Abstract

ABSTRACT: According to Law Number 17 of 2014 as amended in Law Number 14 of 2014 concerning MD3, specifically Article 302 paragraphs 1 and 2 states that DPD members are prohibited from holding concurrent positions if the position in question is as another state official or as a leader. Organizations financed by the State Revenue Budget/Regional Revenue Budget. The problem that then emerged was that there was a case that occurred in a DPD member who held the same position as leader of a political party, so this clearly violated the regulations regarding the DPD being prohibited from holding concurrent positions. For this reason, the implementation of the practice of holding multiple positions by DPD members as leaders of political parties is not in accordance with Law Number 17 of 2014. The aim of this research is to find out and analyze the dual position of a DPD member as a political party leader. The research used in this paper is normative legal research. The results of this research explain that the dual positions held by DPD members are contrary to statutory regulations which ignore Article 302 paragraphs 1 and 2 of Law Number 17 of 2014 as amended in Law Number 14 of 2014 concerning MD3 regarding the prohibition of holding multiple positions for DPD members and the legal consequences of holding multiple positions for DPD members as leaders of political parties. They will be dismissed in accordance with the regulations that apply to DPD members who hold multiple positions.

Abstract

ABSTRACT: One of the important instruments in environmental management is permits. Licensing in an environmental context is referred to as an environmental permit. Environmental permits are understood as an important element in efforts to control activities and/or businesses so that the environment does not suffer a detrimental impact. In order to fulfill administrative activities to obtain environmental approval, there are documents that must be fulfilled, namely, AMDAL or UKL -UPL. After fulfilling one of these conditions, an environmental permit will be issued by the Minister, Governor, or Regent/Mayor in accordance with their authority by including the requirements contained in the environmental feasibility decision document or UKL-UPL recommendation. The research method used in this writing uses normative juridical research, where this type of research is analytical. The sources of legal materials used are primary and secondary legal materials. The collection technique is through literature study and then analyzed through descriptive methods. To obtain environmental approval, there are several conditions that must be met, one of which is through the ANDAL and RKL-RPL addendum. ANDAL is used as a careful assessment of the impact of an activity. ANDAL aims to analyze an activity that has the potential to have an impact on the environment, which will also become an important point in making decisions regarding permits for an activity. So it can be concluded that ANDAL is also the most important part of granting environmental approval.

Abstract

Introduction: Society as a legal subject has civil rights in legal interactions within the community. These civil rights come in many forms, and the socialization carried out includes marriage rights and contract rights. Therefore, legal socialization is necessary to provide enlightenment regarding civil rights.Purposes of Devotion: The purpose of this community service is to transform information and legal knowledge related to civil rights of the community.Method of Devotion: The outreach activities are carried out by conveying a) information and legal knowledge; b) dissemination of marriage law; and c) dissemination of contract law.Results of the Devotion: Increased public understanding of rights arising from civil law relationships, particularly marriage and contract. The community obtains information from the aspect of marriage law regarding the requirements of marriage, rights and obligations within marriage, and the legal consequences of marriage. From the aspect of contract law regarding the validity of unwritten contracts that are often made by the community and their legal consequences. This legal education is expected to provide guidance on legal protection and preventive measures.

Abstract

Introduction: Indonesia is one of the largest archipelagic countries in the world with a total of 17,508 islands and borders with other countries. As a country with a number of boundaries with other countries, Indonesia must strategically plan its borders to protect the sovereignty of its own country.Purposes of the Research: This writing aims to re-position the regional government's authority in managing marine natural resources, especially those in border areas.Methods of the Research: The research method used in this study is normative legal research or another name, namely doctrinal law research which uses statutory regulations as the basis for this research. The analysis uses the statutory approach (statute approach), and the conceptual approach (conceptual approach).Result of the Research: The results of this study indicate that in the Indonesian constitution, there is the authority given to Regency/City Governments to manage border areas for the welfare of the surrounding community and Indonesia as a whole. Thus this thesis was developed in the interest of advancing educational science.

Abstract

Introduction: Legal issues in this study include, What is the form of responsibility of local governments towards abandoned children and the legal consequences that arise if local governments do not carry out responsibilities towards abandoned children.Purposes of the Research: This paper aims to describe the legal consequences if local governments do not carry out their responsibilities towards abandoned children.Methods of the Research: The type of research used is normative research, where research is carried out by collecting legal materials obtained from literature studies. The problem approach used is a statutory approach and a conceptual approach. Legal materials are analyzed qualitatively to achieve clarity on the issues to be discussed.Results of the Research: The results of this study show that Legal consequences arising if the local government does not carry out its responsibilities towards abandoned children based on Perma No. 2/2019 Article 3 that local governments can be sued on the grounds of committing illegal acts because negligence towards the responsibility of caring for abandoned children has been regulated in laws and regulations, besides that it is also contrary to the principles of good governance

Abstract

Introduction: Employers can take action to suspend workers/laborers who are in the process of being laid off by continuing to pay wages and other rights that workers/laborers usually receive.Purposes of the Research: To analyze the absence of supervision and the imposition of administrative sanctions, triggering the non-compliance of employers related to the obligation to pay workers' wages while suspended.Methods of the Research: The method used to analyze and discuss this problem is Normative Juridical. The problem studied in this research is regarding the government's authority to supervise and provide administrative sanctions to employers who do not pay wages for suspended workers.Results of the Research: The research results show that the government has the authority to carry out supervision and provide administrative sanctions to employers who do not pay the wages of suspended workers based on data from the Manpower Service and the results of supervision carried out by labor inspectors.

