Abstract

Perpetrators of general crimes who are willing to cooperate with law enforcement are commonly referred to as justice collaborators. These individuals play a crucial role as a valuable source of information for law enforcement agencies in unveiling general crimes, particularly those involving intricate criminal networks. Justice collaborators offer testimony, guidance, and even assist in securing substantial evidence to bolster criminal cases currently under investigation by authorities. The primary objective of this research is to examine the overhaul of legal safeguards for justice collaborators within the Indonesian criminal justice system, aiming to facilitate the detection of general criminal activities. This research adopts a normative legal research approach with a statutory focus. The author, in addressing the research question, relies on primary legal sources, secondary legal materials, and tertiary legal references as parameters for problem resolution. For data collection, a qualitative approach was chosen, specifically emphasizing a quality assessment. Consequently, the technique employed for data collection in this study is qualitative analysis. Within this research, two pivotal issues related to reconstruction will be elucidated. First, the study will delve into the prerequisites for conferring justice collaborator status in general crimes. Second, it will explore the reconstruction of general criminal acts as actions eligible for justice collaborator involvement.

Abstract

ABSTRACT The Village Regulation is stipulated by the Village Head after being discussed and agreed upon with the Village Consultative Body which is a legal and policy framework in the administration of Village Government and Village Development. The stipulation of Village Regulations is a description of the various powers that the Village has with reference to the provisions of higher laws and regulations. So that as a legal product, the Village Regulation must not conflict with higher regulations and may not harm the public interest. One of the reasons for the promulgation of Law Number 6 of 2014 concerning Villages is the recognition that villages have rights of origin and traditional rights in regulating and managing the interests of the local community and playing a role in realizing the ideals of independence based on the 1945 Constitution of the Republic of Indonesia. This is because the recognition of the village as an autonomous region makes the village have a major role in managing, empowering and advancing the available resources, both natural and human resources. So that in the end they are able to move the wheels of development which must be accompanied by an awareness of the understanding of the spirit of autonomy for all village residents and the capacity of the apparatus as well as the community in understanding governance. Village / Traditional Village Institutions, namely Village / Traditional Village Government institutions consisting of Village / Traditional Village Governments and Village / Traditional Village Consultative Bodies, Village Community Institutions, and traditional institutions. The Village / Traditional Village Head or what is referred to by any other name is the head of the Village / Traditional Village Administration who leads the administration of the Village Government. The Village / Traditional Village Head or what is referred to by any other name has an important role in his position as an extension of the state close to the community and as a community leader. Tri Dharma Perguruan Tinggi is the vision of all tertiary institutions in Indonesia which consists of education and teaching, research and development, and community service. As an effort to realize this vision, the Pamulang University Master of Law study program by involving lecturers and students has held Community Service in the form of providing technical guidance to village heads and the Kalimati Village Consultative Body, Adiwerna District in drafting village regulations to be carried out in Kalimati village, Adiwerna District, Tegal Regency.  Keywords: Technical Guidance, and Village Regulations ABSTRAK Peraturan Desa ditetapkan oleh Kepala Desa setelah dibahas dan disepakati bersama Badan Permusyawaratan Desa merupakan kerangka hukum dan kebijakan dalam penyelenggaraan Pemerintahan Desa dan Pembangunan Desa. Penetapan Peraturan Desa merupakan penjabaran atas berbagai kewenangan yang dimiliki Desa mengacu pada ketentuan peraturan perundang-undangan yang lebih tinggi. Sehingga sebagai sebuah produk hukum, Peraturan Desa tidak boleh bertentangan dengan peraturan yang lebih tinggi dan tidak boleh merugikan kepentingan umum. Salah satu daru alasan di buatnya Undang-undang Nomor 6 Tahun 2014 tentang Desa adalah pengakuan bahwa Desa memiliki hak asal usul dan hak tradisional dalam mengatur dan mengurus kepentingan masyarakat setempat dan berperan mewujudkan cita-cita kemerdekaan berdasarkan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Hal ini disebabkan karena dengan diakuinya desa sebagai sebuah daerah otonom menjadikan desa memiliki peran utama dalam mengelola, memberdayakan dan memajukan sumber daya yang tersedia, baik sumber daya alam maupun sumber daya manusia. Sehingga pada akhirnya mampu menggerakkan roda pembangunan yang harus diiringi kesadaran akan pemahaman spirit otonomi bagi seluruh penggerak warga desa dan kapasitas perangkat juga masyarakat dalam memahami tata kelola pemerintahan. Kelembagaan Desa/Desa Adat, yaitu lembaga Pemerintahan Desa/Desa Adat yang terdiri atas Pemerintah Desa/Desa Adat dan Badan Permusyawaratan Desa/Desa Adat, Lembaga Kemasyarakatan Desa, dan lembaga adat. Kepala Desa/Desa Adat atau yang disebut dengan nama lain merupakan kepala Pemerintahan Desa/Desa Adat yang memimpin penyelenggaraan Pemerintahan Desa. Kepala Desa/Desa Adat atau yang disebut dengan nama lain mempunyai peran penting dalam kedudukannya sebagai kepanjangan tangan negara yang dekat dengan masyarakat dan sebagai pemimpin masyarakat. Tri Dharma Perguruan Tinggi merupakan visi dari seluruh perguruan tinggi di Indonesia yang terdiri dari pendidikan dan pengajaran, penelitian dan pengembangan, serta pengabdian kepada masyarakat. Sebagai upaya untuk mewujudkan visi tersebut, Program studi Magister Hukum Universitas Pamulang dengan melibatkan Dosen dan para Mahasiswa telah mengadakan Pengabdian Masyarakat dalam bentuk memberikan Bimbingan teknis kepada kepala desa dan Badan Permusyawaratan Desa Kalimati, Kecamatan Adiwerna dalam penyusunan Peraturan desa yang akan dilakukan di desa Kalimati, Kecamatan Adiwerna, Kabupaten Tegal. Kata Kunci: Bimbingan Teknis, dan Peraturan Desa

