Abstract

Indonesia, with its cultural and social diversity, is a complex stage for the interaction between law and socio-cultural values. This paper aims to outline the role and impact of law-changing aspects in the socio-cultural context of Indonesia.Through a literature review, it is found that law often not only reflects cultural values, but can also be a significant agent of change in modernizing and adjusting the socio-cultural order. Factors such as globalization, information technology, and urbanization have shaped a dynamic legal landscape, presenting new challenges in maintaining a balance between cultural norms and legal advancement. Meanwhile, conflicts between local traditions and national or international law often create tensions in the Indonesian legal system. Nevertheless, through mechanisms such as inclusive legal interpretation and intercultural dialogue, efforts have been made to facilitate integration between legal and socio-cultural aspects. This research also highlights the need for a culturally sensitive approach in the law-making process, as well as the importance of community inclusion in policy formulation to achieve harmony between legal progress and cultural sustainability. By understanding these complex dynamics, it is hoped that the Indonesian people can develop a legal system that respects and strengthens their cultural heritage, while still adapting to the ongoing changes of the times

Abstract

Based on village authority which is a form of village government, the village head has a role in the splendor of the democratic party in Indonesia which will be held on February 14 2024, but the role of the village head is so important as the head of the village government, it is necessary to study the head's neutrality. villages in general election campaigns and regional head elections in Indonesia. The method used in this research is normative juridical. The method used in carrying out the research is carried out by collaborating in the form of data and field facts. The problem approach used in this research is normative. The neutralistic implementation of village heads based on the election law and village law in elections shows that the Division for Handling Violations of the Election Supervisory Agency (Bawaslu) of DKI Jakarta Province, Benny Sabdo, emphasized that the campaign activities of election participants are prohibited from involving the State Civil Apparatus (ASN) and village heads and factors. The basic thing about the neutrality of village heads in elections is that there is concern that there will be a conflict of interest between village officials and the community and this is also regulated in Law Number 7 of 2017 concerning elections in Article 20 Paragraph 2 which states that village officials are among the parties who are prohibited from being included by the implementer or team. campaign in election campaign activities. The prohibition on village officials from taking part in practical politics is also contained in Law no. 6 of 2014 concerning Villages, Article 29 letter g states that village heads are prohibited from being administrators of political parties and in letter j village heads are prohibited from participating and/or being involved in election campaigns and/or Pilkada. Village officials are advised not to get involved in political activities, either as cadres and campaign activists.

Abstract

Article 2 of Law Number 2 of 2002 concerning the National Police of the Republic of Indonesia outlines the function of the police in maintaining order and security in society. The problem raised in this research is how to implement Article 3 of the National Police Chief's Regulation Number 7 of 2021 in preventing crimes committed by teenagers. As well as factors inhibiting the implementation of Article 3 of the National Police Chief's Regulation Number 7 of 2021 concerning Bhayangkara as a Builder of Community Security and Order by Bhabinkamtibmas in preventing crimes committed by groups of teenagers. Abstract

This article aims to examine the thought of misyar marriage according to Yusuf Al-Qardhawi, and aims to prohibit the practice of misyar marriage in Indonesia. So this research examines the law of misyar marriage from Al-Qardawi's perspective and its contribution to the reform of family law in Indonesia.  This article includes library research. This research is descriptive analytical. The primary data in the research are the Qur'an, Hadith, Yusuf Al-Qardhawi's works, Law Number 1 of 1974 concerning National Marriage Law, and the Compilation of Islamic Law. The secondary data are scientific works, research, journals that are relevant to the research topic. Using Gustav Redbruch's theory of legal objectives and maslahah mursalah, the data analysis in this study uses inductive thinking techniques then the author makes data analysis with qualitative analysis. The result of this article is that misyar marriage according to Al-Qardhawi is a marriage that is not in accordance with the purpose of the ordinance of marriage, namely to form a family that is sakinah mawaddah and rahmah, but there is a gap in Law Number 1 of 1974, concerning Marriage in Article 2 Paragraph (1) "Marriage is valid, if it is carried out according to the laws of each religion and belief". When referring to this article, it can be said that it is valid, so that in order to provide assertiveness to prohibit the practice of misyar marriage and marriage practices that are not in line with the principles of marriage, it is necessary to provide a clear definition of marriage. Keyword: Misyar; Yusuf Al-Qardhawi; Family Law in Indonesia

