Abstract

The concept of food security is food availability to everyone, which is reflected in the availability of sufficient and productive food in a sustainable manner. The purpose of this study is the reformulation of food security in the framework of people's welfare and national economic recovery with the end result to be achieved from food security to food sovereignty. The method used is juridical normative by examining the sources of law through theories, concepts, and legislation related to research. The results showed there are currently quite a lot regulations of food-related but its implementation is still considered less effective. Strategic steps regarding the reformulation of food security in the framework of national economic recovery for the future can be done by harmonizing and synchronizing legislation related to food, land management and spatial planning, and implementing agrarian reform. Law No. 18 of 2012 which specifically regulates food is considered not in accordance with the needs of the community and the times so that the government is expected to quickly and seriously revise these rules and create new legal rules that can accommodate problems in the community so that in the future not only food security is fulfilled but also food sovereignty.

Abstract

Minyak goreng sebagai kebutuhan pokok mendorong bentuk persaingan usaha tidak sehat. Hal ini terlihat pada kasus kelangkaan dan lonjakan harga minyak goreng kemasan tahun 2021–2022 yang menjadi sorotan dan menimbulkan keresahan publik di tengah tingginya kebutuhan akan minyak goreng. KPPU secara inisiatif telah melakukan investigasi dan berdasarkan hasilnya, melaporkan 27 pelaku usaha atas dugaan praktik kartel minyak goreng berupa pengaturan harga dan pembatasan distribusi. Dalam Putusan KPPU Nomor 15/KPPU-I/2022 menyatakan bahwa tujuh pelaku usaha terbukti melanggar Pasal 19 huruf c terkait pengendalian distribusi yang merugikan konsumen, dan menjatuhkan denda Rp71,28 miliar. Namun, Putusan Pengadilan Niaga Nomor 1/Pdt.Sus- KPPU/2023/PN Jkt.Pst yang merupakan hasil dari upaya hukum keberatan oleh tujuh pelaku usaha tersebut, membatalkan Putusan KPPU dengan alasan kurangnya bukti, serta menyatakan bahwa pembatasan distribusi disebabkan oleh perubahan kebijakan pemerintah. Perbedaan putusan ini menyoroti pentingnya pembuktian yang kuat, koordinasi antar lembaga penegak hukum, serta kebutuhan akan reformasi hukum persaingan usaha yang lebih responsif dan berpihak pada konsumen sebagai pihak yang dirugikan.

Abstract

Pengalihan hak tanggungan atas tanah dan bangunan melalui mekanisme cessie telah menjadi praktik umum dalam dunia perbankan, terutama saat terjadi kredit macet. Namun demikian, praktik ini kerap menimbulkan permasalahan hukum, khususnya terkait perlindungan hukum bagi penerima cessie yang menerima hak tagih atas objek jaminan. Penelitian ini bertujuan untuk menganalisis kewenangan hakim dalam menetapkan balik nama hak tanggungan kepada debitur baru serta meninjau kedudukan hukum penerima cessie dalam perspektif perlindungan hukum dan kepastian hukum. Penelitian ini menggunakan metode yuridis normatif dan yuridis empiris melalui pendekatan studi kasus pada Putusan Pengadilan Negeri Semarang Nomor 362/Pdt.G/2022/PN Smg. Hasil penelitian menunjukkan bahwa pengalihan hak tanggungan tanpa persetujuan debitur lama dapat menimbulkan ketidakpastian hukum, dan putusan pengadilan yang menyetujui balik nama sertifikat tanpa keterlibatan debitur lama dinilai tidak sejalan dengan prinsip legalitas dan perlindungan hukum yang diatur dalam Undang-Undang Hak Tanggungan. Oleh karena itu, diperlukan regulasi yang lebih tegas serta kehati-hatian hakim dalam memutus perkara serupa.

Abstract

The protection of the resilience of the domestic industry today is haunted by the practice of dumping by exporting countries of goods and services. Dumping is a competition practice between countries where the selling price of imported goods is below the normal price of good/services in the country. The practice of dumping is carried out by the exporting country by determining the price below or lower than the nominal value or the actual unit cost or can also be said to sell at a lower price in the importing country than in the producer country itself This is certainly detrimental to local businessmen and laborers in the country so that regulations from importing recipient countries are needed for the resilience of the domestic industry in order to sustain the national economy. Some exporting countries often practice dumping to increase the economic benefits of the country itself but can harm the importing country. To avoid this dumping practice, Indonesia’s anti-dumping laws has an important role in the concept of domestic industry resilience.

Abstract

The Job Creation Law which has been approved and ratified becomes Law Number 11 of 2020, cannot be separated from the taxation cluster. As it is known that taxes have a budgetary function as state revenue and regulating function as a reflection of the country's economic policy. This study aims to examine the priority of the regularend function of taxes in the taxation cluster in Law Number 11 of 2020 concerning Job Creation. The results of the study indicate that the regularend function of taxes accommodated in the Job Creation Law and Perppu Number  1 year 2020 Jo. Law Number 2 of 2020 as well as Law Number 7 of 2021 concerning Tax Harmonization can work in several ways, namely: in the context of funding investment in Indonesia, tax incentives on dividends from within the country are intended to reduce the tax burden that must be borne by taxpayers, differences in interpretation in determining the status of tax subjects affect the country or jurisdiction that has the right to impose, relaxation of provisions for crediting Input Tax, which is deemed unfair for business actors, Arrangements on the amount of administrative sanctions of interest and interest compensation which are applied by taking into account market interest rates; and Taxation of digital transactions carried out by foreign sellers or marketplaces.

Abstract

The Indonesian diaspora continues to fight for the right to dual citizenship in various countries around the world. The research aims to explore the concepts of limited dual citizenship and the concept of dual citizenship within the context of India with a study of cross-country analysis of Indonesia and India. The study employs normative legal research to analyze dual citizenship policies in these two countries, focusing on the relevant laws and regulations of each country. Furthermore, it utilizes descriptive comparative analysis to provide a comprehensive and systematic comparison of dual citizenry policies between the two countries. The results show that the Indonesian government's policy on the demand for dual citizenship is different in both countries. In addition, there are differences and similarities in the approaches taken by both countries, especially in the Overseas Citizenship of India (OCI) policy and the dual citizenship policy. This research could provide valuable insights for Indonesia in crafting similar policies that facilitate easier access and engagement for its diasa.
