya dilandasi dengan nuansa yang harmonis dan bahagia, tetapi pada kenyataanya isteri sering menghadapi tindakan kekerasan oleh suami. Penelitian ini bertujuan untuk mengkaji konsep pencegahan kekerasan dalam rumah tangga (KDRT) yang ideal terhadap perempuan. Metode penelitian yang digunakan adalah yuridis normatif. Berdasarkan hasil penelitian diketahui bahwa konsep pencegahan KDRT yang mana isteri sebagai korban kekerasan dalam rumah tangga ternyata masih menjadi problematis setelah adanya pengaturan dari Undang-undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga, untuk itulah harus dibentuk sebuah sistem pencegahan kekerasan dalam rumah tangga terhadap isteri yang ideal, diantaranya yaitu dengan membentuk kaidah sistem pencegahan dan menyediakan rumah perlindungan yang aman. Kesimpulan penelitian ini yaitu konsep yang ideal yaitu membentuk konsep kaidah hukum sistem  pencegahan pada setiap orang atau manusia, yang mengatur bahwa barang siapa dengan sengaja membiarkan seorang dalam keadaan terancam fisik, psikis, seksual atau terlantar, karena kekerasan fisik maupun verbal, atau membiarkan seorang dalam keadaan luka, sengsara, atau menderita akibat kekerasan fisik, sedangkan menurut hukum yang berlaku ia wajib memberi laporan kepada RT atau RW atau kepala desa atau lurah atau polisi, akan diberikan sanksi hukuman.

Abstract

Keadilan restorative merupakan filosofi hukum yang bersifat umum sehingga perlu adanya penyesuaian dalam ranah implementasinya terhadap masalah-masalah hukum yang konkret seperti masalah kekerasan dalam rumah tangga di Indonesia. Penelitian ini bertujuan untuk membahas tentang implementasi keadilan restorative justice sebagai landasan dalam menyelesaikan masalah kekerasan dalam rumah tangga di Indonesia. Penelitian ini menggunakan metode penelitian yuridis empiris. Berdasarkan hasil penelitian implementasi restorative justice dalam penyelesaian masalah kekerasan dalam rumah tangga bisa dilakukan dengan cara Penyidik (Polwan) Unit Perlindungan Perempuan dan Anak (UPPA) akan memberikan pertanyaan bahwa (dalam hal ini adalah korban), apakah kasus yang dialami akan dilanjutkan ataukah dilakukan perdamaian terlebih dahulu, dan dalam hal tersebut penyidik (Polwan) UPPA memberikan solusi kepada korban dan pelaku tentang pentingnya dan akibat positifnya dari hasil perdamaian terhadap penyelesaian kasus kekerasan fisik dalam rumah tangga kepada korban dalam hal ini adalah istri, sehingga dari solusi yang diberikan dapat memberikan motivasi kepada kedua belah pihak untuk berdamai dengan syarat-syarat sesuai dengan Peraturan Kepolisian Republik Indonesia (Perkap Kapolri) Nomor 8 Tahun 2021 tentang penanganan tindak pidana berdasarkan Restorative Justice.

Abstract

This paper examines the effectiveness of resolving physical violence against wives at the investigation stage carried out by investigators from the Women and Children Protection Unit (UPPA) of the Maluku Regional Police (Polda) through a restorative justice approach. This research is a sociological juridical (empirical) research. Efforts to resolve physical violence against wives at the investigation stage are carried out by UPPA investigators of the Maluku Regional Police (Polda) through restorative justce in the form of; (1) Involve all parties interested in the problem of crime (violence) to participate in solving collectively or together; (2) The perpetrator does not refuse and is willing to commit and is voluntarily responsible for compensating for the violence committed; and (3) Provide opportunities to the perpetrator in terms of reaching a resolution to the violence committed against his wife. The resolution of physical violence against wives at the investigation stage carried out by investigators from the Women and Children Protection Unit of the Maluku Regional Police based on the resolution efforts described above through a restorative justice approach has been effective, this is because the victim does not want to continue the case to the court stage which will lead to divorce.

