Abstract

Goodtea is a trademark of a system of ready-to-drink tea beverage business opportunities that offers a choice of diverse and quality flavors. Where consumers can enjoy tea drinks that are beneficial to health, delicious and varied flavors. This study discusses the problem of the influence of product differentiation and promotional mix on purchasing decisions. The purpose of this study was to determine the magnitude of the effect of product differentiation and promotion mix simultaneously on purchasing decisions. The research method used is library research and field research. Data collection techniques using questionnaires, interviews and observations. The population in this study is GOODTEA consumers in Gajah Mada Plaza estimated as many as 2400 customers each month. This study used 240 samples. This study uses SPSS V.23 to calculate, process and analyze research data. The results of the study show that there is a strong and significant influence between product differentiation and promotion mix simultaneously on purchasing decisions of 41,4%

Abstract

Tentara Nasional Indonesia (TNI) adalah salah satu komponen negara yang memiliki tugas utama untuk menjaga kedaulatan negara, mempertahankan keutuhan wilayah NKRI, serta melindungi seluruh bangsa dan tumpah darah Indonesia dari ancaman dan gangguan terhadap integritas bangsa dan negara. Tugas utama TNI dalam menegakkan kedaulatan NKRI dilaksanakan melalui Operasi Militer Perang (OMP) dan Operasi Militer Selain Perang (OMSP). Dalam pelaksanaan OMSP, TNI didukung oleh beberapa unsur kesehatan seperti Rumah Sakit Darurat Lapangan dan Rumah Sakit Bantu Kapal, yang dapat beroperasi baik dalam situasi bencana maupun non-bencana. Persetujuan tindakan medis atau informed consent merupakan proses komunikasi penting untuk menyamakan pemahaman tentang tindakan, perawatan, atau prosedur medis yang akan dilakukan. Informed consent sangat penting bagi tenaga kesehatan dan medis sebagai bukti persetujuan atas tindakan operasi, anestesi, atau prosedur lain yang berpotensi menimbulkan sengketa medis. Keberadaan informed consent juga memberikan perlindungan hukum bagi petugas medis. Dalam penanganan medis saat bencana, dilema etik, termasuk terkait informed consent, bisa muncul. Dokter, baik secara umum maupun khususnya dokter TNI yang bertugas dalam OMSP, harus selalu menerapkan prinsip-prinsip etik seperti nonmaleficence, manfaat, keadilan, dan otonomi dalam menghadapi potensi dilema etik selama pelayanan kesehatan di OMSP.

Abstract

One important part of occupational safety and health protection efforts is health examinations for workers. In this process, doctors play a central role in determining whether a worker is medically fit to perform their job duties. This decision on fitness for work is not only medical in nature, but also has significant legal implications for workers, employers, and doctors themselves. This study aims to examine the legal responsibilities of doctors in determining work fitness based on the results of medical examinations, as well as to explore the limitations and professional obligations of doctors in the context of employment. The research method used is normative juridical with a regulatory and literature study approach. The results of the study show that doctors are required to prioritize the principles of prudence, professionalism, and objectivity in providing medical assessments of work fitness. Errors or negligence in providing recommendations can lead to legal liability, whether civil, criminal, or medical ethics. Therefore, it is important for doctors to understand the legal basis, professional standards, and medical ethics in carrying out occupational health examinations

Abstract

Indonesia perlu segera melakukan peng-harmonisasian peraturan dan perundang-undangan tentang layanan Telemedicine, sehubungan dengan perkembangan market bisnis perusahaan teknologi kesehatan / Start-up sebagai penyedia layanan Telemedicine yang meningkat sangat signifikan. Namun belum ada pengaturannya secara khusus. Meskipun Undang-undang Kesehatan nomor 17 Tahun 2023 dan Peraturan Menteri Kesehatan Nomor 20 Tahun 2019 mengatur tentang Telemedicine, hanya sebatas antar fasilitas pelayanan kesehatan (fasyankes). Sedangkan start-up bukanlah fasyankes. Tujuan dari Penelitian ini adalah untuk Mengkaji dan Menganalisis bagaimana tanggungjawab hukum pemerintah dan perusahaan teknologi kesehatan terhadap pelaksanaan peraturan layanan telemedicine. Jenis penelitian yaitu yuridis normatif dengan Pendekatan Perundang-undangan dan Pendekatan Konseptual, menggunakan data sekunder yang akan dianalisis secara Kualitatif baik itu deskriptif maupun Preskriptif Analisis. Hasil Penelitian menunjukan bahwa Pemerintah sudah menjawab situasi era disrupsi teknologi dan mengatur layanan Telemedicine walau hanya pada fasilitas pelayanan kesehatan saja, namun bukan berarti provider Telemedicine berupa start-up / perusahaan teknologi kesehatan dianggap illegal di Indonesia. Kementrian Kesehatan di awal tahun 2020 telah bekerjasama dengan mereka pada saat terjadinya pandemic COVID-19 dan market bisnis telemedicine terus berkembang maka pengharmonisasian Undang-undang Kesehatan Nomor 17 Tahun 2023 dan Permenkes Nomor 20 Tahun 2019 dengan kebijakan bisnis para Provider Telemedicine sangat diperlukan agar tercipta kepastian hukum bagi perlindungan pasien / pengguna dan pihak-pihak yang terlibat ikut bertanggungjawab terutama perusahaan teknologi kesehatan/start-up. Kesimpulan: Kementrian Kesehatan-RI telah mengeluarkan kebijakan Program Sand Box Regulatory untuk monitoring dan evaluasi semua provider, namun ini perlu didukung dengan peraturan pemerintah sebagai hukum yang mengikat semua provider telemedicine.

Abstract

Public health is a critical component of national development and a fundamental humanright, as stated in the 1945 Constitution of the Republic of Indonesia. Law Number 17 of2023 on Health categorizes drugs into two main types: prescription and non-prescription. In Indonesia, over-the-counter and limited over-the-counter drugs arefrequently sold in small shops and grocery stores. This practice stems from a lack ofpublic awareness regarding regulations governing pharmaceutical service locations, theauthority of pharmaceutical personnel, and standardized distribution channels, compounded by insufficient government oversight. This study aims to conduct a juridicalanalysis of the sale of over-the-counter and limited over-the-counter drugs in smallshops and grocery stores based on the Health Act. The research employed a normativejuridical approach. Article 145 of Law No. 17 of 2023 on Health mandates that over-the-counter and limited over-the-counter drugs must be sourced from pharmaceuticalservice facilities or other authorized outlets, such as hypermarkets, supermarkets, and andminimarkets. Furthermore, Article 436 imposes a criminal penalty of up to IDR200.000.000 on individuals without the proper authority and expertise in pharmaceuticalservices, while Article 439 stipulates imprisonment of up to 5 years or a maximum fineof IDR 500.000.000. Effective law enforcement and supervision by the National Agencyof Drug and Food Control (BPOM), alongside consumer protection, are essential inmaintaining the quality and safety of medications. Although oversight in small shops andgrocery stores is limited, the existing regulatory framework aims to mitigate risks andensure that the drugs in circulation adhere to safety and quality standards.