Abstract

Introduction: The grace period for filing a lawsuit is conceptually aimed at ensuring legal certainty and government stability. The State Administrative Court in examining, adjudicating and deciding cases that have passed the grace period of 90 (ninety) days as regulated in Article 55 of Law Number 5 of 1986 The issues discussed are whether the State Administrative Court can accept the lawsuit which has passed the grace period and whether the State Administrative Court has the authority to examine, hear and decide on cases Number: 26/G/2020/PTUN.ABN.Purposes of the Research: provide academic input for the development of legal science, especially in the field of Constitutional Law, State Administrative Law related to the PTUN's Competence in Examining, Judging and Deciding Cases Number: 26/G/2020/PTUN.ABNMethods of the Research:  This research uses normative legal research, case approach, statutory approach and concept approach, primary, secondary and tertiary legal materials, legal material procedures using primary legal materials which are then linked to secondary legal materials and processing and analysis of legal materials using qualitative descriptive analysis.Results of the Research: The results of the study indicate that the competence of the State Administrative Court in examining, adjudicating and deciding cases that have passed the grace period is not the authority of the State Administrative Court. The period of 90 (ninety) days to file a lawsuit to the State Administrative Court (PTUN) plays a very important role, because if the period is lapsed, the State Administrative Decision (KTUN) cannot be contested anymore even if the KTUN issued by the agency or State Administration officials are not in accordance with applicable legal procedures

Abstract

According to Law Number 39 of 2008 concerning State Ministries, Article 23 to be precise states that ministers are prohibited from holding concurrent positions if the position in question is as another state official or being the head of an organization financed by the State Revenue Budget/Regional Revenue Budget. The problem that then arises is that there have been several cases of ministers holding concurrent positions as leaders of political parties. So this clearly violates the regulations regarding ministers who are prohibited from holding concurrent positions. For this reason, the implementation of the practice of holding multiple positions by ministers as leaders of political parties is not in accordance with Law Number 39 of 2008.The purpose of this study is to find out and analyze concurrent positions in accordance with the rules and regulations carried out by ministers and to find out and analyze the legal consequences of multiple ministerial positions as leaders of political parties. The research used in this writing is normative legal research.The results of this study explain that the concurrent positions carried out by the minister are in conflict with laws and regulations which have ignored Article 23 of Law Number 39 of 2008 regarding the prohibition of concurrent ministerial positions, and the legal consequences of concurrent ministerial positions as leaders of political parties will be dismissed based on President's prerogative for ministers who hold concurrent positions.

Abstract

Pulau Seram memiliki komunitas masyarakat hukum adat yang tergabung dalam suatu persekutuan hidup secara berkelompok dalam bentuk tertentu yang sering disebut Patai dalam bahasa Wemale. Persekutuan ini sebagai sarana untuk menghimpun masyarakat hukum adat sekaligus sebagai bentuk persekutuan pemerintahan adat yang secara hukum belum diatur secara jelas dalam sistem pemerintahan negeri saat ini terutama berdasarkan peraturan perundang-undangan. Tujuan dari pengabdian ini untuk memberikan penyuluhan hukum atau sosialisasi terkait kedudukan sistem pemerintahan adat Yapio Patai dalam persekutuan masyarakat hukum adat di Pulau Seram dan untuk memberikan pemahaman tentang pentingnya pengaturan Yapio Patai dalam pengaturan hukum. Pengabdian ini dilakukan dengan menggunakan metode penyuluhan hukum atau sosialisasi. Dengan hasil memberikan rekomendasi kepada masyarakat adat tentang kedudukan Yapio Patai dapat diterima oleh masyarakat persekutuan Yapio Patai sebagai bentuk pemerintahan adat yang tetap hidup dan berfungsi di tengah-tengah persekutuan tersebut, dan untuk menjaga eksistensi keberadaan persekutuan Yapio Patai dalam kaitan dengan hukum adat dan penyelesaian masalah-masalah adat antara marga-marga yang ada di dalamnya, maka direkomendasikan untuk membentuk Dewan Saniri Yapio Patai dengan Peraturan Bersama Kepala Pemerintah Negeri.

Abstract

Introduction: This article analyzes the concept of Green Constitution, which is essentially the idea of sustainable environmental development. The eco-friendly concept itself is more of a method rather than a status, more of a verb rather than an adjective.Purposes of the Research: The purpose of this article is to understand and analyze the concept of Green Constitution in the management of mining resources, as well as the government's supervisory responsibility over mining activities based on the Green Constitution concept.Methods of the Research: In conducting this research, the author employs a normative juridical legal research method. Juridical research refers to examining legal aspects based on legislation, while normative research is legal research aimed at finding legal rules and doctrines to address existing legal issues.Results Main Findings of the Research: Based on the findings of existing research, the Green Constitution functions as a critique of interests that only prioritize economic benefits over the environment. As a result of regulations that do not fully uphold the Green Constitution, there is an impact on the weak supervision from the government over mining activities.