Abstract

Politik pemerintahan desa pasca Undang-Undang No 6 Tahun 2014 Tentang Desa berpengaruh arus kuat terhadap peran aktif perilaku pelaku pemerintahan desa, seperti kepala desa, perangkat desa dan Badan perwakilan Desa untuk menerapkan good village governance pada pemerintahan desa. Teknologi merupakan bentuk good village governance dalam mewujudkan good village governance. Penelitian ini bertujuan untuk mengetahui apakah ada peraturan dalam penerapan good village governance di era desa digital; dan mengetahui bagaimana perkembangan digitalisasi good village governance di Provinsi Lampung. Pendekatan masalah dilakukan melalui pendekatan undang-undang (Statute approach), pendekatan historis (historical approach), dan pendekatan konseptual (conceptual approach), selanjutnya dianalisis secara menginterpretasi hukum positif yang berlaku melalui metode interpretasi otentik, interpretasi sistematis. Hasil pembahasan dalam penelitian ini adalah 1) Provinsi Lampung adalah salah satu provinsi yang harus mengikuti perkembangan peraturan desa menuju good village governance. Provinsi Lampung juga mengikuti program pemerintah melalui program desa berjaya berdasarkan Peraturan Gubernur Lampung Nomor 18 Tahun 2021 Tentang Program Desa Berjaya yang berisi tentang pengintegrasian terhadap desa juga melalui smart village untuk menuju program pemerintah di era desa digital dan mandiri. Selain itu, 2) implementasi smart village sudah berjalan sebagaimana data Pemberdayaan Masyarakat Desa dan Transmigrasi (PMDT) Provinsi Lampung yang mencatat sebanyak 1.792 desa yang ada di daerah setempat telah menggunakan aplikasi Smart Village. Jumlah tersebut mengalami peningkatan yang cukup signifikan dari tahun 2021 yang hanya berjumlah 563 desa. Sisanya sedang berproses, hal ini dikarenakan masih ada desa di Lampung yang masuk ke dalam kategori blank spot.

Abstract

Desa wisata menunjukkan potensi desa untuk pariwisata. Memahami karakteristik, kekuatan, dan kelemahan desa sangat penting untuk mengembangkan desa wisata yang dapat dipasarkan. Partisipasi masyarakat lokal dalam pengembangan desa wisata sangat penting bagi pembangunan desa. Penelitian ini mengkaji pengembangan desa wisata di Kabupaten Lampung Utara berdasarkan Peraturan Daerah Nomor 9 Tahun 2019 tentang Pengelolaan Desa Wisata dan mengidentifikasi hambatannya. Penelitian ini menggunakan pendekatan yuridis normatif dan yuridis empiris untuk menarik kesimpulan secara deduktif dan membahas permasalahan yang ada. Pengembangan desa wisata di Kabupaten Lampung Utara telah dimulai sesuai dengan Peraturan Daerah Nomor 9 Tahun 2019, tetapi belum mencapai potensi maksimal karena berbagai kendala. Hambatan-hambatan tersebut sesuai dengan Teori Sistem Hukum yang meliputi substansi, struktur, dan kultur. Pengembangan desa wisata di Kabupaten Lampung Utara berdasarkan Peraturan Daerah Nomor 9 Tahun 2019 terhambat karena kurangnya musyawarah, pendekatan personal, transparansi sistem pengelolaan, dan pemaksaan. Kepala Dinas Pemuda, Olahraga, dan Pariwisata Kabupaten Lampung Utara harus menegakkan hukum Pengelolaan Desa Wisata. Bekerja sama dengan para pelaku pariwisata dapat meningkatkan partisipasi masyarakat dalam Pengelolaan Desa Wisata.

Abstract

In social dynamics, societal heterogeneity is evident in various dimensions, including culture, ethnicity, religion, and race. This diversity affects behaviors, thinking patterns, and knowledge. Addressing these differences is crucial to fostering a shared understanding of common needs, as it prevents potential conflicts and ensures social cohesion. This study focuses on how social changes impact legal reforms within an open legal system framework. The research employs a qualitative, normative juridical method, emphasizing doctrinal research and library research to analyze how legal systems adapt to social changes. Results indicate that for legal changes to be effective, they must align with local wisdom and accommodate modernization, ensuring the legal system remains dynamic and responsive. The study concludes that an open legal system is essential for aligning legal reforms with Indonesian values and societal needs.