Abstract

Indonesia's constitutional system adopts a bicameral system with the presence of the Regional Representative Council (DPD) as a representation of regional interests. However, the effectiveness of the DPD within the legislative system still faces various challenges, particularly due to its limited authority compared to the House of Representatives (DPR). The DPD only has the right to propose and provide considerations on certain draft laws but does not possess full legislative authority. This study aims to analyze the existence and authority of the DPD within Indonesia's bicameral system, identify the challenges it faces, and offer recommendations for strengthening its role. This study employs a normative method with a legislative and conceptual approach. The findings indicate that Indonesia's bicameral system is asymmetrical, where the authority of the DPD remains far below that of the DPR, differing from the bicameral systems in other countries such as the United States, where both legislative chambers hold full authority. This limitation creates a dilemma in representing regional interests in national policymaking. Therefore, reforming the authority of the DPD is necessary to achieve a more balanced legislative system that reflects the principles of inclusive democracy.

Abstract

The provision of legal aid is one way to realize access to justice for the poor given by the state on the mandate of the constitution. Several regulations regarding legal aid have been issued by the state through the law and implementing regulations. The most explicit statutory provisions governing the provision of legal assistance are Law No. 16 of 2011 concerning Legal Aid. But the facts in the community, the regulations that have been made have not been effectively implemented so that the meaning of access to justice is biased. The ineffectiveness of the application of legal aid in Indonesia is an interesting legal issue to be followed up immediately to make effective the provision of legal aid in order to realize access to justice for the poor. Based on the Memorandum of Understanding (MoU) that was signed between the Faculty of Law at the University of Pamulang with the District of North Serpong, then as a follow up is the implementation of Community Service (PKM) in all sub-district in the Serpong Utara District, one of which is Lengkong Karya Sub-District. This is one form of the implementation of the Tri Dharma of Higher Education which is an obligation of the academic community of Pamulang University. Lack of socialization and access to information on free legal assistance for the poor among the increasing number of people who are in conflict with the law, either because they are victims, perpetrators, or witnesses of criminal cases, such as murder, theft, etc., or become parties to civil matters such as divorce, inheritance, land disputes, etc. So that this legal counseling activity is very urgent to do in order to guarantee the rights of the poor to legal assistance in accordance with the mandate of Law No. 16 of 2011 concerning Legal Aid. This journal is a mandatory output from PKM that has been conducted in accordance with PKM Edition XII guidelines. PKM activities have been carried out on 9-11 October 2019. Located in the Lengkong Karya Village Head Office, with staff members from the Lengkong Karya sub-district and other community groups, such as women who are administrators of Family Welfare Empowerment (PKK). There are two stages of the method of implementing PKM; First, the preparation stage which contains surveys and preparation of activity material; Second, the implementation phase is carried out using two methods, namely counseling and discussion.

