Abstract

Homosexual behavior and prostitution are social phenomena often encountered in correctional facilities, including Cipinang Class I Penitentiary. This study aims to examine the relationship between homosexual behavior and the reality of prostitution occurring within the prison environment. The research uses a qualitative approach with in-depth interviews with inmates and prison staff. The findings show that environmental factors, loneliness, and economic needs are the primary causes of homosexual behavior and prostitution in Cipinang Prison. The limited conditions in prison create social dynamics that affect sexual behavior, both among inmates and with outsiders. Furthermore, economic factors also drive prostitution, where some inmates engage in such activities for financial gain. This study is expected to provide new insights into the social dynamics within correctional facilities and contribute to policy development to address prostitution and homosexual behavior in prisons.

Abstract

This study seeks to assess the implementation of preventive measures by correctional officers through repressive actions toward inmates, with a focus on analyzing Article 466 of the Indonesian Penal Code (KUHP) within the framework of rehabilitation and crime prevention. Preventive approaches aim to mitigate the risk of future criminal behavior, while repressive measures are designed to deter recidivism by imposing consequences. This research adopts a qualitative methodology, utilizing data collection techniques such as literature reviews and in-depth interviews involving inmates and correctional officers. The findings reveal that the enforcement of Article 466 KUHP significantly contributes to inmate rehabilitation and crime prevention efforts, despite several challenges in its practical application. Consistent enforcement of regulations, coupled with a more humanistic approach, can help balance the protection of inmate rights with the overarching goals of rehabilitation. This study recommends enhancing the capacity of correctional officers through continuous training programs and periodic evaluations to improve the effectiveness of preventive approaches and repressive measures in reducing recidivism rates.

Abstract

Crime is a phenomenon that cannot be avoided and occurs very often in society. Crime can happen to someone regardless of the victim's background, so it can be said that crime cannot be avoided in society and can cause anxiety and a sense of insecurity for Indonesian society. The aim of this research is to understand the school of crime process of recidivist prisoners in this case study (Case Study of the Kalianda Class IIA Penitentiary). After going through the stages of the judicial process such as investigation, trial and determination of punishment, the perpetrator of the crime will be directed to serve his sentence in a correctional institution. Prisoners in correctional institutions receive personality and independence development. The coaching program was not successful because of the large number of prisoners. As a result, there is a School of Crime within the "School of Crime" correctional institution where prisoners can learn various ways of committing crimes, both directly from their interactions with other people and indirectly from the influence of their environment. This is in accordance with Edwin H. Sutherland's Deferential Association theory, which states that crime is not something that is inherited or taught from parents. Abstract

This study aims to examine the consequences of disciplinary punishment for inmates from the perspective of labeling criminology, with a focus on the Pati Class IIB Correctional Institution. Disciplinary punishment in correctional institutions aims to enforce order, but it is inseparable from the labeling process and social intervention that has various consequences. This study uses qualitative methods and finds two classifications of consequences : negative and positive. Negative labeling can lead to loss of social opportunities, discrimination, isolation, and an increased risk of repeat offenders. Abstract

The increasing crime rate has led to overcrowding in correctional facilities. This condition poses a barrier to the implementation of rehabilitation programs, which are the rights of every inmate during their incarceration. Given the diversity of inmates' backgrounds, in-depth identification is needed to assess each individual's criminogenic needs. Risk and needs assessment instruments are used to evaluate the risk of recidivism among inmates and to identify criminogenic factors. The results of these assessments should serve as a reference in the formulation of rehabilitation programs. However, in practice, the assessment results are often not used as the primary basis for providing rehabilitation programs. This study aims to determine the relevance of risk and criminogenic needs assessments in the implementation of inmate rehabilitation. The research employs a qualitative method with data collection techniques including literature review, interviews, and documentation. The results indicate that risk and needs assessments remain relevant to the condition of the correctional system in Indonesia, particularly in supporting the adopted philosophy of social reintegration. However, there are several challenges in implementation, such as the unavailability of assessors in correctional facilities, leading assessments to be conducted by social workers and correctional staff. Additionally, the available rehabilitation programs are still limited, resulting in not all recommendations from the assessments being accommodated through existing rehabilitation programs. In conclusion, assessments are highly relevant to rehabilitation programs for inmates, and future developments in assessment and the digitalization of assessments are needed. Abstract
