Abstract

Terrorism has been qualified as a serious crime in Indonesia. The gravity of the crime can be estimated based on the fact that a person accused of such an offence is classified as a high-risk offender. However, complications arise when children and/or youth are suspected of this crime. Indonesia has ratified international human rights instruments, including the Convention on the Rights of the Child. The question emerges on how the rights can be exercised when youth is suspected to commit such high-degree crime. There are some laws that must be taken into account for further analysis in relation to this issue, especially the Law on Juveniles Justice System and the Terrorism Law. The context of how these laws intersect with the implementation of the Rights of the Child is important to be considered for the best interest of the child, including their comprehensive rehabilitation and reintegration process. The philosophical legal approach used in this research aims to have comprehensive analysis and solution of the complexity associated with the implementation of the rights of the children associated with a terrorism charge, especially when it comes to the legal system. It is also of critical importance to identify possibilities of improvement in the implementation of these rights.

Abstract

Abstract

Development in Indonesia is currently marked by a variety of economic growth. Indonesia's national development is a development paradigm that is built on the experience of Pancasila, namely the development of the whole Indonesian human being and the development of the Indonesian people as a whole and Article 33 of the 1945 Constitution. Thus, the RPJMN includes the Sustainable Development Goals (SDGs). The focus of development is welfare, which cannot be separated from issues economy. In this framework, policy tools are needed, especially the economic sector that can support welfare and achieve justice. This Economic Analysis of Law (EAL) approach can be used as a means to see the role of law in supporting the achievement of prosperity and justice through an economic perspective for the development. This research is normative-doctrinal by exploring legal products and curating literature (written, visual, and audiovisual) to map out the role of law in development using the EAL approach. The findings from this study indicate that EAL approach can be used as a tool to critise and analyse legislations and situation which are contribute significantly to development, namely: the economic policy and legislation, the restorative justice sector, and corruption.

Abstract

Human rights are often perceived as obstacles to achieving national security, especially in the context of addressing past serious human rights violations. State repression plays a role in national security by impacting national stability, public trust, radicalization risks, international reputation, and economic outcomes. Thus, it is essential to examine how different countries have approached the resolution of past serious human rights crimes and how these approaches contribute to security from the perspective of repression management. Argentina, Cambodia, and Greece represent regions that have endured past severe human rights violations. The processes of addressing these violations in these countries offer valuable insights that Indonesia can consider in addressing its historical human rights issues. This study finds that nations like Greece and Argentina, which have effectively resolved past human rights abuses and gained international support, have seen reductions in repression, thus enhancing the intended security outcomes. In contrast, Cambodia's delayed and fragmented approach, lacking state commitment and international attention, has resulted in differing impacts on security compared to the outcomes observed in Greece and Argentina.

Abstract

Post-Cold War security in international relations is identified as security in the global contemporary. Contemporary global issues are closely related to issues that are no longer dominated by East-West relations, such as the threat of nuclear war, ideological competition between Liberal-Democracy and Marxism-Leninism, crisis diplomacy, and so on. From the perspective of liberalism, peace and security are important for the international system, and being considered by international law and organizations. However, recent developments in Afghanistan and Ukraine mark a challenge to this idea and challenge the consistency of peace and security under international law. This study uses the EUD (Explore, Understanding, and Doing) method to analyze the security context and the juridical-normative research to understand the international law that contributes to the aspect of security. The security landscape from the perspective of International Law is fragile against minorities and vulnerable groups because gaining power, in relation ot effective control doctrine in international law, does not necessarily associate to the security of human protection as the case happened in the new-Taliban-Afghan State.

Abstract

This paper explores how the concept of Bela Negara (state defense) in Indonesia must be redefined in light of evolving global security dynamics, especially amid digital transformation and the rise of hybrid threats (HT) and hybrid warfare (HW). Through a normative juridical and comparative approach, the study examines legal frameworks in Indonesia and other countries such as Singapore, Sweden, and the United States, highlighting differences in how citizen participation, resilience, and national security are framed. It argues that Bela Negara in Indonesia remains heavily tied to a traditional, militaristic understanding of security and must shift toward a more holistic model rooted in national resilience. Such a model includes individual, community, and institutional capacities to resist digital disinformation, violent extremism, and hybrid campaigns. Drawing lessons from total defense models and international frameworks on human rights and security, the article suggests aligning Bela Negara with democratic values, critical digital literacy, and a whole-of-society approach. This reconceptualization is necessary to ensure that Indonesian national security frameworks remain adaptive and inclusive in facing both conventional and emerging threats.