Abstract

Setelah diberlakukannya undang-undang Informasi dan Transaksi Elektronik (ITE) di Indonesia, terdapat batasan-batasan tertentu dalam hal menyampaikan sesuatu melalui media social, terutama mengenai ujaran kebencian. Tujuan penelitian ini untuk mengetahui bagaimana implementasi Undang-Undang ITE dalam penyelesaian masalah ujaran kebencian pada media sosial. Metode yang digunakan metode studi kepustakaan. Hasil penelitian ini menunjukan pengimplementasian undang-undang ITE sudah disesuaikan dengan tujuan Undang-Undang Dasar Tahun 1945,akan tetapi, di dalam penyelesaian masalah ujaran kebencian selalu terikat dengan pasal karet yaitu pada pasal 27, 28 dan 29 Undang-Undang ITE. Pasal ini seolah menjadi momok yang mengerikan, bahkan dijadikan sarana untuk membalas dendam, membungkam kritik, memenangkan suatu perkara atau bahkan menjadi senjata politik. Saran dari kajian ini adalah  agar pemerintah untuk mengkaji ulang isi dari beberapa pasal dan juga sanksi-sanksi terhadap pelaku ujaran kebencian. Tri Dharma Perguruan Tinggi merupakan visi dari seluruh perguruan tinggi di Indonesia yang terdiri dari pendidikan dan pengajaran, penelitian dan pengembangan, serta pengabdian kepada masyarakat. Sebagai upaya untuk mewujudkan visi tersebut, Program studi Magister Hukum Universitas Pamulang dengan melibatkan Dosen dan para Mahasiswa telah mengadakan Pengabdian Masyarakat dalam bentuk memberikan Penyuluhan dan sosialisasi hukum kepada lapisan Aparat Desa dan masyarakat Desa Jagabaya dalam Sosialisasi Undang-Undang Informasi dan Transaksi Elektronik yang dilakukan di desa Jagabaya Warunggunung Lebak Banten

