Abstract

This article discusses global issues and its relation with national security. Global contemporary issues—drugs, migration, living environment, population, global economy challenges, liberal democracy crisis, fusion and division, small arms production—are issues that emerged as new security threats that transformed since the end of the Cold War. Security threats are no longer in form of “military attacks” that one country does to another, but are acts of crime that are performed by non-state actors and are aimed at state actors, individuals or citizens that ultimately threaten human security. Human security is a new term in response of threats from global contemporary issues. This article concludes that national security in the context of global contemporary issues in an international relations perspective is a complex issue. This is explained in the transnational theory in international relations. United Nations have reassessed the concept of national security which then noted about human security.

Abstract

Indonesia memiliki satwa seperti penyu sisik yang berperan penting dalam menjaga keseimbangan ekosistem laut, keberadaan habitat penyu menunjukkan kekayaan laut yang melimpah. Regenerasi penyu sisik tergolong rendah, sedangkan perburuan liar oleh manusia dan predator alami mengancam keberlangsungan hidupnya. Walaupun Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistem telah diundangkan, namun perdagangan penyu sisik masih marak terjadi, seperti dalam Putusan Pengadilan Tinggi Negeri Kupang Nomor 115/Pid/2019/PT KPG. menunjukkan adanya tindakan seperti perdagangan cinderamata berbahan dasar penyu sisik. Penelitian ini bertujuan untuk mengetahui bentuk pertanggungjawaban pidana dalam deelneming dalam perdagangan cinderamata berbahan dasar hewan penyu sisik dan untuk mengetahui alasan mengapa penyu sisik diburu dan dijadikan cinderamata sedangkan penyu sisik merupakan satwa yang dilindungi. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan konseptual, perundang-undangan, studi kasus. Yang mengkaji berdasarkan norma dan aturan hukum terkait dengan kasus pertanggungjawaban pidana dalam deelneming dalam perdagangan cinderamata berbahan dasar penyu sisik. Hasil penelitian menunjukkan bahwa meskipun peraturan perundang-undangan telah ditetapkan, namun pelaksanaan pengawasan dan penegakan hukum terhadap perdagangan ilegal belum optimal, dan perlindungan penyu sisik dari perburuan liar dan perdagangan cinderamata masih terjadi di berbagai lingkungan.

Abstract

Tidak ada definisi terorisme yang berlaku secara universal yang disepakati oleh semua negara di dunia. Namun dari banyaknya definisi terdapat persamaan dalam definisi terorisme yaitu, kekerasan terhadap individu, penyanderaan, pembunuhan, dan penyerangan terhadap properti orang lain merupakan kejahatan terorisme. Salah satu bentuk perkembangan baru dalam aksi terorisme adalah Foreign Terrorist Fighters (FTF). FTF adalah individu yang melakukan atau mencoba melakukan perjalanan ke luar negeri dengan tujuan terlibat dalam kegiatan terorisme. Penelitian ini bertujuan untuk mengetahui bagaimana pertanggungjawaban tindak pidana terorisme terhadap Warga Negara Indonesia yang terasosiasi dalam FTF. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa Indonesia dapat menuntut pertanggungjawaban pidana kepada warga negaranya yang terasosiasi dalam FTF di luar negeri seperti Suriah ataupun Irak dengan manganoan yurisdiksi personal. Namun dalam hal ini terdapat beberapa hambatan seperti pembuktian yang sulit, tindakan di masa lalu yang tidak dapat dikenakan hukum secara retroaktif, dan kesulitan dalam mengukukur tingkat tanggungjawab perempuan dan anak.

Abstract

Children and adolescents now live substantial parts of their lives in cyberspace, where the benefits of the digital environment are accompanied by rising exposure to cyber-enabled harms — principally cyberbullying and cyber violence, including its sexual forms. This article offers a comparative socio-legal analysis of how Indonesia and the Philippines regulate these harms for youth, employing a normative juridical perspective supported by secondary empirical evidence and read against Space Transition Theory, which attributes online offending to anonymity, identity flexibility, weak deterrence, and movement between physical and virtual settings. It argues that the protective deficit is, in the first instance, structural rather than national: the international regime regulates online harm largely by transposing pre-existing offline offences into the digital domain rather than recognizing natively digital harms, so that sexual cyber-harms against minors are comparatively well covered while non-sexual cyber violence survives only as soft-law aspiration or strained analogy, with ASEAN supplying no binding floor. The two jurisdictions inherit this gap differently — Indonesia through dispersed, analogy-dependent instruments lacking an offence-specific definition of cyberbullying, the Philippines through a more integrated but sexual-exploitation-focused framework that treats cyberbullying as a school-administrative matter — while sharing a common implementation deficit and a dual youth victim/offender reality. The article concludes with calibrated recommendations for offence-specific definition, statutory harmonization, coverage of synthetic harms, rehabilitative juvenile justice, and a regional binding instrument.

Abstract

In March 2020, The World Health Organization (WHO) finally announced a coronavirus or Covid-19 disease outbreak as a pandemic. According to WHO, the status of a pandemic is determined if a new disease has not had an antidote against the spread of the virus in regions of the world. The virus attacked individuals and no doubt the impact on people is significant, which relates to the security of the people and human rights aspects. The article explores the argumentative basis of human security and further analyzes the problem, strategy and needs in the lens of human rights related to pandemic in the framework of human security. It aims to analytically describe human security approaches in relation to the COVID-19 with human rights perspective through the common pattern of threat identified worldwide and plausible strategies based on literature study. The state strategy addressed in the article exists as a set of examples of best practices and/or critics toward the policy with materials provided by journals. The article uses a qualitative approach with a systematic literature study based on human security framework with human-right analysis and results in a generic set of human security frameworks for COVID-19 with the perspective of human rights.

Abstract

This paper examines how the implementation of liability for gross human rights violators in transitional justice contexts often involves "rule-bending." It focuses on the tension between legal norms and the interests of authorities, particularly in cases of enforced disappearances, concerning command responsibility. Taking into account the Indonesian case and comparing it to the implementation of the liability prosecution process in various countries, this research employed a socio-legal method and crime semiotics to deconstruct the law for analysis purposes. The research employed the rule of law theory by Lon Fuller as the grand theory, progressive law theory by Satjipto Rahardjo as the middle theory, and the liability theory of gross human rights violations, particularly in relation to Law No. 26 of 2000 as applied theory. The research results indicate that the rule-bending of processing the liability of gross human rights violators, particularly in the case of enforced disappearances, is associated with negative rule-bending, which involves a culture of autocratic legalism. The progressive law and transitional justice provide a solution to what this research indicates, which is the novelty of the research, as a transformative law model that covers the system of law and the individuals, particularly law enforcement officers, to be progressive: having compassion, empathy, and daring to prosecute the liability of past gross human rights violators.