Abstract

Introduction: The Indonesian government has issued a number of policies to support criminal law enforcement during the Covid-19 pandemic. Children are entrusted by God Almighty who must be guarded and protected as the next generation of the nation and State. Children's rights must also be fulfilled and protected from violence and all forms of discrimination and treatment that are contrary to the general principles of child protection. As for the events that occurred after the Covid 19 pandemic, namely children committing violence against fellow students where the chronology of events was on Monday, October 10, 2022 at around 15.00 WIT, located in front of the Ambon Muhamadiah school in Talake, where the perpetrator FF stopped the victim when he returned home from school and beat the victim using his right and left hands repeatedly on the victim's face and kicked the victim from behind hitting the victim's spine. RS saw the beating and immediately ran towards the victim and also beat the victim using his right fist and left fist towards the back of the victim's head.Purposes of the Research: This study uses normative legal research methods. Peter Mahmud Marzuki, argues that normative legal research which is another name for doctrinal legal research is also known as library research or document study because this research is carried out or shown only on written regulations or other legal materialsResults of the Research: The reasons why children commit violence in the form of maltreatment during the post-pandemic covid 19 online school include; 1) Internal Factors which are divided into; a) the child's own factors where the child has a bad character; b) parental or family factors where the child grows and develops with violence from both parents; c) poverty factors where a person is unable to meet his own needs according to the standard of living; and d) the presence of unwanted children, namely parents who do not anticipate pregnancy so they will do everything in their power to get rid of the child, then 2) External factors consisting of; a) outer circle factors where this factor talks about a bad environment that causes children to commit violence against other children in the form of maltreatment; b) social media where users can easily participate, communicate, share, and create different content without space and time restrictions; and c) cultural factors where they still think that the status of children is underestimated and must be punished if they do not conform to parental expectations.

Abstract

Introduction: Criminology is the study of crime and criminal acts. The Maluku province has a local alcohol soothing drink, namely, Sopi which is the result of calming sap or sweet liquid obtained from plant stems, and is produced by people for generations on various islands in Maluku. Sopi is produced from the mayang tree (sageru) and is then processed traditionally using the knowledge that was also passed down by our predecessors. For this reason, sopi is always present in the traditional rituals of the Maluku people.Purposes of the Research:  To analyze and discuss the influence of alcoholic beverages (sopi) on crime in the Mngeswaen Village and the efforts made by the Police in tackling traditional alcoholic beverages (sopi) in the Mngeswaen Village.Methods of the Research: The research method used is empirical legal research, namely a type of legal research that analyzes and examines the operation of law in society. qualitative analysisResults of the Research: The results of the study show that the causes of the people of Mngeswaen Village consuming sopi are due to several reasons, namely community habits, alcohol addiction, feeling agitated and depressed, generating a spirit of mutual cooperation, social climbers, strengthening friendships and calming the mind to sleep soundly. The adverse effects of drinking sopi include fights between the residents of Mngeswaen Village. Countermeasures against the adverse effects caused by traditional alcoholic beverages (sopi) are carried out through preventive and repressive efforts by the local police, as well as by the village government, traditional leaders, religious leaders, educational leaders, health leaders as well as community leaders.

Abstract

Introduction: Nowadays, there are many irregularities related to the Health Act. The urgency of problem solving arising from medication errors is very great because one type of medication error, namely administration error, ranks first compared to other types of medication errors. With the percentage of administration errors amounting to 81.32% of errors related to medical administration that occur in Indonesia.Purposes of the Research:  To understand and explain the juridical responsibility that must be imposed on the perpetrators of selling prescription drugs without a doctor's prescription through online buying and selling sites.Methods of the Research: Research methods are used to find and process data in accordance with the research objectives and solve the problems posed by researchers.Results of the Research: The results showed that: (1). In Law Number 17 of 2023 concerning Health (hereinafter referred to as the Health Law) there are offenses that can be imposed on the perpetrator, these offenses are listed in Article 435 & Article 436. Article 435 states that every violation of medication error will be sentenced to imprisonment for a maximum of 12 (twelve) years or a maximum fine of Rp5,000,000,000.00 (five billion rupiah). Meanwhile, a person who does not have the expertise in the field of pharmacy in accordance with the provisions of the Law but continues to distribute pharmaceutical preparations will be subject to the offense in article 436 with a maximum imprisonment of 5 (five) years or a maximum fine of Rp. 500,000,000.00 (five hundred million rupiah).” Countermeasures against prescription drugs without a doctor's prescription can basically be dealt with by article 435 and article 436 of the Health Law, and there is a lot of evidence of the existence of these two articles that apply to offline prescriptions drug dealers.  (2). Countermeasures against the distribution of prescription drugs through online buying and selling sites are still somewhat ambiguous because there is no law that specifically regulates the countermeasures of prescription drugs online, which causes a legal vacuum in countermeasures against the distribution of prescription drugs online. Therefore, elaboration, and hard work from every law enforcement officer is needed to tackle the problem.