Abstract

Pelaksanaan Pengabdian kepada Masyarakat ini bertujuan untuk memberikan edukasi kepada siswa siswi yang ada di lingkungan SMK Sasmita Jaya 2 Pamulang Tangerang Selatan mengenai Pembuktian Dalam Tindak Pidana Kekerasan Seksual yang selama ini sering terjadi dilingkungan sekolah. Dengan adanya kegiatan PKM ini diharapkan dapat memberikan wawasan kepada siswa siswi  di SMK Sasmita Jaya terhadap dampak dari adanya kekerasan seksual yang sering terjadi dilingkungan sekolahan. Kegiatan ini dilakukan dengan memberikan ceramah,pemahaman, dan sosialisasi kepada siswa-siswa di SMK Sasmita Jaya Pamulang. Diharapkan dengan adanya kegiatan ini dapat mencegah terjadinya kekerasan seksual dilingkungan sekolah. Sebelum pelaksaan PKM dilaksanakan terdapat tahapan persiapan, tahapan awal dalam PKM meliputi: survey awal, pada tahapan ini dilakukan survey lokasi yaitu di SMK Sasmita Jaya 2 Pamulang Tangerang Selatan. Setelah survey maka ditetapkan lokasi pelaksanaan kegiatan di aula sekolahan SMK Sasmita Jaya 2 Pamulang. Penyusunan bahan mareti pelatihan yang meliputi slide dan makalah untuk peserta kegiatan. Materi penyusunan disusun dan disiapkan oleh narasumber. Pelecehan seksual adalah sebuah tindakan yang menjurus ke arah seksual yang tidak diinginkan oleh salah satu pihak. Terdapat ketidaknyamanan, intimidasi/ancaman pada korban pelecehan seksual tersebut. Dengan demikian, unsur penting dari pelecehan seksual adalah adanya ketidakinginan atau penolakan pada apapun bentuk-bentuk perhatian yang bersifat seksual. Sehingga bisa jadi perbuatan seperti siulan, kata-kata, komentar yang menurut budaya atau sopan santun (rasa susila) setempat adalah wajar. Namun, bila itu tidak dikehendaki oleh si penerima perbuatan tersebut maka perbuatan itu bisa dikategorikan sebagai pelecehan seksual. Adapun pasal pelecehan seksual dapat dijerat dengan menggunakan pasal percabulan sebagaimana diatur dalam Pasal 289 sampai dengan Pasal 296 KUHP. Selain dalam KUHP juga diatur dalam Undang-Undang Tindak Pidana Kekerasan Seksual sehingga bisa dapat lebih memberikan kepastian hukum terhadap para korban sehingga nantinya pelaku dapat mendapatkan hukuman yang setimpal.  Dalam hal terdapat bukti-bukti yang dirasa cukup, Jaksa Penuntut Umum yang akan mengajukan dakwaannya terhadap pelaku pelecehan seksual di hadapan pengadilan. Dengan demikian, di Indonesia, pelecehan seksual dapat dijerat menggunakan pasal percabulan yakni Pasal 289 hingga Pasal 296 KUHP dan Undang-undang Tindak Pidana Kekerasan Seksual, dengan tetap memperhatikan ketentuan unsur-unsur perbuatan tindak pidana masing-masing. Sebagaimana telah disebutkan sebelumnya, pelaku pelecehan seksual dapat diberikan ancaman hukuman pidana dengan jerat hukum maksimal asalkan memenuhi unsur dan terdapat bukti bukti yang kuat. Tindak pidana kekerasan seksual terhadap anak merupakan tindak pidana yang harus mendapatkan perhatian khusus, karena perbuatan dilakukan di tempat tersembunyi yang menyebabkan sulitnya mendapatkan saksi dan alat bukti, usia anak yang memungkinkan korban secara fisik dan psikis tidak berdaya untuk segera melapor sehingga menyulitkan mendapatkan visum et repertum, serta dampak yang ditimbulkan dari perbuatan tersebut yang dapat merusak kehidupan anak di kemudian hari. Karena kekhususannya, maka tindak pidana kekerasan seksual terhadap anak tidak dapat diperlakukan secara biasa.Kata Kunci : Tindak Pidana, Kekerasan Seksual, Pelecehan

Abstract

The very existence of the Constitutional Court is interpreted as a constitutional tribunal, which then becomes a new branch of power included in the judicial power. The model for appointing judges to the Constitutional Court may affect the independence and impartiality of the judiciary. In order to implement changes and improvements in the appointment of judges in Indonesia, we need to look at the model of appointment of constitutional judges in other countries. The aim of this research is to analyse the model of constitutional judges' appointment in Indonesia and compare it with the models of constitutional judges' appointment in other countries. The research method used is normative legal research by examining primary and secondary legal materials related to the appointment of constitutional judges. The research results show that there are several models of constitutional judge appointments in different countries, namely models involving the executive and legislative branches, models involving only the legislative branch, models involving all three branches of government, and models conducted by special institutions. Indonesia itself uses a model involving all three branches of government. This research also compares the system for appointing constitutional judges in Indonesia with other countries such as Germany, Austria and South Korea. The conclusion of this research is that the mechanism for appointing constitutional judges must be carried out in a transparent, independent and accountable manner in order to guarantee the independence of the Constitutional Court.
